Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on October 10, 1984, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Stephenson Beach, Inc.", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: 1. The proposed subdivision creates a landlocked parcel, Lot 3; that is, a parcel that does not have frontage on any existing or pro- posed public road. The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. It also places the Zoning Board of Appeals in the awkward position of having to grant a building permit under Section 280-a of the Town Law to a buyer of the lot as the buyer is not responsible for the creation of the lot and is not a self-imposed hardship. Unfortunately, the information submitted did not clarify the status of the road which is indicated as a right-of-way on the map (public or private?), a town road in one document, and private property in another document. 2. The drawing prepared June 8, 1984, by Garrett A. Strang, Architect, does not answer the question raised as to the location of existing park facilities. Should there be any facility encroaching into Lot 1 it may have an impact upon that lot being a viable lot meeting all zoning requirements particularly if the easterly lot line has to be relocated.
