This is in reference to your request to waive the installation of concrete curbing along Route 25
at the above noted location.
After review, per your request, we find that the installation of the curbing is necessary to provide
continuity with future development east and west of your property, along Route 25. The
installation of curbing prevents unregulated ingress/egress to sites and defines and controls
access. While I understand the masons for your request, based on the above, we must require the
installation of the concrete curb.

Dear Ms. Herold:
The following took place at a meeting of the Southold Town Planning Board on
Monday, May 18, 1998:
WHEREAS, The Mattituck Presbyterian Church is the owner of the property
known and designated as SCTM# 1000-141-4-32.1 & 26 located on Main Rd. in
Mattituck; and
WHEREAS, the Zoning Board of Appeals has granted a variance for this non-
conforming building with a non-conforming use in this Hamlet Business (HB)
zone; and
WHEREAS, an examination has been made of all uses and the existing parking
was determined to be adequate due to public parking facilities across the street;
and
WHEREAS, the proposed 1,114 square foot addition to an existing church
building will not be a more intensive use of this property; and
WHEREAS, the Architectural Review Committee has approved the elevation
drawings on April 3, 1998; and
WHEREAS, any violation of the conditions of this resolution may be grounds for

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION:
The above-identified property is a corner lot, situate on the southerly
side of Sound Avenue and the westerly side of Main Road (a]k/a State
Route 25), Mattituck. The subject promises consists of a total size of
163,916 square feet (3.763 acres), as shown on the December 10, 1997
survey proparod by Northstar Surveying, P.C. The promises is
improved with a church building located at the easterly portion of the
promises, set back 44 feet from the chain link fence to the north (close
to the northerly property line along Sound Avenue). Also existing on
the promises are a 20 ft. by 24 ft. masonry structuro and the Church
Cemetery. (For information purposes, it is noted that there aro other
lands adjoining this site also owned by the applicant identified as
County Tax Map Parcels 26, 33 and 34, District 1000, Section 141,
Block 4, which aro not a part of this application.)
BASIS OF APPEAL: Building Inspector's March 13, 1998 Action of
Disapproval which reads as follows:
"...Under Article XXIV, Section 100-243, a nonconforming building
with a nonconforming use cannot be enlarged, reconstructed or
structurally altered. Note - the nonconforming use pertains to the
HB Zone where churches aro not permitted; the nonconforming
building pertains to the existing front yard set back to Rt. 25
which is less than the required 15 feet. Action required by the
Zoning Board of Appeals .... "
VARIANCE RELIEF REQUESTED BY APPLICANT: Applicant proposes the
construct an addition and alteration to an existing church as shown on
the survey revised March 13, 1998 (Surveyor Job. No. F997) consisting
of a new area of 32 feet by 34.8 feet, which replaces the existing front
porch and step areas and alters a portion of the existing building.

REASONS FOR BOARD ACTION~ DESCRIBED BELOW:
1. Grant of an area variance will not produce an undesirable ehange
the character of the neighborhood or a detriment to nearby properties
because the Church was built in 1715, centuries prior to zoning, and the
modest expansion proposed is in keeping with the time-honored site
the Church. The proposed setbacks of the new addition conform lo the
code requirements.
2. The benefit sought by the applicant cannot be achieved by some
method, feasible for the applicant to pursue, other than a variance,
because there is no other practica] location on the site to build
extension onto the Church.
3. The requested variance is not substantial. It is well established
under the case law that religious institutions enjoy enhanced protections
and are to receive wider latitude in permissive land-use than commercial
businesses such asprovided for in this Hamlet Business District.
4. The difficulty has not been self-created and is due to the historic
use and location of the Church at this site.
5. The proposed variance will not have an adverse effect or impact on
the physical or environmental conditions in the neighborhood or district
because the Church has existed in harmony with the community at this
site for more than 200 years.
In considering this application, the Board deems this action to be the
minimum necessary and adequate, and at the same time preserves and
of the neighborhood, and the health, safety,
protects the character
welfare of the community.

On behalf of the Mattituck Presbyterian Church, 12605 Main
Road at Sound Avenue, Mattituck, tax map 1000-141-4-32.1 and
I would like to request a waiver of site planrequirements.'

The Church is proposing a 32' x 34.8' (1114 square feet)
addition to the main floor of the building. Because the
church is historically significant and is located on a
prominent corner in Mattituck, the design of the addition
was carefully considered. It was decided to relocate the
north end and steeple of the church 32 feet north of its
existing location. The new addition would be built between
the church and the relocated steeple. This would preserve
the appearance of the church and provide the space needed.
The addition would add 17 feet (592 sq. ft.) to the sanctuary
to provide 80 new seats to accommodate the increase in the
congregation. At present, worshippers either stand in the
back of the church or go home. The remaining 15'x 34.8'
(522 sq. ft.) would provide a much-needed handicapped
lavatory and coat area as well as a stair to the lower level.
The increased size of the narthex would provide a "mothers'
room" so that mothers and fathers with small children may
stay for the service.
The lower level would include the area under the proposed
addition and a new cellar under the existing sanctuary in
order to connect to the existing cellar. This area would
add 3965~ gross square feet to the lower level. Approximately
1056 sq. ft. would be used for classrooms and the remaining
space for mechanical equipment and storage for the thrift
store and food pantry.

I am requesting a waiver of site plan requirements for
two reasons.
1. Only a small part of the proposed addition would require
parking spaces. As the attached calculations indicate,
the new pews in the sanctuary would seat 80 people, which
would require 20 additional parking spaces. The classrooms
on the lower level would require 29 parking spaces but these
would be the same parking spaces used by those attending
the services. A review of the available parking on
neighboring properties indicates 195 parking spaces are
available. Therefore, the additional parking spaces are
available for the increased use proposed by the Church.
2. The church has been on this site for many years so the
site is fully developed. The area not used by buildings is
now a cemetery so there is no area left to be developed with
site improvements. Most of the neighboring properties are
also developed. The Church benefits from permission to use
the Handy Pantry parking lot as well as the Town of Southold
parking lot, both across the street from the church.
Because of the significance of the building and its
prominent location, this request does not include a waiver
from review by the Architectural Review Board. If the
Planning Board feels it is necessary, the proposal will
be submitted to that board for review.
