In response to your request of January 28, 1994, the Planning
Board has inspected the Resource Center and reviewed the site
plan. Attached you will find a copy of the draft parking layout
drawn by Jamie Richter which provides for additional parking on
the site. We endorse this layout with the following comments:
If security lighting is added to the parking area,
the pole lights should be restricted to 12' in height
and the lighting be directed downward to prevent glare
onto the surrounding residential neighborhood.

If possible, the pick-up and loading zone at the
entrance to the center should be designed so that the
vans can discharge and pick-up passengers right at the
entrance without blocking the travel lane.

This memo is intended as an addendum to the Planning Board's
response to your January 28th request. Its purpose is to
provide additional factual background and technical information
that may be needed to facilitate a decision.
The maximum building occupancy is 92 persons. At present
there are 24 parking spaces, which works out to about one
parking space for every 3.8 persons.
The parking layout drawn by J. Richter provides for about
50 spaces. However, it does not provide for the designated
van pickup and drop-o~f area recommended by the Planning
Board. Attached you~ind a diagram showing how the van
area could be designed in order to keep the travel lane
open while a bus or van is loading/unloading.
This plan was drawn at the request of the previous
administration, and at that time, Ray Jacobs indicated that
the work could be done, but only as the work schedule
permitted. I am not sure, but I think the Town would have
to provide money to the Highway Department to purchase all
the necessary paving materials. Consequently, the cost of
this expansion will depend on the quality of the parking
lot's construction.
There may be some complications in expanding the parking
area due to the fact that many years ago, the Bank gav~ the
Street on its own property. (This intersection has a
severe flooding problem.) However, no record was made of
where the pools were put, and apparantly no one remembers
their precise location. Accordingly, the work will have to
undertaken with great care so as not to damage the existing
drainage system.
Clearly, you will have to talk with Ray and Jamie at some
length about items # 1, 2 and 3 before you make a final
decision.
The parking layout drawn by J. Richter and endorsed by the
Planning Board assumes that the Garage will remain as
such. It is presently used for storage, and not as a
garage, according to Jim McMahon.
You should be aware that V. McKeighan plans to convert the
Garage into a child care center. Jim says this is not
practical for two reasons: 1. the building is not designed
for such a use; e.g. there are no bathrooms on the
building, no insulation, no windows, etc. and 2. the
Health Department is not likely to approve any expansion of
use on this property without public water (the site already
has a variance from the Health Dept.) I would add a third
reason: the site is too small for the present use,
nevermind adding a day care center.
Sad to say, but when the kitchen was added onto this
building, none of the landscaping was replaced, and the
entrance to the kitchen was placed in the front yard,
facing Sound Avenue. My understanding was that this
entrance was intended for fire exit purposes only. The
Zoning Board's decision, which permitted the front yard
setback to be reduced to 13', stated that the front yard
was to be a "non-traffic area". However, in actuality, it
is used for deliveries. There is no sidewalk from this
door to the street, just a sea of mud and a cardboard
"walk" created by the kitchen workers to make a path for
the delivery people.
In my opinion, this slipshod approach has resulted in a
building that has become a negative element in a
neighborhood that badly needs visual enhancement, not
further degradation. A municipality should hold itself to
the same standards as it holds its residents and developers
alike.
Accordingly, whether the Town decides to expand the parking
area or not, I would strongly recommend that the Town Board
ask the Tree Committee to landscape the site with street
trees around the entire perimeter of the property, and with
shrubbery around the parking area to buffer the parking
area from the adjoining residential neighborhood. The
property itself is zoned Hamlet Business, but it is
bordered on its south and west by an R-40 residential
district that is composed of older homes. In fairness to
the existing residential community, the Town should provide
some landscaping to this site.

