Dear Mr. Lark:
The following took place at the meeting of the Southold
Town Planning Board Tuesday, October 2, 1990.
The final public hearing, which was held at 7: 30 p.m. , was
closed.
The Planning Board passed the following resolution:
WHEREAS, Elizabeth F. McCance is the owner of the property
known and designed as SCTM#1000-6-5-3 ,5. 1 & 12 located at the
southeast side of Fox Avenue on Fishers Island; and
WHEREAS, this minor subdivision, to be known as Elizabeth
F. McCance Minor Subdivision, is for 4 lots on 4.739 acres;
and
WHEREAS, a variance for insufficient area was granted by
the Zoning Board of Appeals on September 21, 1989 , with a
condition that the kitchen be taken out of the accessory cottage
in lot 3 , and it only be used for sleeping quarters; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8 ) , Part 617,
declared itself Lead Agency and issued a Negative Declaration on
March 5, 1990; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
October 2, 1990; and

WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and
now therefore, be it
RESOLVED that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated
May 21, 1990.
Enclosed please find a copy of map which was endorsed by
the Chairman. The mylar maps, which were also endorsed by the
Chairman, must be picked up at this office and filed in the
office of the County Clerk. Any plat not so filed or recorded
within sixty ( 60) days of the date of final approval, shall
become null and void.

Mr. Orlowski: Good evening, I would like to call this meeting
to order. First order of business, at 7: 30 p.m. Elizabeth F.
McCance - This minor subdivision if for four lots on 4 .739
acres located on the southeast side of Fox Avenue on Fishers
Island.
SCTM # 1000-6-5-3 , 5, & 12. We have proof of publication in
both local papers. At this time everything is in order for a
final hearing. I ' ll ask if there are any objections to this
subdivision? Hearing none, are there any endorsements of this
subdivision? Are there any questions from the board?
Board: No questions.
Mr. Orlowski: Hearing no further questions, I ' ll declare this
hearing closed.
Mr. Edwards: I would like to offer the following resolution.
• WHEREAS, Elizabeth F. McCance is the owner of the
property known as designated as SCTM # 1000-6-5-3 , 5.1 & 12

• located at the southeast side of Fox Avenue on Fishers Island;
and
WHEREAS, this minor subdivision, to be known as Elizabeth
F. McCance Minor Subdivision, is for four lots on 4. 739 acres;
and
WHEREAS, a variance for insufficient area was granted by
the Zoning Board of Appeals on September 21, 1989, with a
condition that the kitchen be taken out of the accessory cottage
in lot three, and it only be used for sleeping quarters; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8) , Part 617,
declared itself Lead Agency and issued a Negative Declaration on
March 5, 1990; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
October 2, 1990; and
WHEREAS, all the requirements of the Subdivision
regulations of the Town of Southold have been met; and
now therefore, be it
• RESOLVED that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated May 21,
1990 .

Town Planning Board at a meeting held on January 18, 1990.
RESOLVED that the Southold Town Planning Board start the
coordination process on this unlisted action. The Board assumes
lead agency status and in that capacity makes an initial
determination of non-significance.
RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated March 13 , 1989 with the following
condition:
1. Due to the fact that this subdivision involves
pre-existing dwelling units with inadequate
road frontage, the access to Lot No. 3 is to be
shown as an easement over Lot No. 1. The right-
of-way is not to be a separate parcel as
currently shown.
Sketch plan approval is conditional upon submission of
final maps within six months of the date of sketch approval,
unless an extension of time is requested by the applicant, and

WHEREAS, a public hearing was held and concluded on
September 21, 1989 in the matter of the Application of ELIZABETH
McCANCE under Appeal No. 3798; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. the premises in question is located along the east
side of Fox Avenue, Fishers Island and is identified on the
Suffolk County Tax Maps as District 1000, Section 06, Block 05,
Lot 3-5 . 1.
2. this is an application for Variances from the Zoning
Code Article I , Section 106-20 (Article III , Section 100-31, for

4. The subject premises for the proposed lots are as
follows, approximately 1. 51+- acres for lot one ( 1) , Lot two ( 2)
is 1.00+- acres, lot three ( 3) is 1. 54+- acres and lot four (4)
is 0. 689+- acres.
(a) For the record, each lot is improved with preexisting
dwellings, except for lot #3, which consists of a main dwelling
and a cottage.
5 . In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(c) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.
Accordingly, on motion by Mr. Doyen, seconded by Mr.
Grigonis, it was
RESOLVED, to GRANT a Variance in the matter of the
application of ELIZABETH McCANCE as applied under Appeal No.
3798 for approval of insufficient area in this division of land.
SUBJECT TO THE FOLLOWING CONDITIONS:
(a) the only requirement is that the kitchen be taken out
of the accessory cottage in lot 3, and it only be used for
sleeping quarters.

