Is to remain as written Page 2 Proposed set-off for Jack and Margaret Stern September 14, 1993 The final public hearing which was held at 7:30 P.M. was closed. The following resolution was adopted: WHEREAS, Jack and Margaret Stern are the owners of the property known and designated as SCTM# 1000-17-2-1.3 located at Private Road #2, at Orient; and WHEREAS, this set-off to be known as proposed set-off for Jack and Margaret Stern is to set off a 80,000 square foot parcel from an existing 168,252 square foot parcel; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on June 15, 1993; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on September 13, 1993; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore RESOLVED that the Southold Town Planning Board grant conditional final approval on the surveys dated February 18, 1993, and authorize the Chairman to endorse the final surveys, subject to fulfillment of the following conditions within six (6) months of the date of this resolution: 1. Submission of a Declaration of Covenants and Restrictions Numbers 3, 4, and 5 must be presented in proper legal form. A copy of the draft Declaration of Covenants and Restrictions must be submitted for review by the Planning Board and the Town Attorney. Once approved, the document must be filed in the office of the County Clerk and the liber and page number of the recorded document must be noted on the final maps. Determination by the Planning Board if a fire well is required. Submission of five (5) paper prints and two (2) mylars of the final maps, all containing a valid stamp of Health Department approval and a notation that a Declaration of Covenants and Restrictions, with the liber and page number, was filed pertaining to the subdivision. It's been a long day, and I thought we were all set. I ¥~s told by the Water Co. - I went up there today -- I [~s there and I was told that if I came with ~ry- thing necessary, they would help us get through this. BScause I've moved out of my home, all the furniture I've ~one. A twelve room house. I live in a barn and I've got everything piled in there. The house ~s ready to go. Southold Town Planning Board 2 September 13, 1993 They've sold their home and because I was supposed to have everything ready; we have the papers all there at the Water Co. - and the gal went on vacation, and they have sat there for 10 days, 11 days, and I went in today with the understanding from the gentleman, a Mr. Maloney, that if I had papers they would look through them, the papers that were there they would check, when the girl c~/~e back from her vacation, were there. And he came out of his office, he saw me and he said I don't have good news for you. And I said,"oh?" Because everything w~s supposed to be complete. And he said to us, Suzanne with me, he said to us that they couldn't do it because they didn't have the well covenants. I said those came in hand delivered 9, 10 days ago. I now they were there. And he said alright, sit there. Which we did. And about 20 minutes later, they said they got the papers, they were there, they'd .been cubby--holed. Then, on top of this, this ~as supposed to be all we needed. They announced they needed an easement release from the bank that's holding our huge mortgage, and I need to get rid of it. We've been paying terest for years on the darned thing, an~ I finally found a wonderful person who loves the house as well as I do, and is buying it -- an admiral-- and they love it. They've got their ship in dry doc]f, I tell them. And it is beauti-- ful. But here I am, with a house ready to go, they have their mortgage, were ready to close the first of the month, and we've been held up by a gal on vacation and not checking this out. And we were going to the attorney today and I couldn't do it because of this easement thing, that is completely ne%;. Mr. McDonald: What is the... Ms. Stern: I don't know. Suzanne (last name inaudible): I've been a friend of Margaret's for 15 years, I'm also her neighbor, and I'm the broker involved. What Suffolk County Health Dept. told us they w-anted was an ac~owledgment notarized by the bank. An ack- nowledgment to be accompanied by the easement. They had all their easement agreements. It ~as just an acknowledgment. Bo we had that faxed to the bank attorney and to the bank officer. We had a messenger welting this afternoon to bring it back to Mr. Maloney and Ms. Sasota at the Suffolk County Health Dept. and they said that's all they needed to put the stamps on. And this we were just told about today. Mr. McDonald: What's the easement for? Mr. Kassner: The well is on the other lot. Everyone talking. Mr. McDonald: How long will it take you to get what you need, tOgether? Ms. Stern: Tomorrow or the next day, I think. Suzanne: Within 48 hours. We have either a messenger or an overnight.. Ms. Stern: But I can't