Dear Mr. Cuddy:
As per your inquiry, please find the following in regard to the above
mentioned property:
1. During the time period from approximately 1987 to 1991, the Planning
Board records show a pending 4 lot subdivision on the subject
property.
2. During the review process of the 4 lot subdivision, the Planning
Board received maps containing approval from the Suffolk County
Department of Health and the Suffolk County Board of Review.
3. Although the Planning Board performed an extensive review of the
subdivision and the subdivision reached the final stages of
subdivision review, the Planning Board did not grant final approval
to the subdivision.
4. In 1997, the owner of the property sold the development rights to
Suffolk County on approximately 11 acres of the property. The
development rights were left intact on approximately 4 acres of the
property.
5. There is no subdivision application pending and the parcel has not
been subdivided; it remains a 15 acre parcel with the development
rights intact on 4 of the 15 acres.

Dear Henry:
This letter is in response to Mr. Kaufman's inquiry as to our
intentions regarding a joint access road. I 've consulted with the
other owners of the Townsend/Dorman/McKay property and we have decided
not to participate at this time. This is primarily due to the cost
of the road as estimated by The Southold Town Planning Board.
It is also my personal opinion that such a large road is not
appropriate to this area for a variety of esthetic and environmental
reasons. Please feel free to call if you wish to discuss this further.

Dear Mr. Townsend and Mr. Raynor:
The Planning Board reviewed the above mentioned proposals
in regard to the road location.
The Board recommends that one access point and one road be
designed for both subdivisions, rather than two separate roads
running parallel to each other.
The Planning Board' s recommendation includes a road built
to major specifications located on the Townsend and Plum Gut
parcel ( to be referred to as Parcel A) . This road will
terminate in a cul-de-sac at the property line marked N/F
Shapiro. A road to the alternate specifications will then
continue in the twenty-five ( 25) foot right-of-way to the
Dorman, Townsend, MacKay & Millis property (to be referred to
as Parcel B) . Please see the enclosed sketch for clarification
of this concept.
If development of the two parcels is not to continue
simultaneously, it is suggested that an easement over Parcel A
be granted to Parcel B so that Parcel B can proceed with a road
built to the alternate 'specifications, which would later be

The Planning Board reviewed the above mentioned proposals
in regard to the road location.
The Board recommends that one access point and one road be
designed for both subdivisions, rather than two separate roads
running parallel to each other.
The Planning Board' s recommendation includes a road built
to major specifications located on the Townsend and Plum Gut
Parcel ( to be referred to as Parcel A) . This road will
terminate in a cul-de-sac at the property line marked N/F
Shapiro. A road to the alternate specifications will then
continue in the twenty-five ( 25) foot right-of-way to the
Dorman, Townsend, MacKay & Millis property ( to be referred to
as Parcel B) . Please see the enclosed sketch for clarification
of this concept.
If development of the two parcels is not to continue
simultaneously, itis suggested that an easement over Parcel A
be granted to Parcel B so that Parcel B can proceed with a road
built to the alternate specifications, which would later be
upgraded to the major specifications upon development of
Parcel A.
Development of the parcels in the above mentioned manner
will necessitate only one curb cut. The subdivision proposals
have been sent to the New York State Department of
Transportation for their comments in regard to this situation.
The Planning Board will contact you upon receipt of the
comments from the NYSDOT. At that point, revised road profiles
will have to be submitted showing the suggested location of the
road.

RESOLVED that the Southold Town Planning Board overide the

The Suffolk County Planning Commission at its regular meeting on July 6,
1988 reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Joseph L. Townsend & Plum Gut Properties, Ltd." referred to it pursuant to
Section A14-24, Article XIV of the Suffolk County Administrative Code. After
due study and deliberation it resolved to disapprove said map for the following
reasons:

2. There is concern that the proliferation of lots with long panhandles
for access and lots dependent upon rights-of-way over adjoining
properties will result in safety and health problems for future
residents. Should a fire or medical emergency result on one of these
lots precious seconds may be lost by the fire department or medical
response team in locating and using the proper access to the lot.
The Commission also offers the following comment on the map for your use
and consideration:
It is suggested that a study be made of the area ascertaining the
number and location of the rights-of-way that provide access to the
many lots that do not have frontage on a public highway with the
purpose of developing a plan that will provide for proper access by
means of a public road. This subdivision should then be redesigned in
accordance with that plan.

We would like to request a four month extension of the six month

The need for this request arises out of the fact that we are still in
the process of complying with conditions placed on the approval which we

Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617 , Section 617 . 10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town
Planning Board as lead agency for the action described below
has determined that the project will not have a significant
effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Plum Gut Properties is located
at Main Road, Orient for 4 lots on 15 acres , tax map no.
1000-18-3-9 . 1 .
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence from the Suffolk
County Department of Health Services in the alotted time,
it is assumed that there are no comments or objections
from that agency.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

off of this parcel . I believe that this covenant precludes any

Dear Mr. Reynolds:
I enclose herewith an application for approval of a realty subdivision
which will create four residential lots of approximately four acres each in
Orient.
Please note on the subdivision plan that two test wells have been instal-
led on the property in addition to an existing well which services a house on
an adjacent parcel . Both test wells were installed by Krieger Well & Pump Co.
this year. Test well number one was tested under the supervision of the Health
Dept. and was found to be above the limit for nitrates. (See prior application
in the name of Leon C. Marcus). Test well #2 was tested by John Hallman of
Shelter Island and was also found to be above the limit in nitrates. We had the
existing well sampled and tested from the house .nextodbor which results showed
this well to be exactly at the limit of 10 parts. i
We would like to have the subdivision approved for individual house wells
conditioned on treatment for nitrates pursuant to your "Standards for Sampling
Subdivision Test Wells, and Sampling and Treatment Requirements for Individual
Home Water Supply Systems" paragraph 7.
Please give this matter your consideration and inform us at your early
convenience as to how the Health Department would like us to proceed.
