The following resolution was adopted: WHEREAS, Thomas McCance is the owner of the property known and designated as SCTM# 1000-6-5-5.4 and Ellen McCance Parker is the owner of the property known and designated as SCTM# 1000-6-5-12, located on Sappho Road and a r-o-w from Fox Ave.; and WHEREAS, this proposed lot line change is to subtract 1,252 square feet from the Ellen McCance Parker property and to add it to the Thomas McCance property; and to subtract 1,252 from the Thomas McCance property and to add it to the Ellen McCance Parker property; and WHEREAS, the two lots involved in the lot line application are Lots Number 3 and 4 of a four lot subdivision for Elizabeth McCance, which was approved by the Planning Board in 1990; and WHEREAS, prior to the Planning Board's 1990 subdivision approval, the lots within the subdivision received area variances from the Zoning Board of Appeals (1989 Appeal #3798); and Page 2 Proposed lot line change for McCance-Parker May 4, 1999 WHEREAS, as noted in a letter dated April 2, 1999, from Jerry Goehringer, ZBA Chairman, the ZBA has no objection to the exchange in the lot-line application as long as it does not change the final area of the lots shown on the map last dated March 2, 1999 and as long as the owner has met the other conditions related to the prior ZBA decision; and WHEREAS, the lot line application has been designed so that the final area of the lots remain the same; and WHEREAS, the Planning Board has received a notarized letter dated March 29, 1999, from Thomas McCance, stating that the kitchen has been removed from the accessory cottage in compliance with the ZBA condition; WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on April 5, 1999; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on May 3, 1999; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated March 30, 1999, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following condition. The condition must be met within six (6) months of the date of this resolution: 1. New deeds reflecting the lot line change must be filed for each parcel. The two lots involved in the lot line application are Lots Number 3 and 4 of a four lot subdivision for Elizabeth McCance, which was approved by the Planning Board in 1990. Prior to the Planning Board's 1990 subdivision approval, the lots within the subdivision received area variances from the Zoning Board of Appeals (1989 Appeal #3798) . The 1989 ZBA approval had a condition that the kitchen be taken out of the accessory cottage in Lot 3 and that it only be used for sleeping quarters. The Planning Board is requesting that an affidavit be submitted from the owner of Lot #3 (Thomas McCance) confirming that the ZBA condition has been met. I faxed a copy of the ZBA decision to your attention yesterday. Please let me know if you did not receive the transmission. 2. As noted above, both lots involved in the proposed lot line application received an area variance from the ZBA. The proposed lot line application has been referred to the ZBA for comments in regard to whether the proposed lot line change necessitates revisions to the 1989 ZBA approval. 3. As we discussed, the lot line proposal must be prepared at a scale of 111:1001. Upon submission of the information noted above, the Planning Board will proceed with the review of the lot line application. The lot in question is Section 006, Block 5, Lot 12 on County Tax Map No. 1000. As I mentioned yesterday, all of the adjacent property is owned by members of the same family. Our intention would be to move the western lot line further west in order to meet the 50 feet rear yard requirement. In turn, the northern lot line could be moved further south in order for each lot to maintain its current square footage. I've noted this on our Site Plan, A0.
