Located on East End Road, Fishers Island SCTM#1000-1-1-3.13 Zone: R-120 Dear Mr. Ham: The Southold Town Planning Board, at a meeting held on Monday, May 12, 2003, adopted the following resolution: The final public hearing was closed. The following resolution was adopted: WHEREAS, this proposed site plan, to be known as site plan for Fishers Island Club, is to construct a 3,200 square foot maintenance/storage building and adjacent covered washdown area on an existing golf course, located on East End Road; and WHEREAS, the Fishers Island Development Corp., is the owner of the property known and designated as Fishers Island Golf Club, Inc., SCTM#1000-1-1-3.13; and WHEREAS, a formal application for the approval of this site plan was submitted on October 21,2002; and WHEREAS, the Southold Town Planning Board has determined that this action is a Type II Action and not subject to review under the State Environmental Quality Review Act, (Article 8), Part 617; and WHEREAS, the Zoning Board of Appeals granted a Special Exception (Application No. 5290) on May 1,2003 to allow a maintenance building on a golf course within an R-120 Zone; and F.i. Club - Page Two - 5/13/03 WHEREAS, on November 19, 2002, the Architectural Review Committee reviewed and approved the design elements of the proposed site plan; and WHEREAS, the Town Engineer has reviewed the drainage calculations and the Planning Board has accepted his recommendation for approval; and WHEREAS, this site plan, dated July 18, 2000 and last revised September 18, 2002, was certified by the Building Inspector on May 10, 2003; and WHEREAS, a final public hearing was closed on said application at Town Hall, Southold, New York on May 12, 2003; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the surveys, dated July 18, 2000 and last revised on September 18, 2002, and authorize the Chairman to endorse the final surveys subject to a one year review from the date of the building permit. Enclosed please find two copies of the approved site plan: one for your records and one to be submitted to the Building Department when you apply for your building permit. No. 5290 - Fishers Island Club, Inc. (FIDCO) Property Location: East End Road, Fishers Island; Parcel 1000-%1-3.13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 100.79-acre site has a frontage of +- 394 feet along Oriental Avenue on Fishers Island. The property is occupied and used as a golf course facility with an existing maintenance building. BASIS OF APPLICATION: Zoning Code Sections 100-13 and 100-31B(7) provides as follows: B. [Amended 12-21-1993 by L.L. No. 27-1993] Uses permitted by special exception by the Board of Appeals. The following uses are permitted as special exception by the Board of Appeals, as hereinafter provided, and, except for two-family dwellings and the uses set forth in Subsection B(14) hereof, are subject to site plan approval by the Planning Board: (7) Amended 12-27-1994 by L.L. No. 30-1994; 12-8-1998 by L.L. No. 26-1998] Beach clubs, tennis clubs, country clubs, golf clubs and annual membership clubs and accessory playgrounds, beaches, swimming pools, tennis courts, recreational buildings and maintenance buildings catedng exclusively to members and their guests, subject to the following requirements: la) No building or part thereof or any parking or loading area shall be located within 100 feet of any street line or within 50 feet of any lot line. lb) The total area covered by principal and accessory buildings shall not exceed 20% of the area of the lot. (c) No such use shall occupy a lot with an area of less than three acres. GOLF COURSE, STANDARD REGULATION -- A golfing facility open to the general public for a play greens fee, which is at least 125 contiguous acres of property and contains a regulation eighteen-hole golf course. The following accessory uses may be included, provided that sufficient land is available: practice tees for instruction purposes, pro shop and school, driving range, snack bar or restaurant, catering and banquet facilities, club houses, course offices, vehicle maintenance shed, employee facilities, locker rooms and showers, swimming pool and tennis courts. No. 5290 - Fishers Island Club, Inc. 1-1-3.13 at Fishers Island FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: APPLICANT'S REQUEST: Applicant requests a Special Exception under Section 100- 31B(7) for a 3,200 sq. ft. golf course storage building and 800 sq. ft. covered area, both used in conjunction with the existing golf course facility. Details of the layout of the buildings