I own a home on the Main Road in Orient Point, about one-half mile west of the ferry terminal. Recently, several business establishments including the Orient by the SeafRestaurantlMarina, the Plum Island Ferry and the Cross Sound Ferry have installed high-intensity exterior lighting systems on their properties. These lights, which are on from sunset to sunrise, emit a very bright orange- pink light (I believe they are either mercury- or sodium vapor) that illuminates the sky for hundreds of yards around. Our neighborhood, which formerly had a rural feel with the night sky and stars visible, is now lit up like a parking lot near Yankee Stadium. I am sure these businesses wanted to increase security in their parking lots, and I and my neighbors are sympathetic to this. However, I am hoping that we might agree on some compromise which would avoid destroying the "feel"of our end of the Island. Perhaps lower-intensity incandescent lamps could be used and/or the fixtures shielded in a way so that the light focuses downward onto their properties as opposed to creating a "halo" effect that illuminates the whole sky. I suppose that the first step is probably for you or someone from the Town to take a look. I and my neighbors would very much appreciate anything the Town can do to remedy this situation. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. The proposed system will be 20 ft. to 30 ft. from the marina bulkhead. 11. The site is developed with a 90-slip marina and restaurant of 160 seats. 12. Applicant has received Zoning Board of Appeals approval from the town of Southold. 13. New York State Department of Environmental Conservation has issued a letter of non- jurisdiction because the system is proposed landward of a bulkhead that existed prior to 1977. 14. Marina was constructed in 1959. 15. The need for the new facility is to serve the boating clients who now use the existing restaurant facilities. 16. The proposed leaching pools are no closer to the water than the existing system that serves the restaurant. 17. The facility will only contain two toilets. 18. No. 4905—ORIENT BY THE SEA MARINA/MGH ENTERPRISES (HAAS) Planning Board Parcel Location: South Side of Main Road (S.R. 25), Orient PARCEL 1000-15-9-8.1 Date of Public Hearing: January 4, 2001. FINDINGS OF FACT PROPERTY FACTS: A site plan prepared by Architechnologies, dated October 19, 2000, shows the subject property to be a parcel of 4.55 acres lying between Main Road and Gardiner's Bay in Orient. It is improved with a restaurant and a marina for commercial and recreational fishing boats. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated November 21, 2000, denying a permit to construct an accessory building because it would be 3 feet from the property line whereas Code section 121C(1) requires a minimum setback of 20 feet. RELIEF REQUESTED: Applicant requests a variance authorizing the location of the accessory building as proposed, with a 3-foot setback from the westerly lot line. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicant wants to provide adequate restrooms for marina patrons, as well as some cold storage for patrons' fish and ordinary storage space for his business. He proposes to build a 20 x 40-foot structure containing these facilities. (2) The property is deep from Main Road to the Bay, but narrow, and the entire center is a boat basin. The relatively narrow strip of land between the westerly lot line and the boat basin is paved and provides vehicular access with parking spaces abutting the westerly lot line. The rational location for the proposed building is on this paved strip. Although there is open land near Gardiner's Bay, that would be a very inconvenient location for the proposed building.