Upon application filed bY THE NORTH FORK BANK & TRUST
COMPANY for a variance to the Zoning Ordinance, Article IX,
Section 100-92 for permission to construct addition with an
insufficient front yard setback along Sound Avenue. Location of
Property: 750 Pacific Street at intersection with Sound Avenue,
Mattituck, NY; County Tax Map Parcel No. 1000-144-4-24.
Subject premises is located in the Hamlet-Business (HB) Zone
District.
WHEREAS, a public hearing was held on September 10, 1992,
and at said hearing all those who desired to beheard were heard
and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, the present use and zone
district, and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question:
(a) is located in the Hamlet "HB" Business Zoning
District, is identified on the Suffolk County Tax Maps as
District 1000, Section 141, Block 4, Lot 24, and contains a
total area of approximately 51,226 sq. ft;
(b) is improved with a principal one-story stucco
building having been used as a banking and mortgage company, and
a separate stucco garage building used for accessory storage and
garage purposes incidental to the main use of the premises which
is located in the southerly (rear) yard area. {See survey
revised on September 18, 1989, prepared by Young & Young, L.S.}
(c) the setbacks of the existing principal building
are presently 21 feet from the northerly property line, 23 feet

from the northerly concrete curb, 29.8 feet from the westerly
front property line, 39 feet from the westerly concrete curb,
42.8 feet from the easterly property line, and 177+- feet to the
southerly property line, all at its closest points.
2. The application before the Board is related to the
recent occupancy by the Town of Southold of the Nutrition
Center, or Human Resource Center, (which has been relocated from
its site at St. Agnes Hall in Greenport) and involves an
expansion extending 14 feet from the existing closest ~etback,
and 24 feet from the further setback. This expansion is
specifically necessary for this Town 'Service Center, and will be
a kitchen work/food-service area, and two lavatories. The
application is being made for the Town of Southold by the North
Fork Bank & Trust Company. It should be noted that if the
acquisition of this property by Town of Southold was finalized
by this date, the Town would have been exempt from the zoning
setback requirements. Due to time constraints, the Bank is
assisting the Town in its efforts to acquire and occupy the
premises with the new extension.
3. For the record, it is also noted:
(a) that the yard area which is the subject of this
variance is at the northerly side of the principal building;
(b) that the setback proposed for the new kitchen
area is shown to be approximately 13 feet from the existing
· concrete curb along Sound Avenue (also known as the old North
'Road) approximately 80 feet from the existing concrete curb
along Pacific Street to the west.
(c) that there are other front yard setbacks to the
west and to the south, in the immediate area of this property,
which have similar reduced front yard setbacks;
(d) that the allowance of an addition at the
northerly front yard area, as applied, will not be adverse or
create a dangerous or adverse conditions, and will not interfere
with visibility or manueverability along these side streets;
(e) that the aesthetics of the front yard area will
not be changed since the addition will not exceed one-story
height (variable 14-17 feet), the front yard landscaping will
remain and will be a non-traffic area; and the parking area
will remain located at the south of the principal building with
dual access points (from Pacific Street and from Sound Avenue at
the northeast side of the building), as previously existed and
still exists.

(f) the new floor area for this extension is shown to
be 1120+- square feet. The existing floor area of the building
is shown on the town records to be 4965+- square feet.
5. In considering this application, the Board also finds':
(a) that the relief, as conditionally noted below,
will not be adverse to the essential character of the neighbor-
hood;
(b) that the relief, as conditionally noted below,
will not in turn be adverse to the safety, health, welfare,
comfort, convenience or order of the town, or be adverse to
neighboring properties;
(c) that the relief herein will not be an increase in
density, or cause a substantial effect on available governmental
facilities;
(d) that although the amount of relief requested is
substantial in relation to the requirements, the setback will be
similar to others existing in the area;
(e) in considering all of the above factors, the
interests of justice will be served by granting the relief as
requested.
Accordingly, on motion by Mr. Goehringer, seconded by
.Mr. Villa, it was
RESOLVED, to GRANT a variance for a proposed one-story
kitchen addition as applied and shown on the plans prepared for
the Southold Town Human Resource Center (Nutrition Center) by
the Southold Town Engineering Department dated May 22, 1992,
subject to approval of the Town Building Inspector under all
state building and construction codes.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Dinizio, and Villa. This resolution was duly adopted.