w~it another month; it means more money, mere every-- thing. Ms. McDonald: Is there anything else? I missed the discussion on this earlier, is there anything else that's a problem? Southold Town Planning Board 3 September 13, ]993 Mr. Kassner: No. Ail she needs Mark is Health Dept. approval. What this easement is about is that the main house that Mrs. Stern is selling; the Well for it is on the other property in the house where she is -- the barn. What we're doing tonight is approving the Suffolk County Planning Core, lesion report and keeping the hearing open. Just as soon as Mrs. Stern gets Health Dept. approval, this Board can approve it. Mr- McDonald: Unless there are other problems, I suggest that we make a motion, normally we don't, but do it conditionally. On the filing of the declaration of covenants and restrictions as the County has requested, and then the Health Dept. approval. I don't want us waiting three weeks or a month. You won't have to do that, unless there's other problems. Everyone talking. Mr. Ward: There's too many conversations going on here at once. Our secretary doing the dictation is going to have a big problem. Suzanne: Are there any questions you'd like us to ansx~er for you? Mr. McDonald: No, I think we're ready to go. Suzanne: It's just the main thing, that time is really...every day counts. Mr- McDenaald : Well, let,s finish the hearing. You haven't bad the opposed? Suffolk County Sanitary Code (SCSC) The SCDHS maintains jurisdiction over the final location of sewage disposal and water supply systems, pumuant to the authority and requirements of Articles 4, 5, 6 and 7 of the SCSC. Applications must comply with ail relevant density and constn]ction standards for water supply and sewage disposal. Applicants should not undertake the construction of, or connection to, either system without Health Department approval. 2. Where applicable, the depa~Xment regulates the storage, handling and discharge of restricted toxic and hazardous materials pursuant to the requirements of Articles 7 & 12 of the SCSC. If an application has not yet been submitted to the SCDHS, one should be filed at the earUest date to allow for die technical review of the proposed action. Project designs submitted to the department should be fully consistent with any action currently under review through the SEQRA process. Design and flow specifications, information regaffifug subsurface soil conditions, water supply information, and complete design details are essential to the review of this project, and are evaluated fully at the time of application review. Should the town require additional environmental information (such as a DEIS), discussion of the compliance requirements of the SCDHS should be required. Of parricular concem to the department are those areas which because of elevated groundwater conditions, or soils which are not conducive to the proper functioning of conventional subsurface sanitary sewage disposal systems. NATURAL RESOURCES: The SCDHS fully supports all efforts to maximize protection of natural resources which may be impacted upon by construction and development activities. It is the position of ~he department ~hat the SEQRA review process provides the greatest opportunity for comprehensive consideration of these resources, and that all practicable planning measures should he employed to help ensure their protection. Of particular concem to department is the adequate protection of wetlands, surface waters, natural communities, contiguous natural habitats, and rare, threatened and endangered species. In addition, efforts to protect sensitive physical resources such groundwaters, dunes, bluffs, shorelines, natural drainage channels, groundwater recharge areas, and steep slopes are fully supported and encouraged by the SCDHS. In general, the depamnent encourages the following land use measures be considered (where appropriate) to actions being reviewed pursuant to SEQRA. 1. Maximum practicable setbacks from all wetlands, surface waters, dunes, and bluffs. 2. Non-disturbance buffers between wetland limits and required structural setbacks. 3. Clustering of subdivision lots to provide for maximum preservation of large contiguous areas of dedicated open space. 4. Stringent cleming limitations which can reduce potential impacts to wildlife habitats, vegetative communities, and unconsolidated soils. 5. Maximum practicable confinement of development to areas with slopes of less than 10%. 6. Maximum use of native species for landscaping purposes. 7. Conslxuction of recharge areas, so as to minimize the amount of disturbance and structural modification to the site. 8. Maximum use of land-banked parking on commercial sites. 9. Minimal use of fertilizer-dependant turf and landscaping. 10. Employment of stormwater ranoff control measures necessary to maintain runoff on-site.
