The following action was taken by the Southold Town Planning Board,
Monday, March 4, 1985.
RESOLVED that whereas, a formal application for the
subdivision plat entitled "Stephenson Beach
Orien~- M . was submitted to the Planning Board on

WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on February 4, 1985

ORDER DISCONTINUING
TOWN HIGHWAY

Applicatio~ having been made ror the discontinuance or a.portion
or a certain Town highway located between East Marion and Orient in
the Town or Southold, said Town highway being known as "Old Main, .
Road" and all parties errected thereby having released the Town of
Southold from all damages by reason of the discontinuance of said
highway through the parcel of land hereinafter described as a Town
highway, and the Town Board or the Town or Southold having made its
consent to the making of this order
NCW, THEREFORE, I, Harold D. Price, Town Superintendent of
Highways or the Town or Southold, in accordance with the provisions
of Section 171 of the Highway Law of the state of New York, do
hereby order that portion of said existing highway consisting of
lands hereinafter described be discontinued and closed as a public
highway of the said Town of'Southold. The lands to be discontinued
for highway use are the following, to wit:
'" All that certain tract, piece or parcel of land at Orient,
in the Town 'of Southold, Suffolk County, New York, bounded and
described as follows:
Beginning at a point-of-curve on'the northwesterly line of
the. Main Road or State High'~ay (Route 25), said point being' North"
2~ aegrees35 minutes 10 seconds East 61.37 feet distant from the
point of intersection of said line of the Main Road with the north-
easterlyline of land of Rutledge M. Howard; running thence along
land of Stephenson Beach, Inc. four courses as follows: (1) North
2~ degrees 35 minutes 10 seconds East 195.15 feet; thence (2) North
3~ degrees 01 minutes 00 seconds East 200.03 feet; thence (3) North
50 degrees 39 minutes 10 seconds East'1~39.20 feet; thence (~) South
86 degrees 32 minutes East l37.3~ feet to land now or formerly of
Wilson W. Stephenson; the above four courses being along the north-
westerly line of "Old Main Road"; thence diagonally across said "Old
Main Road"', South 25 degrees 43 minutes 30 seconds West 71.31 feet
to the southeasterly line of said "Old Main Road"; thence along said
southeasterly line of "Old Main Road", adjoining meadow land of
Stephenson Beach, Inc., two courses, as follows: (1) North 86
degrees 32 minutes West 84.45 feet; thence (2) South 50 degrees
39 minutes 10 seconds West 759.13 feet to a point' on the curved
northwesterly line of said Main Road or State Highway; thence
southwesterly along said line of Main Road or State Highway on a
curve to the left having a radius of 1381.45 feet, a distance along
said curve of 1~9.03 feet to the point of beginning.

We are in receipt of a copy of Mr. Lind's
letter from the Suffolk County Planning Commission
dated October 15, 1984 in which the County still takes
exception to e.pproval of Lot # 3 in the subject ap-
plication ba,s,ed on their uncertainty of the status of
the old Ma.in Road.
As to item one of Mr. Lind's letter, it is
the opinion o'f the Town's a.ttorney, Robert W. Tasker,
Esq. and of our a.ttorney, Willia,m H. Price, Jr., Esq.
as set forth in their letters of September 17, 1984
and September 18, 1984 respectively, that the north-
west to south,-east portion of the old Ma.in Road abut-
ting Lot # 3 is in fact a Town highway. This conclusion
was reached based on the fact that a,be,ndonment wa,s
requ.sted and e.pproved by the Town in 1959 .only on that
portion of the old Main Road which lies parallel to
Lonp: Island Sound.
As to item two, there are no permanent exist-
ing Orient-Ealst Marion Pa,rk District facilities. The
small ga.te house used for a.dmission to the beach is
eAsily mova,ble if necessary and there are no present
permanent sa,l1i ta.ry facilities. There is no need to re-
loca.te lot lines as there are no present encroachments.
In view of the importance of the gift of the
beach to the community and to expedite early construc-
tion of the l1ecessa.ry permanent Pa,rk District facilities,
we respectful.ly request that the Southold Town Planning
Boa.rd overric:l!e the sta,ted Suffolk County Pla,nning Com-
mission's objections, and place the subdivision a,pplica,-
tion on its a.genda for approval at the earliest possible
dste.

Enclosed please find town record concerning
the abandonfuent of part of the old road. You should
note that tpe portion abandoned does not include that
stretch of the road which abuts Lot 3. Therefore,
Lot 3 does not need a 280-a access approval, in that
it abuts a town road.
I believe that these town records will deal
absolutely with Items 1 and 3, in the letter of Charles
G. Lynn, dated August 3, 1984.
I have requested that Mr. Strang supply me
with a plan he made on August 28, 1984, which should