Enclosed is a copy of a survey I have sketched a proposed
addition to house a kitchen addition t6 the building which the Town of
Southold is proposing-zor its nutrition center. Also enclosed is a copy of
the N of Disa roval from the Building Department, and a copy of the
Va~riance Application.
We would like to request a waiver of site plan approval. The plans
for the addition are on file with the Building DepartmenT%'

RESOLVED that the Town Board of the Town of Southold hereby authorizes James
C. McMahon, Director of Program Evaluation, to submit the necessary permit
applications to the New York State Department of Environmental Conservation,
Corps of Army Engineers, and Southold Town Trustees, for the repair of the
Brushes Creek Bridge, Peconic Bay Boulevard, Mattituck, New York.

Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris.
This resolution was declared duly ADOPTED.
SUPERVISOR HARRIS: As most of you know, that's one of the few bridges that
the Town of Southold owns. Most of the bridges in the township are owned
by the County of Suffolk, and this bridge is in need of repair, and Superintendent
of Highways Ray Jacobs is on top of this with Town Engineer Jamie Richter,
and they are now working on a schedule to get this repair underway, as
expeditiously as possible.

SUPERVISOR HARRIS: Are there any members of the a~dience, that would like
to address this Board on any issue, that may be of importance, not only to you,
but would be of importance to this Board? Yes, come forward, a~d state your
name, please.
RONNIE WACKER: Ronnie Wacker. I was interested in this resolution to support
the Clean Water/Jobs Platform of the Long Island Sound Coalition. I think that's
one cause that's so very important because environments creates jobs, and it
would be good for our economy here. We are fortunate being that Peconic Bay
is not yet polluted, and we are fortunate in being in a position where we can
help keep it clean by the simple fact of not developing Robins Island, and that's
what brings me here. I would like to know what the Town Board is doing about
Robins Island? What is happening?
SUPERVISOR HARRIS: The Town Board has passed many resolutions, as you
know in the past, including one just recently, and we've.' supported memorializing
what our position is. It's totally up to the litigation, that's ensuing in the County
of Suffolk. That's as far as this town can take it.
RONNIE WACKER: Well, you know I think this Town should take it further.
This town is the town most involved. This is like having a wedding-without
the bridegroom. You know we 'are the most involved. We are going to have '
the greatest inpact on our area. New Suffolk is going to suffer. Partial develop-
ment of that island is going to lead to partial pollution, which would of course,
inevitably lead to total pollution. You know years ago Lee Koppleman said that
development of Robins Island spells the end of Peconic Bay, as a clean bay, and
this is an important item for tourism, for fishing, for the total economy. There's
nothing else we can depend upon. You know we can't make wishes. We have
to depend upon farming, fishing, and fun, recreation, and if the people up west
see what we're becoming, just like that, why bother to come out here to see
another KMart?
JUSTICE EDWARDS: What do you suggest we do? What do you suggest the
Town Board does?
RONNIE WACKER: I suggest the Town Board camp on Mr. Caffney's doorstep,
and tell him we are involved, and we want to know what is going on. Why aren't
we participants in this discussion?
SUPERVISOR HARRIS: The question has to be addressed to the Legislature,
and it's not to Mr. Gaffney's Office. I'm not going to give him the total blame
for what has happened in the past. This has been going on for many, many
years. Whatever administration happens to be in charge, the west end towns
refuse to move on this, and to fund it. That has always been the problem we've
had on the East End. We have foughtforevery dollar we've gotten out here. The

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested far the reason that applicant desires to construct a 20' x 40' kitchen extension
to the North side of the building in order to convert the premises to a nutrition cent:
for sale to the Town of Southold. The extension requires a variance due to insufficie,
front yard.

REASON FOR APPE~ Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sow HARDSHIP because the layout of the building and parking/driveway areas makes the
kitchen addition most feasible in the proposed location. Since the property is a come
lot and the building is located near the corner, an extension will intrude into the
setback area. However, to locate the addition on the South side of the building would
require major relocation of the parking area and driveway, site plan review, and possib
relocation of cesspools and drywells installed by the Town of Southold with the owner's
permission to collect road run-off.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the building is situated near the corner,
and the property is a corner lot.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the front yard along Pacific Street will maintain its
current setback; the addition will be one story designed to blend with the existing
building; and there is an additional 12 feet beyond the property line to the curb so
that the set back will appear to exceed 20 feet.
