Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on April 1, 1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision - Emilia T. Pike" referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: 1. Creation of a subdivision with substandard lots, that is, lots whose areas are less than the minimum required by the zoning classification of the property, constitutes an overintensification of land use in a groundwater sensitive area in what is meant to be a low density area. Such action could establish a precedence for future subdivision of this kind which would essentially be a circumvention of the Town Board's action taken over the past years to upzone these groundwater sensitive areas. The Commission feels that the Town Planning Board should have the prerogative to review this type of application rather than it being left to the sole discretion of the Zoning Board of Appeals. 2. No information was provided that Parcel 1 when developed will retain on site all stormwater runoff resulting from the improvement of the lot. Pike on Main Road, Mattituck, N.Y. 11952. The Southold Town Zoning Board of Appeals has recently approved the subdivision of the Pike property. This would permit the division of a 60,461 sq. ft. lot so that another house could be built on less than z acre of that property. The question of adequate sewage disposal and water supply for a residence in an already high density area is of extreme concern. An argument might be presented that the division of this property could not be denied because it is surrounded by existing residences with z acre lots. However, this argument falls pale when one considers the other existing structures in the area. Within 500 yards of this proposed subdivision are the following: 1. the Mattituck High School 2. the Roman Catholic Church 3. a funeral home 4. the Mattituck Public Library 5. a physicians office 6. a lumber yard 7. two restaurants 8. 16 private residences 9. three retail businesses We have extremely serious reservations about the effect of further increases in population density in this already-dense area on the quality and quantity of potable water and the effect of more sewage drainage fields on those supplies. Please register this letter as an objection when you consider the water and sewage plans for this property subdivision. We request that you consider the existing population density in the area of the proposed subdivision and reject the division of the Emilia T. Pike property on that basis. Pike Gentlemen: Since the Zoning Board of Appeals has granted a Variance permitting lot width at the frontage of Parcel 1 to be 100. 12 feet as shown on the proposed map , we believe that revision of the lot width to 125 feet is not required. We refer you to a decision entitled Town Board of the Town of Islip v. Zoning Board of Appeals of the Town of Islip , 77 Misc . 2d 23. The L-shaped configuration was created for the express purpose of avoiding a common driveway while still obtaining a 40 ,000 square foot lot. Mrs . Pike feels very strongly about maintaining her own driveway; and as a legal matter , we think it advisable to avoid a common driveway with the creation of reciprocal easements since it could lead to title difficulties , disputes regarding maintenance, and liability problems . While an L-shaped lot is not the most desireable planning configuration, I call to your attention that there is an L-shaped lot immediately adjoining this parcel. Moreover , the width of Parcel 1 is considerably larger than the adjoining lots to the nest and in keeping with the abutting lots to the North. Logically, the most appropriate solution to this problem would be that of our first application - a straight strip with a frontage of 100 feet.
