(SBB 87150) S.C.T.M. : 1000-14-2-1 Gentlemen: A site inspection was conducted on 3/2/88. The roadway east of the Demerest property from Main Road was originally inspected on 8/3/87. The report (SBB letter dated 8/3/87) submitted at that time recommened that a grading plan for this roadway be submitted for review to avoid the problems that now exist due to the elevation of the gravel roadbed recently installed. We again recommend submission of a final grading plan to include elevations along the Demarest property line. We inspected the roadway reconstruction from Main Road (Route 25) north and found a dozer parked and fill distributed along the access road. If the elevation of this material spread on the road bed is the proposed finished grade which is, at present, higher than the property to the west The final result of this work will be that the surface runoff will drain to the westerly edge of the right-of-way and onto the Demerest property. We recommend an immediate curtailment of this work, until a plan reflecting the final roadway profile be submitted for review. The subdivision map lists restrictions, re: construction in respect to the bluff. We found that these restrictions were not adhered to, although upon further investigation at the Building Dept. , some of this restricted construction had been approved by the Board of Appeals. We await submission of the grading plan, reflecting the current road reconstruction, as drainage facilities may be required. At that time we will review this project and render our recommendations. If the elevation of this material spread on the road bed is the proposed finished grade which is, at present, higher than the property to the west. The final result of this work will be that the surface runoff will drain to the westerly eage of the right-of-way and onto the Demerest property. We recommend an immediate curtailment of this work, until a plan reflecting the final roadway profile be submitted for review. The subdivision map lists restrictions, re: construction in respect to the bluff. We found that these restrictions were not adhered to, although upon further investigation at the Building Dept. , some of this restricted construction had been approved by the Board of Appeals. We await submission of the grading plan, reflecting the current road reconstruction, as drainage facilities may be required. At that time we will review this project and render our recommendations. We believe that a number of the conditions have imposed un- warranted restrictions on the use of the premises . In this connection, there are only four lots to be utilized in this total acreage, all of which are substantially in excess of the minimum ares required under the Zoning Ordinance and substantially greater than the width requirement. We deem the most serious of the conditions to be that number- ed 5 whereunder access structures to the beach are to be shared for every two lots. We find it difficult to comprehend that access structures for each lot would impose any serious problem in the disturbance of the Sound bluff. Such a condition, however, will cause a great number of problems in the sale of these lots in terms of imposing on prospective owners the need for each to enter into access agreements of construction and maintenance. These are to be high priced lots and we believe the owners thereof would find it most difficult to have to bargain with such a situa- tion. In the light thereof, we would respectfully request that the last sentence with respect to access structures in condition number 5 be eliminated. RESOLVED that the Southold Town Planning Board agrees with the , conditions of the Suffolk County Planning Commission in regard to the subdivision of Whitcom Realty Company as follows: 1. No sanitary disposal facility shall be located within 100 feet of the top edge of the bluff or within 100 feet of the edge of the freshwater marsh. 2. No grading shall be permitted within 50 feet of the top edge of the bluff except that that may be necessary to control or remedy erosion or to divert stormwater from flowing over the edge and down the face of the bluff. 3. Clearing and cutting of vegetation within 50 feet of the top edge of the bluff shall be limited to that necessary for maintenance and the removal of dead or diseased vegetation. 4. No stormwater resulting from the development of any lot shall be discharged down the face of the bluff in any manner or directly into the freshwater marsh area. 5. Access down the bluff to the beach shall be restricted to a structure designed and constructed in such a manner as to result in a minimum disturbance of the bluff. Access structures shall be limited to one for every two lots located on or near the lot line common to two lots and shall be shared by the owners of the two lots. The right-of-way shall be extended to the easterly property line to provide for the aforementioned proposed collector road. 9. Dear Mr. Raynor: The Commission returned the proposed subdivision map, entitled, "Minor Sub- division - Whitcom Investment Company", as an incomplete referral for the three reasons given in my letter to you dated April 3, 1980. Apparently, due to the brevity of the reasons, some confusion has arisen as to the information being sought by the Commission. I will, therefore, attempt to elaborate on these reasons so that you will be able to provide the required information. It was the opinion of the Commission that the subdivision of the tract into five separate parcels constituted a major subdivision; the fifth parcel being the one containing the freshwater marsh. The Commission would like to know why the subdivision was being handled as a minor subdivision. Unfortunately, the fifth parcel was not labeled other than "Fresh Water Marsh - Area = 17.333 Acres". This caused some confusion as to the purpose of the parcel. Although it was pointed out that this parcel was going to be offered to The Nature Conservancy and that no approval would be granted to the subdivision until covenants were filed in the County Clerk's office prohibiting development on the parcel, the Commission was still very concerned about the eventual disposition of the parcel. There was much deliberation about this aspect of the subdivision. What, for example, would happen to this parcel if The Nature Conservancy did not accept the offer? Would the parcel end up in the County's hands through tax default because the owner could not see any reason to continue to own the property if it could not be developed? The Commission also felt that because of the shape and area of each of the four building lots that were being created that each lot was prime for future subdivision. Should these lots be subdivided the Commission felt that there would be access prob- lems and environmental impacts. The Commission felt that it should be given some assurance that there would not be further subdivision of the tract and if it was fur- ther subdivided that it be given an opportunity to review the subdivision even if it did not formally come within its area of review. It has been faced, in the past, with the situation where its approval of a minor subdivision placed a major subdivi- sion of one of the lots within the minor subdivision outside of its jurisdiction.
