The following resolution was adopted: WHEREAS, Janet T. Swanson and Marion D. Fitzsimmons are the owners of the property known and designated as SCTM# 1000- 15-3-1 & SCTM#1000-15-2!-17.5, located at Route 25, Orient; and WHEREAS this lot line change, to be known as Proposed Lot Line Change for Janet T. At her own cost and expense, Swanson shall apply to the Town of Southold for whatever municipal approvals are necessary to permit the conveyance of property and realignment of the right of way as hereinafter set forth. 2. If the aforesaid approvals are received, the parties agree to execute and deliver the following documents, in accordance with the terms of this paragraph and paragraph "3" hereof: (A) Fitzsimmons shall, at no cost to Swanson, execute and deliver a quitclaimjdeed, in a form suitable for recording, by which she shall transfer and convey to Swanson all of her right, title and interest in ',and to the 23-foot by 200-foot parcel of property located adjacent to the southerly portion of Swanson's property more fully described and set forth on the annexed survey prepared by Peconic Surveyors, last revised on May 19, 1990. This quitclaim deed shall also create a right of way for the benefit of both the property conveyed by Fitzsimmons to Swanson and the property now owned by Swanson, which said right of way shall run from Ryder Farm Lane westerly, along the southerly side of Marion Lane, and thence northerly, along and over the easterly side of the property owned by Fitzsimmons, to the land to be conveyed to Swanson pursuant to this Agreement. The said right of way shall be 12 feet in width, dIxcept where its north-south and east-west legs intersect, where it shall include an additional turning area defined by an arc. The width and location of the right of way, including the arc of its turning area, are shown on the survey annexed hereto, and the! deed to be delivered to Swanson hereunder shall describe the right of way by the metes and bounds set forth on said survey. The night of way shall permit passage by foot, bicycle, etc., or motor vehicle for all customary residential activities. (B) Swanson, shall execute and deliver, in a form suitable for recording,! a quitclaim deed or such other documents as are necessary, to cancel and terminate the portion of the existing right of way set forth in documents recorded in the Office of the Suffolk !County Clerk at Liber 2405, Page 27 and Liber 7517, Page 41 that is not encompassed in the new right of way described in paragraph "2(A)" above. The parties agree that First American Title (!Insurance Company shall determine the appropriate documents to effectuate said termination. 3. The deeds and other documents to be executed and delivered pursuant to paragraph "2" above shall be delivered to the Office of Esseks, Hefter & Angel at 108 East Main Street, Riverhead, New York, and held by that office in escrow pending receipt by Swanson ofa title report from First American Title Insurance Company or, other mutually agreeable title company confirming that Fitzsimmons has and may convey good and marketable title to the 23-foot by 200-foot parcel and the right of way set forth in paragraph "2(A)" above.
