Dear Mr. Bruer:
The following took place at the meeting of the Southold
Town Planning Board on Monday, August 17, 1992.
The final public hearing which was held at 7:30 P.M., was
closed.
The following resolution was adopted:
WHEREAS, Suzanne M. Egan and Venetia Hands are owners of
the property known and designated as SCTM#1000-13-3-10, 11 & 12
located at the south side of South View Drive at the
intersection of Brown's Hill Road; and
WHEREAS, this Lot-line change, to be known as Proposed
Lot-line change for Suzanne E. Egan and Venetia Hands, is for a
lot line change to subdivide a 15,700 square foot parcel and
merge 7,840 square feet of it to a 17,180 square foot parcel to
the east; and to merge 7,860 square feet of it to a 15,909
square foot parcel to the west; and
WHEREAS, the Southo1d Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
July 21, 1992; and

WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met, and
be it therefore,
RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated June 1,
1992.
Enclosed please find a copy of the map which was endorsed
by the Chairman.

WHEREAS it is the desire of all of the parties hereto that
the restrictions on all of tne parcels of land in the Brown's
Hills Estates development should be substantially identical,
Now, Therefore, in consideration of the premises, and of the
aum of One Dollar by each of the parties to the other paid, the
receipt whereof is hereby acknowledged, and of other good and val-
uable considerations, and the agreements made herein, it is mutual

A, The restrictions imposed on the premises conveyed by the
First Parties to the Second, Third and Fourth Parties by the
several deeds hereinabove referred to are hereby abrogated, nul-
lified and voided for the slll1le purpose and to the seme effect as
though they were not mentioned in the said foregoing deeds,
B. In lieu thereof the following restrictions are placed on
the said premises I
1. No bUilding shall be erected or permitted upon any portion
of eaid premises other than a single, one-family detached dwelling
house on a fully enclosed (except for necessary doors and windows)
masonry foundation, of not more than one and one-half stories in
height; and containing within its exterior walls (not including
porches or any attw:hed ('arage) on the ground floor not less than
seven hundred fifty (750) square feet, or other than a private
garage and other necessary and proper outbuildings (exce~t privies
for the use of the occupants of such dwelling house.
2. No lot shall be of ~ ss than 10,000 square feet.
3. That no fence or hedge shall be erected or permitted upon
said premises exceeding four feet in height.
4. That no building or other structure, except a pump house,
shall be erected or permitted which, measured from its main founda
tion walls, ehall be within ten (10) feet of any lot, boundary or ,

a 15,909 square foot parcel to the west. The purpose of
this lot line change is to eliminate one building lot by
dividing it and merging with the two adjoining parcels.

Reasons Supporting This Determination:
The proposed lot-line change will not increase the
intensity of land use in this Residential Low Density
(R-40) zone as both lots have existing residential
dwellings. Rather the change will reduce the overall
density by removing one building lot from circulation.
An Environmental Assessment has been submitted and
reviewed. It was determined that no significant effects to
the environment were likely to occur should the project be
implemented as planned.

The proposed lot line change between Suzanne M. Egan and
Venetia Hands is to subdivide a 15,700 square foot parcel
and merge 7840 square feet of it to a 17,180 square foot
parcel to the east; and to merge 7,860 square feet of it to
a 15,909 square foot parcel to the west. The purpose of
this lot line change is to eliminate one building lot by
dividing it and merging with the two adjoining parcels.

Reasons Supporting This Determination:
The proposed lot-line change will not increase the
intensity of land use in this Residential Low Density
(R-40) zone as both lots have existing residential
dwellings. Rather the change will reduce the overall
density by removing one building lot from circulation.
An Environmental Assessment has been submitted and
reviewed. It was determined that no significant effects to
the environment were likely to occur should the project be
implemented as planned.
