The board made the following findings and determination: ~ By this appeal, appellants seek approval of access over a private right-of-way commencing at a point located at the north side of the Main Road and extending northerly approximately 480 feet to the begin~ ning of the Subdi:vision of "Jonathan D. Stern at Orient". The right-of-way extending within the subdivision in question is not within the purview of this board. The 480' right-of-way as shown the survey submitted with this application surveyed by Van Tuyl and Son June 25, 1970 has a legal width of 33 feet and has a varied traveled, improved width of between nine and 12 feet. The macadam top course is broken in some areas. Also, for the record it is noted that the subject right-of~way is traversed by a large number of residents in the area and is the legal access to these parcels and possibly others along abutting r rights-of-way. ' In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of zoning; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created, that the difficulty cannot be obviated by a method feasible for appellant other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in viewaf the manner in which the difficulty arose and in consideration of all the above factors, the interests of justice will be served by allowing the variance as indicated below. Davis REPORT NO. 320 FROMI DATE: August 31, 1983 RE I STERN/DEVOE RIGHT-OF-WAY COMMENTS: Reference is made to your letter of August 29, 1983 and copy of letter dated August 16, 1983 from Joanne DeVoe in the matter of using an asphalt surface course on the entire length of the R.O.W. The DeVoe letter states that the asphalt course would be 2" in thickness and 10 ft. in width. I would recommend the asphalt course at the 2" depth but would still want the 12 ft. width. I am familiar with the existing materials in the present R.O.W. and believe the 2" asphalt surface will be satisfactory. Dear Mr. Raynor: After the rain we had last week,-we were left with deep gullys where the gravel washed out, sending it all down the hills. In our opinion, and in the opinion of the neighbors with houses on the right-of-way, the placing of another 4" on gravel would only compound the problem. Last Sunday Paul Corazzini came up and gave us an estimate on paving the entire road. Although more costly, we all feel that by using blacktop we wil~ elimiat~'the problems we have with every rain. Therefore, we are willing to pave the entire 2000 plus feet of Right-of-way leadiDg from the Main Road to our house with 2" of ashpalt ten feet wide. I would like to discuss this alternative with you.