After reading your letter of August IS, 1984 to Robert W. Gillispie III and the
Suffolk County Planning Commission's letter dated August 3, 1984 to the Southold
Town Planning BoaI'd, I have had the Town Clerk search her records with
respect to the abandonment of the "old road" which extended from west to east
along the seawall to the property of Stephenson Beach, Inc. and then turned to
the south and connected to State Route. 25. Enclosed herewith is a photostatic
copy of an abandonment proceeding with respect to this highway wherein
Stephenson Beach, Inc. applied for the discontinuance of a portion of the "old
road". Attached to the abandonment proceeding is a copy of that portion o{ the
map which indicates that portion which was discontinued. You will note that by
reason of this abandonment, Parcel III of Stephenson Beach, Inc. actually abuts
the northerly terminus of that portion of the "old road" which still remains as a
Town highway.
By reason of the foregoing, it would seem that items 1 and 3 of the County
Planning Commission's report is academic. With respect to information as to the
location of park facilities, on August 28, 1984, Garrett Strang, the architect for
the park district prepared a revised plan showing all the facilities including sewer
and water facility locations.
I would suggest that you submit a copy of the abandonment proceeding with
respect to the highway and a copy of the August 28, 1984 facility plan to both
the County Planning Commission and the Town Planning Board. It would seem that
these items would resOlve any questions which .either board may have with respect
to the minor sUbdiv;si(m.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on October
10, 1984, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Stephenson Beach, Inc.", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to disapprove said
map for the following reasons:
1. The proposed subdivision creates a landlocked parcel, Lot 3; that
is, a parcel that does not have frontage on any existing or pro-
posed public road. The creation of such a lot is contrary to good
subdivision layout principles and creates problems as far as access
by emergency and service equipment is concerned. It also places
the Zoning Board of Appeals in the awkward position of having to
grant a building permit under Section 280-a of the Town Law to a
buyer of the lot as the buyer is not responsible for the creation
of the lot and is not a self-imposed hardship.
Unfortunately, the information submitted did not clarify the status
of the road which is indicated as a right-of-way on the map (public
or private?), a town road in one document, and private property in
another document.
2. The drawing prepared June 8, 1984, by Garrett A. Strang, Architect,
does not answer the question raised as to the location of existing
park facilities. Should there be any facility encroaching into Lot
1 it may have an impact upon that lot being a viable lot meeting
all zoning requirements particularly if the easterly lot line has
to be relocated.

The following action was taken by the Southold Town Planning
Board at the regular meeting of May 21, 1984.
RESOLVED that the Southold Town Planning Board declare lead
agency with regard to the State Environmental Quality Review
Act for the minor subdivision of Stephenson Beach, Inc.
located at Orient-East Marion. An initial determination
of non-significance has been made.
RESOLVED that the Southold Town Planning Board grant sketch
approval to the minor subdivision of Stephenson Beach, Inc.
located at Orient-East Marion dated February 27, 1984 subject
to the fOllowing covenants and restrictions: no further
subdivision in perpetuity, and Suffolk County Department
of Health approval of the water of lot No. 3 is needed prior to
obtaining a buiding permit for this lot.
Please forward six (6) copies of the final map (see enclosed
list for requirements ) in order that we may make the necessary
referrals. The Board also requests that you submit the draft
covenants and restrictions for their review.

At the hearing held In March 23, 1984 you had an cpportunity to present your
appeal of the department's ruling on the subject Application.
In accordance with the provisions of Section 220, Article 2 of the Suffolk County
Sanitary Code, the {0termination of the Board of Review is as follows:
Based on,the information submitted, that the application be approved provided:
1. Well on lot 1 be installed approximately 20 feet deep and be as far from
saltwater as possible. The proposed sewage disposal system is to be at
least 200 feet from the well.
2. Plot 2, the 8.4 acres, is to be donated to the Orient-East Marion Park
District.
3. Plot 3 cannot be built upon unless PUbL~C water becomes available or an
-~~lternate off-sioe source of potable water is found to supply water to

The undersigned being the owner of' and only person interested
in lands effected by the proposed discontinuance of a portion of a
certain Town highway known as "Old Main Road" between East Marion
and Orient in the Town of Southold, and more particularly herein-
after described, for a valuable consideration, does hereby release
the said Town of Southo1d from any and all damages by reason of
the discontinuance of the following portion of the said Town
highway known as "Old Main Road", to wit:

All that certain tract, piece or parcel of land at Orient,
in the Town of Southold, Suffolk County, New,York, bounded and
described as followsl
, Beginning at a point-of-curve on the northwesterly line of
the Main Road or State Highway (Route' 25), said point being North
24 degrees 35 minutes 10 seconds East 61.37 feet distant from the
point of intersection of said line of the Main Road with the north-
easterly line of land of Rutledge M. Howard; running thence along
land of Stephenson Beach, Inc. four courses as followsl ' (1) North
24 degrees 35 minutes 10 seconds East 195.15 feet; thence (2) North
34 degrees 01 minutes 00 seconds East 200.03 feet; thence (3) North
50 degrees 39 minutes 10 seconds East 1439.20 feet; thence (4) South
86 degrees 32 minutes East 137.34 feet to land now or formerly of
Wilson W. Stephenson; the above four courses being along the north-
westerly line of "Old Main Road"; thence diagonally across said "Old
Main Road", South 25 degrees 43 minutes 30 seconds West 71.31 feet
to the southeasterly line of said "Old Main Road"; thence along said
southeasterly line of "Old Main Road", adjoining meadow land of
Stephenson Beach, Inc., two courses as follows: (1) North 86
degrees 32 minutes West 84.45 feet; thence (2) South 50 degrees
39 minutes 10 seconds West 759.13 fee t to a point on the curved
northwesterly line of said Main Road or state Highway; thence
southwesterly along said line of Main Road or State Highway on
'a curve to the left having a radius of 1381.45 feet, a distance
along said curve of 1~9.03 feet to the point of beginning.