Dear Mr. Orlowski :
After having a conference with the Town Attorney and the
Building Inspector it was decided to comply with the Planning
Board' s request of December 6 , 1988 and amend the Minor
Subdivision application to include Lot No. 4 . Accordingly,
the ZBA application has also been amended. However, the
Building Inspector after inspecting the property insists the
lot lines for Lot No. 4 remain the same. The reason for
this was due to the location of the dwelling on Lot No. 4 in
that any changes could encroach on Lot No. 3 and create
drainage problems in the future. Further, nothing would be
accomplished by increasing the size of Lot No. 4 as the
surrounding property is on an existing slope. The whole
purpose of including Lot No. 4 is because the Town Attorney
has decided from a Zoning point of view the land is merged
with the other property of Mrs. McCance. However, the
dwellings are exempt from the current zoning requirements.
Therefore, to avoid any future problems as to conveyancing
it was agreed that Lot No. 4 would be included in the
subdivision.
The Building Inspector also wanted the proposed Lot No. 3 to
remain "as is" because Cottage Place is a "paper street" . There
is nothing there but a large gulley. It would be economically
unfeasible to ever construct this into any type of roadway. By
allowing Lot No. 3 to have frontage on this "paper street" might
encourage someone in the future to attempt this.
It would be appreciated if you or the members of the
Planning Board would review the property so you can act promptly

Dear Mr. Orlowski :
As a courtesy the Board of Appeals forwarded me the
Planning Board' s opinion and request dated December 6 , 1988 .
Why the Planning Board would not forward a copy of this
correspondence to the undersigned is a question you should
answer.
I have reviewed this opinion with my client and she does
not agree with it. The property you want to merge in the
subdivision was purchased from Fishers Island Utility Company,
Inc. on March 26 , 1970 and it has its own separate Certificate
of Occupancy. I am enclosing a copy of this deed and
Certificate of Occupancy for your review. This has always
been a separate parcel of land. If the Board would only go
and inspect the property they would find this is a separate
parcel having nothing to do with the subdivision. The premises
contain an old dwelling which is rented out and has been so
for many years . It is topographically separate from the
property in the proposed subdivision and it makes no sense to
merge it into the subdivision as this parcel is to remain "as
is" with no diminishment or enlargement.
A considerable amount of time, thought and money was
spent by my client in laying out the three parcels which are
the subject of this subdivision request. The Suffolk County
Health Department requires each of the lots to have a minimum
of 40 ,000 square feet. If any changes are made to the
property lot lines this area requirement cannot be met.
Furthermore, the so called "Cottage Place" does not exist.
It is owned by Benjamin H. and Martha Kent Gray and why it
is listed as a road on the old map is beyond me. From a
topographical point of view it would be prohibitive to

construct a road on "Cottage Place" . The Grays do not intend
to develop it as a roadway. If the Board makes a property
inspection it is clear only Lot No. 3 needs a "legal right-of-
way" for access. Lots Nos. 1 and 2 front on Fox Avenue which
is a public street. Therefore, it seems senseless to vary the
lot lines for Lot No. 3.
I would appreciate the opportunity to appear before the
Planning Board to discuss this subdivision and receiving
copies of all correspondence generated by the Planning Board
on this application.

inconsistent with the proposed Master Plan which was adopted by
the Planning Board.

The Planning Board recommends that the building envelope for Lot
No. 2 be designed so that it is setback at least 75 feet from
the wetlands.
The Board also is aware that this subdivision is to be for
affordable housing. The Board thus recommends that a Covenant
and Restriction be asked for which states that this is to be for
affordable housing in perpetuity.

It is the Planning Board' s opinion that Lot No. 6-5-12 was
merged with Lot No. 6-5-3 . Research shows that both lots were
purchased in the same name (McCance) . The Board thus requests
that the lot labeled as Assessor Map 6-5-12 be included in the
subdivision as Lot No. 4 .
The Planning Board also requests that the lot line for Lot No. 3
be designed to allow for frontage on Cottage Place (please see

The Planning Board is not in favor of the variance. The site is
large enough to meet setbacks without a hardship. The granting
of the variance will set an unnecessary precedent in this area.
The surrounding properties are residential and this use should
be protected by adhering to yard setbacks in accordance with the
Town Code.

The Planning Board requests that all storage be inside, and that
no on site storage be allowed.
The Planning Board also requests that the number of employees
and uses of the building be described so as to calculate the
number of parking spaces.
Howard Luce (Lucas Ford) ZBA Appl. No. 3802
The Planning Board is requesting that the applicant use the same
material for all four sides of the building. Also, the gable
should continue around the rear of the building as it is visible
from CR 48 as well as from Horton' s Lane.
The Board is also requiring that the building be set back to
allow for a 75 foot buffer on Horton' s Lane.
The Board also requests that parking be in the rear, and not in
the front or side of the building.

Dear Ms . Schultze:
Please find enclosed a copy of a survey of a
piece of property owned by my client, Elizabeth
McCance, located on Fishers Island. The survey outlines
the subdivision proposal made to Mrs. McCance by the
surveyor. The property has always been a family com-
pound and each of the dwellings is occupied by one
of Mrs . McCance ' s four children. The un-numbered lot
is vacant.As far as I know , all of the dwellings are
pre-existing. It is Mrs . McCance' s desire to sub-divide
the property so that it can be legally distributed to
the children, each retaining their separate dwelling
with the land.
Could you please ask the Zoning Board of Appeals
to informally comment on the surveyors suggestion and I
would appreciate any alternative suggestions which
would achieve the same results . In the event that this
or some modification is acceptable to the Board I will
then be proceeding with a formal applicat ' n.

Dear Mr. McVann:
Your correspondence and survey of March 23 , regarding
the above property was reviewed by Mr. Edwards, our Fishers
Island Board member.
Mr. Edwards noted that the survey is incorrect since
there is a house on the un-numbered lot of Mrs. McCance. It
was also noted that this subdivision would constitute a major
subdivision with 5 lots .
Since the lots proposed do not meet the current zoning,
the Planning Board can not proceed with an application unless
a variance is obtained from the Board of Appeals.
If you choose to file an application with the Board of
Appeals, Mr. Edwards will review this matter with Mr. Doyen,
the Fishers Island Board of Appeals member.
If you have 'any questions, please don' t hesitate to contact
our office.
