The deed in the files for the Hale and Hughes properties describe a Right-of-way in common with others, but does not specify "others". I suggest that you review your property deed and survey to see if reference is made to that Right-of-Way. Finally, you might approach the homeowners along that Right-of-way and discuss the possibility of sharing expenses and usage of same. Please let me know what transpires. Raynor, Jr., Chairman Southold Town Planning Board No. 102 DATE: December 6, 1979 FROM: John W. Davis COMMK~ TS: Re: Hale and Hughes (Minor subdivision at Orient) As requested by Mr. T. Latham, contractor for the owners, I made an inspection with him of the completed road work on the above subdivision as foll~s: Access to this project is made through a 50 ft. width private R.O.W. on a one way gravel road 1300 ft. from the State highway. Ibis road is passable at present time. Lilco and N. Y. Telephone Co. have installed their t~nk lines in the left side shoulder of the road. 3. Roadway width 2~ ft., some sections at 28-30 ft. 4. Top 6" of road material is mixture of bank~an and sandy loam. Approximately 3000 C.Y. of other materialhrough~ in from outside. 5. According to contractor, fill sections were layered and compacted ~rith construc-- tion e~ipment. The roadway appears stable, is being used by owners. 6. The profile is satisfactory, grades not over 5%~ A low point was established at the pond opposite Lot No. 3. Road grades are minus from the South and North to this low point. 7. 48 ft. of 18" C.M.P. is installed under the road at the low point, to. permit drainage from the wes~ side of the road to go to the pond area. 8. Some of large boulders from grading operations have been left on the Sides. According to c~ntractor no objections from owners. 9. ~his type of road wil! require maintenance as most of the length is higher than existing ground. 10. No type of s~rface course for additional stabilization of the road is planned by the owners at this time. Mr. and ~Z~s. Hale were on the site, said they are satisfied with the road. ~his type of road construction with maintenance should be satisfactory for the subdivision and I recommend approval of the work. COMMENTS: To construct the road in the Right-of-Way for this subdivision the following specifications should be followed: 1. The road shall be 36 feet wide with the centerline of the road coinciding with the centerline of the Right-of-Way. 2. Strip all begetatio~ and humeus from the 36 feet width. The road shall flow gently downward from south to north so that water draining from the road will flow into the pond on lot 1. The top of the road at this pond shall be at least 3 feet above the bottom of the pond. The elevation of the surface of the road will be established by those boulders which cannot be re- moved. All remaining boulders shall be covered by at least 12 inches of fill material. 5. The top 6 inches of road shall be bankrun, the fill section under this top 6 inches shall be two-thirds bankrun and one-third loam. The profile of the road shall be free of any abrupt humps or dips. No water accumulating depressions will be allowed. 7. The shoulders of the road shall be graded up or down on a I on 2 slope as the situation demands. HENRY E. RAYNOR. No residential structure or sanitary disposal facility shall be loca- ted within 100 feet landward of the 25 foot contour along the bluff. 2. No storm water runoff resulting from the development and improvement of the lots on the map shall be permitted to be discharged over the edge of the bluff or down over its face. 3. Clearing and grading within the setback area and on the bluff shall be restricted to that necessary to protect the bluff and required by ordinary maintenance. 4. Ail necessary steps are to be taken, such as requiring a paved walk or boardwalk, to prevent erosion resulting from use of the right-of-way to the beach. 5. June 28, 1976 On June 28, 1976, a meeting was held at the Southold Town Clerk's Office, Main Road, Southold, New York, with the following people present: Irving L. Price, Jr., Esq. Phyllis Hale Henry Raynor Frederick Gordon Muriel Brush The matter under discussion was the minor subdivisions of FLrs. Hale and her cousin, Barbara Hughes. Mr. Price is Mrs. Hale's attorney. The width of rights-of-way for minor subdivisions was discussed. Mrs. Hale's right-of-way has 34.09 feet at the Main Road. Mr. Price made the following comments: Clausen Construction, a minor subdivision to the south of Mrs. Hale's property was approved using Mrs. Hale's right-of-way. Gorwitz & Barnett have a minor subdivision with a 16-1/2 foot right-of-way. The Stillo minor subdivision has a 30 foot right- of-way, i~ There was some discussion as to the reason why Clausen Construction was allowed this insufficient right-of-way and the secretary will research this matter in the minutes prior to 1971 to see what reasons were given for approval. Mr. Price contended that the right-of-way was not 1200 feet long in these minor subdivisions if you measure the actual length of the road as there is a 400 foot ten foot wide foot path going to Long Island Sound. The question came up as to what the actual definition of a block is should it be actual length of road or the metes and bounds description. The Town Attorney will be consulted in this matter as an actual descriptioh of the term did not appear to be in the Code of the Town of Southold. This report will be made to the full Planning Board at the next regular meeting to be held July 12, 1976, with the hope of resolving this situation. In the Stillo minor subdivision, there is a dotted line indicating possible future dedication to the Town of Southold.
