RE: Hale and Hughes (Minor S.lbdivisions at Orient)
COMMENTS :
Access to the above subdivisions is made through a 50 ft. private R.O.W. on a one-way dirt
road (12:t ft. wide) approximately 1300 ft. in length from the main highway. Road is
passable at present time.
,
In company w1th Mr. T. Latham, contractor for owners, I made an inspection of the road
grading to date. A considerable amount of rough grading and most of the clearing has been
done in this common 50 ft. R.O.W. (980 ft. t: in length) for both subdivisions. No profile
was submitted with the sketch plans which could have been used for a guide in this area
of steep rolling contours. The existing ground slopes generally from south (contour 70t:)
to north (contour 40i:") where the road R.O.W. ends.
7b date the final profile has not been completed, additional excavation and filling re-
mains to be done. Based on prior inst~lctions, the road WaS to be established on a minus
grade from south to north with a low point opposite a pond at Lot No.1 on the Hale sub-
division. This appeared reasonable and contractor has tried to conform. However, due
to some extra large boulders encountered., the minus grade has been slightly modified in
part. An 18" pipe cross drain should be installed at the above low point as the road
embankment will block drainage tha t use to go to the pond.
For road surface I would recommend 6" of bankrun for a width of 20 ft., shoulder widths
of 2 ft. following road crown and then graded 1 on 2 up or down to meet existiq~, gr()':lJld.
Would also recommend say a course -of small granular materi~ or bluestone at If
to stabilize the bankrun as parts of the final profile may be at 4% ~ .
There may be problems at some of the lots in these subdivisions when house building
starts due to the difference in elevation of the road and lower existing ground.

Dear Mr. Wickham:
The Suffolk County Planning Commission at its regular meeting February 2,
1977, reviewed the above captioned proposed subdivision plat referred to it
pursuant to Section 1333, Suffolk County Charter. After due study and delib-
eration, it did take the following action:
The Map of "Minor Subdivision - Phyllis E. Hale", as submitted, was approved
subject to the meeting of the following six conditions:
1. No residential structure or sanitary disposal facility shall be located
within 100 feet landward of the 25 foot contour along the bluff.
2. No storm water runoff resulting from the development and improvement of
the lots on the map shall be permitted to be discharged over the edge of the bluff
or down over its face.
3. Clearing and grading within the setback area and on the bluff shall be
restricted to that necessary to protect the bluff and required by ordinary main-
tenance.
4. All necessary steps are to be taken, such as requiring a paved walk
or boardwalk, to prevent erosion resulting from use of the right-of-way to the
beach.
5. The subdivision shall be made subject to any requirements imposed by
the "Tidal Wetlands Act" if such Act is applicable to subject property.

Gentlemen:
Further as to the Public Hearings of December 27,
1976 relative to approval of above, at which time a letter
from Lawrence M. Tuthill was first read to the undersigned
recommending that a 24-foot wide road in accordance with
Town Highway specifications be constructed some 1600 feet
from above minor subdivisions to the Main Road:
At the hearing, your Board requested a copy of
the deed from applicant's predecessors in title (George
Edwards Estate) to Clausen Construction Company, Inc. for
the intervening land (between said minor subdivisions and
the said Main Road) in which the grantee, Clausen Construc-
tion Company, Inc., assumed all obligations for maintenance,
construction, improvement and repair of all, or part, of
said right of way. A copy of such deed is enclosed and
marked EXHIBIT "A", dated February 9, 1971.
I also enclose herewith map of minor subdivision
of said intervening land made by Van Tuyl as of January
22, 1971 for said Clausen Company, Inc. Access to the
five (5) lots of the minor subdivision are over the same
right of way as is access to Hale and Hughes minor sub-
divisions.
I respectfully call the Board's attention to the
case of Medina, et al. v. Carrol H. Burns, et al.; (Planning
Board of Islip) 20 Misc. (2) P. 890, October 24, 1960, in
which the Supreme Court, Special Term, Suffolk County, held:

"A town planning board was not authorized
to deny approval of a land subdivision
map on the ground that the developers
had failed to indicate they would improve
the fuil length of a private road running
from a public highway to the development.
Section 277 of the Town Law provided
that in approving such plats, the planning
board could require that all streets
'shown on such plats' should be paved.
The connecting street was not a street
'shown on such plats,' the quoted language
referring to streets within the development."
Since the applicants never had the obligation to
do anything as to the intervening right of way because it
was assumed by the developer of the intervening land and
for whom a minor subdivision was approved with access over
the same right of way to be used by instant applicants, I
respectfully suggest that approval of both minor subdivisions
should be granted upon requirements stated prior to public
hearing, all of which have been met by the developers.

On June 28, 1976, a meeting was held at the Southold Town
Clerk's Office, Main Road, Southold, New York, with the following
people present:
Irving L. Price, Jr., Esq.
Phyllis Hale
Henry Raynor
Frederick Gordon
Muriel Brush
The matter under discussion was the minor subdivisions of
Mrs. Hale and her cousin, Barbara Hughes. Mr. Price is Mrs.
Hale's attorney.
The width of rights-of-way for minor subdivisions was
discussed. Mrs. Hale's right-of-way has 34.09 feet at the Main
Road.
Mr. Price made the following comments:
Clausen Construction, a minor subdivision to the south of
Mrs. Hale's property was approved using Mrs. Hale's right-of-way.
Gorwitz & Barnett have a minor subdivision with a 16-1/2 foot
right-of-way. The Stillo minor subdivision has a 30 foot right-
of-way.
There was some discussion as to the reason why Clausen
Construction was allowed this insufficient right-of-way and the
secretary will research this matter in the minutes prior to 1971
to see what reasons were given for approval.
Mr. Price contended that the right-of-way was not 1200 feet
long in these minor subdivisions if you measure the actual
length of the road as there is a 400 foot ten foot wide foot path
going to Long Island Sound. The question came up as to what the
actual definition of a block is - should it be actual length of
road or the metes and bounds description. The Town Attorney will
be consulted in this matter as an actual description of the term
did not appear to be in the Code of the Town of Southold.
This report will be made to the full Planning Board at the
next regular meeting to be held July 12, 1976, with the hope of
resolving this situation.
In the Stillo minor subdivision, there is a dotted line
indicating possible future dedication to the Town of Southold.
Mrs. Hale was asked if she would be in agreement with this and
her answer was in the negative.
