The fOllowing actions were taken by the Southold Town
Planning Board on Monday, April 3, 1989.
RESOLVED that that whereas, a formal application for the
approval of a lot line change entitled Karl Baunach located at
Mattituck was submitted to the Planning Board on December 27,
1988 and,
Whereas, a public hearing was held on said lot line change
application at Town Hall, Southold, New York, on Monday, April
3, 1989. at 7:30 p.m., and
Whereas, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said application,
NOW, therefore, be it RESOLVED that the application of Karl
Baunach for approval of said subdivision plat prepared by
Roderick Van Tuyl dated February 27, 1989, be approved and the
Chairman be authorized to endorse approval on said lot line
change.

Planning Board, as lead agency for the unlisted action described

DESCRIPTION OF ACTION

The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which

We would sincerely appreciate your taking action as
soon as possible on this application, which was submitted to
you on or about December 21, 1989. It is a rather simple
lot line change between two single and separate lots which
would greatly improve the configuration of both lots.
My clients have quite a hardship in that they have
already had to move from the house, but the young couple
that is buying it cannot move in until this application is
approved since they need a mortgage and the Bank requires
title to the entire parcel.

Please let this confirm for the record in a telephone discussion
with Gail Wickham on December 7, 1988, I indicated that I was
not sure whether or not it was the policy of the Planning Board
to require a variance for premises located at Horton Avenue in
Matt:ituck. It was also mentioned that in a situation where the
nonconformity is not being increased, there have been actions
taken by the Town, without a variance, for a lot-line change.
It was suggested that they inquire further of the Planning Board
and the Building Inspector as to further review of the project.
No submission of the lot-line change map was made to our office
duri.ng that time period.

To correct our letter of December 21, 1988, we were advised by Linda
of the Board of Appeals that there have been recent lot line changes where
a variance has not been required. She did not express an opinion on this
matter and did not have the full details which an application would reveal.
Our main concern is to ascertain what the Town does require so we may proceed
with a rather simple matter in as expedient a matter as possible.

Gentlemen:
We are the owners of the lots listed above, and as
such, are requesting a lot line change in conformity with
the map dated October 14, 1988, by Roderick Van Tuyl, P.C.,
change for the following reasons:
The northwest corner of lot contains a pool, a deck,
and a shed. We wish to contain this in our residence
parcel, and intend to sell the corner parcel, which will be
vacant. It will be more practical to sell if we had the lot
lines changed, so as to sell the vacant parcel as a unit.
Furthermore, the proposed lots would have a more
uniform size and shape than do the present lots, which we
believe is in the interests of the community as well as any
potential purchasers.

The following actions were taken by the Southold Town
Planning Board on Monday, April 3, 1989.
RESOLVED that that whereas, a formal application for the
approval of a lot line change entitled Karl Baunach located at
Mattituck was submitted to the Planning Board on December 27,
1988 and,
Whereas, a public hearing was held on said lot line change
application at Town Hall, Southold, New York, on Monday, April
3, 1989. at 7:30 p.m., and
Whereas, the requirements of the Subdivision Regulations of
the Town of southold have been met by said application,
NOW, therefore, be it RESOLVED that the application of Karl
Baunach for approval of said subdivision plat prepared by
Roderick Van Tuyl dated February 27, 1989, be approved and the
Chairman be authorized to endorse approval on said lot line
change.
