RESOLVED rescinds resolution no.
that the Town Board of the Town of Southold hereby
2006-596, adopted at the July 11, 2006 regular Town Board meeting, which read as follows:
WHEREAS,
the Town of Southold strives to support cultural organizations and support its
downtown areas and;
WHEREAS
the Suffolk County Downtown Revitalization grant Round VI seeks applications
for funding for projects throughout the county that will enhance downtown areas and strengthen
the community and;
WHEREAS,
Custer Institute and Observatory is applying for funding under the Downtown
Revitalization Round VI grant;
NOW THEREFOR RESOLVED
that the Southold Town Board supports the application of
Custer Institute and Observatory and will serve as the conduit for the funds and;
FURTHER RESOLVED,
that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott Russell to enter into a contract with the Suffolk County to receive
funding on behalf of Custer Institute and Observatory.

WHEREAS,
the Town of Southold strives to support cultural organizations and support its
downtown areas and;
WHEREAS
the Suffolk County Downtown Revitalization grant Round VI seeks applications
for funding for projects throughout the county that will enhance downtown areas and strengthen
the community and;
WHEREAS,
North Fork Chamber of Commerce is applying for funding under the Downtown
Revitalization Round VI grant;
NOW THEREFOR RESOLVED
that the Southold Town Board supports the application of
North Fork Chamber of Commerce and will serve as the conduit for the funds for the capital
improvement project to repair and preserve one of Long Island's oldest preeminent attractions,
The Custer Institute and Observatory in Southold, and;
FURTHER RESOLVED,authorizes and
that the Town Board of the Town of Southold hereby
directs Supervisor Scott Russell to enter into a contract with the Suffolk County to receive
funding on behalf of North Fork Chamber of Commerce for the Custer Institute and
Observatory.

The proposed Local Law entitled, “

” reads as follows:
LOCAL LAW NO. ______ 2006
A Local Law entitled, “A Local Law in relation to extending the expiration date of the two
percent (2%) real estate transfer tax imposed in connection with the Town Community
Preservation Fund for ten years until December 31, 2030”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Legislative Findings.
The Town Board hereby finds that in 1998 the New York State Legislature adopted
Chapter 114 of the Laws of 1998 which authorized Towns in the Peconic Bay Region to
establish Community Preservation Funds for the purpose of preserving land for open space,
farmland preservation, historic preservation, and parks and recreation purposes. The revenue for
said fund was to be derived from a two percent (2%) real estate transfer tax. Pursuant to Chapter
114 of the laws of 1998, said real estate transfer tax was to expire on December 31, 2010. The
Town Board, by Local Law No. 39 of 1998, did implement the real estate transfer tax provisions
of Chapter 114 of the Laws of 1998. Said Local Law was approved by electors of the Town in a
mandatory referendum on November 3, 1998. Pursuant to the provisions of said Local Law, the
Town Community Preservation Fund and the real estate transfer tax went into effect on April 1,
1999.
By Chapter 250 of the Laws of 2002, the State Legislature authorized the Towns in the
Peconic Bay Region to extend the expiration date of the real estate transfer tax until December
31, 2020, subject to mandatory referendum. The Town Board did enact Local law 49 of 2002
which provided for such extension. The voters approved the local law at the general election
held November 5, 2002.
The Town Community Preservation Fund has been an unparalleled success in protecting
land for community preservation purposes. To date, the Community Preservation Funds in the
Peconic Bay Region Towns have generated more than $375 million for community preservation.
The result has been the acquisition of thousands of acres of land for the public benefit.

Authorization for the two percent (2%) real estate transfer tax will expire on December
31, 2020. The State has enacted a Chapter of the Laws of 2006, which authorizes the Towns to
extend the expiration date of the tax until the end of the year 2030.
The Southold Town Board finds that such an extension is critical to the continued success
of the Town’s community preservation goals. It is estimated that an additional ten (10) years of
the program, at current rates of revenue generation will provide more than $900 million in
additional revenue for the Peconic Bay Towns for land preservation. Further, by utilizing the
Southold Town Community Preservation Fund program in conjunction with low interest
borrowing and other conservation strategies, the Town would be enabled to buy more land now
before it is lost to development and before values escalate further.
The additional ten (10) years will provide the necessary revenue stream to fund such
preservation strategies. This Local Law implements the ten (10) year extension.
II. Extension of the Expiration Date of the Real Estate Transfer Tax.
Section 17-40 of the Town Code of the Town of Southold is hereby amended as follows:
§17-40. Effective date; referendum requirement.
This Article is subject to a mandatory referendum as set forth in §1449-bb of Article 31-
D of the Tax Law. This Article shall take effect on March 1, 1999, after approval at the general
election to be held on November 3, 1998, by the affirmative vote of a majority of the qualified
electors of the Town of Southold and filing with the Secretary of State; and provided further that
the real estate transfer tax imposed by this Article shall expire and be deemed repealed as to any
conveyance taking place after December 31, 2020 2030.
III. Proposition.
Pursuant to a Chapter of the Laws of 2006, this Local Law is subject to mandatory
referendum. Therefore, the following proposition shall be submitted to the electors of the Town
at the general election to be held on November 7, 2006:
“SHALL LOCAL LAW NO. OF 2006, ENTITLED ‘A LOCAL LAW IN RELATION
TO EXTENDING THE EXPIRATION DATE OF THE TWO PERCENT (2%) REAL ESTATE
TRANSFER TAX IMPOSED IN CONNECTION WITH THE TOWN COMMUNITY
PRESERVATION FUND FOR TEN YEARS, UNTIL DECEMBER 31, 2030’, BE
APPROVED.”
IV. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate
the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph,