and golf course facilities are more particularly shown on Site Development Plan prepared by Chandler, Palmer & King dated 9/18/02. The height of this new building will not exceed 18 ft. to the mid-line and 20 ft. to the top of the ridge. All parking and screening will be determined by the Southold Town Planning Board as provided under the Zoning Code site plan regulations. STANDARDS/REASONS FOR BOARD ACTION: After review of the requirements set forth in Article XXVI of the Zoning Code, the Zoning Board of Appeals finds and determines the following: 1) The site is utilized by applicant/owner of the existing private country club golf course, located in an R-120 zone. The proposed construction of an equipment storage building accessory to the existing golf course, is provided as an allowed use under Town Code 100-31B-7, by special exception approval, which also must meet the requirements of the Planning Board under the site plan regulations of the Town Code, and requires issuance of a building permit before construction. 2) The applicant's proposed construction is located in a secluded section, surrounded by woods, tucked under a hill side which wraps around the site, and its only exposure is to the existing accessory storage building of the 154+- acres of land which comprises the golf course, but, is also in an area that is very accessible to large vehicles such as fire trucks, in an emergency. 3) Total lot coverage after construction is noted to be +-1 (one) percent. 4) The applicant's proposal exceeds the setback requirements of 100 feet to the nearest street, and 50 feet from any lot line. 5) The applicant has a letter o7 non-jurisdiction from the NYSDEC. No. 5290 - Fishers Island Club, Inc. 1-1-3.13 at Fishers island 6) The applicant meets every standard of Town Code-263.A-F which requires that such use be reasonable, safe, readily accessible in emergencies, not detrimental to adjacent properties, compatible with its surroundings, and with the character of the neighborhood, and, in harmony with the purpose of the zoning code. 7) The Zoning Board of Appeals also notes that the applicant constructed a very similar accessory storage building within 80 feet of the proposed building, during the early 1990s by issuance of a building permit. The new storage building is proposed approximately west of the existing accessory storage building. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehdnger, seconded by Chairwoman Tortora, and duly carded, to GRANT the Special Exception, with the conditions that: 1) the building be used only for a proposed maintenance storage building related to the golf course, as applied for, and shown on the site development map prepared by Chandler, Palmer & King dated 9/18/02. 2) the height be limited to 18 ft. to the mid-line and 20 ft. to the top of the ridge. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Drainage calculations have been provided to contain run-off generated by the proposed building and the subsequent drainage design meets the minimum requirements of the Town Code. The sump and drain system for the equipment wash area is a new technology that does not require a drainage basin. This equipment, when used correctly, totally recycles the discharge. Contaminants are separated out and the remaining water is re-used and not recharged back into the ground. If you have any questions concerning this report, please contact my office. ,~mes A. Brown, Co-Chairman Herbert Adler, Jr., Landmarks Preservation Committee Yan Reiger, Orient Howard G. Meinke, Cutchogue Robert Keith, Mattituck, Secretary Aisc present were Victor L'Eplattenier of the Planning Board Staff, Joseph Fischetti for the North Fork Bank as well as Stanley and Paul Pawlowski for Reflecting Nature. Southold Town Plannina Board Moved by Herbert Adler and seconded by Robert Keith, it was RESOLVED to APPROVE the MINUTES of the meeting of September 12, 2002. Vote of the Committee: Ayes All. NORTH FORK BANK (Main Road - Mattituck) The 20,000 square foot addition was described. It will have exterior finishes and lightingto match the present building. It was RESOLVED by Howard Meinke and seconded by Robert Brown to APPROVE the application with the CONDITION that the elevator penthouse be clad with material to match the exterior of the building Vote of the Committee: Ayes All, REFLECTING NATURE (Cox Neck Lane - Mattituck) The 2500 square foot metal storage building will have bays in the rear and colors of green for the roof and the lower four feet of the sides with white above and for the trim and doors.
