Box 728 Southold, New York 11971 April 22, 1983 IIPR 2 5 Bear Planning Board: I am writing to your in response to a prospective road to be built right through my recently squired land at Orient Point. As the new owner of a ten acre farm at Orient Point(see enclosed survey), I was recently informed by your town meeting on April 18, 1983, that the town is interested in designating some part of my ~arm ~or a prospective road to be extended from Bight Road. I strongly oppose. Having spent an exuberate amount of money to purchase these ten acres and plan on spending another hefty some in building a private home and landscaping, I do not want my land to me severed. I p~'rchased this land with great intent to preserve the area of Orient Point. A road extending from Bight Road onto my land would only create more development and congestion. I would have not pur- chased this land two months ago if I kn~w of th&s threat. Why build a road when the Main Road is only 300 £eet away? I am deeply disturbed in regard to this matter and shall do everything possible to prevent this prospective road from being built. The "Owner" reserves the sole rig~ ~ to grant franchise and ~onsent for the installation and maintenance of any publzc u~ility in, over and ~pon and across any of the streets in the development, lncluding, without limitation the right to lay wa~er and gas.mains, erect pole lines for the transmission of etectrzc power and install other utilities in, over, upon and across the said streets. The "Owner" does also reserve for himself and his suc- cessors in interest a perpetual easement not to exceed five (5) feet in width, along the rear and side lines of each lot in the development for utility installation and maintenance. The "Owner" reserves the right to dedicate all streets, roads, drainage areas and easements to the Town of $outhold for hi~'way and drainage purposes. Failure by the "Owner", his successors or assigns, or any owner, to enforce any of the provisions herein shall in ne event be deemed a waiver of the right to do so thereafter. In validation of any one of these covenants. by judgment or court order shall in no wise affect any of the other provisions which shall remain in full force and effect. The "Owner", bis successors or assigns shall have the : right to alter, modify or annul any of the covenants, restrictions or conditions of this Declaration except those contained in Paragraph 1, and shall also have the power to assign such rights with or without conveyance o~ any title by an instrument in recordable fo~.