section, or part thereof directly involved in the controversy in which such judgment shall have
been rendered.
V. EFFECTIVE DATE
This Local Law shall take effect after filing with the Secretary of State and after approval at the
general election to be held on November 7, 2006 by the affirmative vote of the qualified electors
of the Town upon the proposition set forth in Section 3 of this Local Law.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
Purpose
I. – In order to provide for the better enforcement of Town Code violations
with respect to land clearing, storage of unregistered vehicles, and the discharge of water onto
highways, it is necessary to make these amendments to the Town Code.
II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
§280-136. Land clearing.
No person shall undertake or carry out land clearing, including grading, clearing, cutting
and filling, excavating or tree removal associated therewith, without first having obtained any
appropriate approvals or permits where required. site plan approval. Weeding, gardening,
mowing and the selective pruning of vegetation or selective cutting of diseased or dead trees
shall not be included herein. Any landowner found guilty of violating person in violation of this
section shall be fined up to subject to a fine not to exceed $5,000. Site plan approval shall be
withheld until and unless a plant restoration plan for that site is approved by the Planning Board
.
§ 280-110. Open storage.
No unenclosed debris, vehicles, vehicle parts or refuse may be kept on property in a
residential district storage, except parking of operable passenger vehicles capable of passing
inspection registered motor vehicles or, recreation vehicles, or boats and commercial vehicles as
set forth in §280-78, and except where located in an agricultural district and kept in connection
with bonafide agricultural operations. shall be permitted in a residential district.
§280-111. Prohibited uses in all districts.
I. Encumbrances to public roads.
(1) No person shall intentionally discharge or cause to be discharged

any water of any kind onto a public highway, roadway, right of way or
sidewalk causing a public nuisance, hazardous condition, or resulting
in flooding or pooling in or around the public area including
neighboring properties.
(2) No person shall place or cause to be placed obstructions of any
kind, except the lawful parking of registered vehicles, upon a public
highway, roadway, right of way or sidewalk that unreasonably
interferes with the public’s use of the public highway, roadway, right
of way or sidewalk.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Southold, Section 117-5, the Land Preservation Coordinator and the Town Board have reviewed
the acquisition and have determined that sanitary flow credits will not be transferred from this
property; now, therefore, be it
RESOLVED by the Town Board of the Town of Southold that this action be classified as an
Unlisted Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and, be

Southold, New York, and is located on the southerly side of Albacore Drive approximately 320
feet from the intersection of Main Road (Route 25) and Albacore Drive in Southold; and

WHEREAS, the open space acquisition is for fee title of the entire approximately 0.48 acre
(subject to survey) property and has been offered for sale to the Town of Southold below fair
market value. The purchase price is $5,000.00 (five thousand dollars) plus acquisition costs. The
property will be acquired using Town open space funding. The seller may claim a bargain sale;
and
WHEREAS, the subject property should be preserved due to its significant wetlands and for the
purpose of preserving open space to allow for the natural drainage pattern to continue in this
area; and
WHEREAS, the purchase of this property is in conformance with the provisions of Chapter 185
(Open Space Preservation) of the Town Code of the Town of Southold; and
WHEREAS,the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and the Local Waterfront Revitalization Program
(LWRP) and the LWRP Coordinator has determined that this action is consistent with the
LWRP; and
WHEREAS, as per Chapter 117 (Transfer of Development Rights) of the Code of the Town of
Southold, Section 117-5, the Land Preservation Coordinator and the Town Board have reviewed
the acquisition and have determined that sanitary flow credits will not be transferred from this
property; and
WHEREAS,the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the property; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase fee title to the subject property for the purpose of the preservation of open space to
allow for the natural drainage pattern to continue in this area; now, therefore, be it

Road (Route 25) and Albacore Drive in Southold in the R-40 zoning district. The proposed
acquisition for fee title is approximately 0.48 acre (subject to survey) and has been offered for
sale to the Town of Southold below fair market value. The purchase price for this open space
acquisition is $5,000.00 (five thousand dollars) plus acquisition costs. The seller may claim a
bargain sale. Town funding for this purchase is in conformance with the provisions of Chapter
185 (Open Space Preservation) of the Town Code of the Town of Southold. The proposed action
has been reviewed pursuant to Chapter 268 (Waterfront Consistency Review) of the Town Code
and the Local Waterfront Revitalization Program (LWRP) and the LWRP Coordinator has

determined that this action is consistent with the LWRP. As per Chapter 117 (Transfer of
Development Rights) of the Code of the Town of Southold, Section 117-5, the Land Preservation
Coordinator and the Town Board have reviewed the acquisition and have determined that
sanitary flow credits will not be transferred from this property.
