Dear Mr. Praetorius:
The following action was taken by the Southold Town Planning
Board at a regular meeting held December 15, 1980.
RESOLVED that whereas, a formal application for the approval
of a subdivision plat entitled Minor Subdivision of Roger H. and
Richard J. Praetorius was submitted to the Planning Board on
October 17, 1979 and an application fee of $20 was paid on October
17, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and plat at the Town Hall, Southold, New York, on
November 3, 1980 at 8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations
of the Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED that the application of
Roger H. and Richard J. Praetorius for approval of said subdivision
plat prepared by R. Van uyl, P.C. mapped January 30, 1979 and
amended September 14, 1979 be approved and the chairman be
authorized to endorse approval on said subdivision plat subject
to the following conditions of the Suffolk County Planning Commission
being placed on the map:

We are in receipt of your letter dated November 19, 1980.
Considering the restrictions placed upon the septic system (located 200
feet inland of mean high water) and the questionable groundwater supply in
the area, it does not appear that the minimum standards for two individual
water supplies can be maintained.
Please note that this conclusion is based upon incomplete information and a
formal application should be submitted for a complete response.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that Southold Town Planning Board as lead
agency for the action described below has determined that the
project will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Roger H. and Richard J. Praetorius
is a two lot residential subdivision located at Mattituck.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The New York State Department of Environmental Conservation
determined that the project would not have a significant
effect on the environment and issued a permit to subdivide
the parcel and construct two one-family homes and associated
septic systems.
The Suffolk County Department of Health Services indicated
that it does not appear that the minimum standards for two
individual water supplies can be maintained. Application
should be made to this department.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on December 3,
1980, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Roger
H. and Richard J. Praetorius" , referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to approve
said map subject to the following two conditions deemed necessary to help preserve
the natural and aesthetic characteristics of Mattituck Creek:
1. All requirements imposed under the Tidal Wetlands Permit shall be adhered
to.
2. There shall not be any direct discharge of stormwater runoff resulting
from the development and improvement of these lots into Mattituck Creek.
The Commission also offers the following comment on the map for your use and
consideration:
Stormwater from Westview Drive flows through the center and northwesterly
parts of the tract and discharges into Mattituck Creek. Before the Planning Board
grants approval of this subdivision it should investigate this drainage flow
thoroughly to insure that if these lots are developed that the Town of Southold
will not be faced with a flooding problem in front of these lots. It is also sug-
gested that the Town investigate the possibility of creating an easement through
these lots for drainage purposes.

The following property owners in Brower Woods, Kattituck, resent and object to your
granting a variance of one lot into two undersized lots, Appeal 2586, dated September
6, 1979, Article III, Section 100-310.
WE SEEK A REVERSAL OF YOUR DECISION FOR THE FOLLOWING REASONS:
1. There is no consistent pattern of ownership in Brower Woods of narrow frontages
and insufficient area to justify this variance. Please note our proof by studying
the survey covered by this petition. Many owners built on two or three lots.
2. There is no reasonable hardship to the owner other than the 10S8 of his contem-
plated profit. This is a selfish interest to try to gain monetary advantage.
Furthermore, we question whether two lots would bring Mr. Praetorius any more
money than one.
3. This variance will lower our property values and encourage other owners of vacant
land to try and cut up their property. This will be true not only for adjoining
owners but to ~ of Brower Woods. This is a hardship on ~ of us as against
his one possible hardship.

Dear Mr. Raynor:
It has come to my attention that Allen Dawe had told the Planning
Board not to consider our application or to refuse it because he is
buying parts of our property. No part of our property is being considered
for sale by us to Allen Dawe or anyone else.
I want to inform the Planning Board that the crusade by Allen Dawe
to keep us from Sub-dividing is based on nothing but his own self interests
in his attempts to purchase parts of our property. He has attempted to
influence the Local Board of Appeals and now the Planning Board Simply
to make the property les!s useable to us and lower in value for his purchase
attempts. We feel his actions are immoral and illegal.
Our instruction to the Planning Board is to proceed with our
application on a: timely basis. We trust your decision will be based
on logic and facts, and not influenced by the ,conspiracy of one selfish
individual.

this Board made September 6, 1979 granting Richard and Roger
Praetorius, 846 Westmoreland Avenue, Syracuse, NY 13210
approval of insufficient area and width as applied for,
for property located at Westview Drive, Mattituck, NY,
more particularly known as County Tax Map Item No. 1000-
139-1-4.
Mr. Allen Dawe, Mr. George Morgan, Mrs. Rits Schmidt,
Mr. Marty Phillips, Mr. Paul Murphy, among other property
owners in the area of Brower Woods, Mattituck, appeared
presenting a Petition with 20 signatures "resenting and
objecting to the granting of a variance of one lot into
two undersized lots, Appeal No. 2586, dated September 6,
1979, Article III, Section 100-310 [sic]" and seeking a
reversal of decision for the following reasons:
... 1. There is no consistent pattern of ownership in
Brower Woods of narrow frontages and insufficient area to
justify this variance. Please note our proof by studying
the survey covered by this petition. Many owners built
on two or three lots.
2. There is no reasonable hardship to the owner other
than the loss of his contemplated profit. This is a selfish
interest to try to gain monetary advantage. Furthermore,
we question whether two lots would bring Mr. Praetirous any
more money than one.
3. This variance will lower our property values and
encourage other owners of vacant land to try and cut up
their property. This will be true not only for adjoining
owners but to ALL of Brower Woods. This is a hardship on
ALL of us as against his one possible hardship.

The following is excerpted from my minutes of the regular
meeting of the Planning Board held September 22, 1980.
"Praetorius. Mr. Allen Dawe, adjoining property owner,
had requested an appointment to discuss this with the
board. Mr. Morgan appeared with him. This was a split
granted by the Board of Appeals a year ago and Mr. Raynor
asked him if he had approached the Board of Appeals. He
said he had not. Mr. Dawe presented a petition signed by
the property owners in Browers Woods, Mattituck. Mr.
Raynor assured him a covering letter would be sent to the
Board of Appeals asking them for their consideration in
view of the petition. He was told to contact the
secretary of the Zoning Board of Appeals and ask for an
appointment to appear before the board. Mr. Gordon and
Mr. Latham inspected the property and agreed it should not
be divided. The matter will be tabled until there is a
response from the Board of Appeals."
As was indicated to you this morning the Zoning Board of
Appeals has decided not to review this matter. I have, therefore,
placed it on the agenda for my meeting of October 16th.

In the course of processing your application for a minor
subdivision in the Town of Southold, the provisions of the
State Environmental Quality Review Act must be followed. The
Southold Town Planning Board declared itself lead agency and
has made notification to the New York State Department of
Environmental Conservation, the Suffolk County Planning Commission
and the Suffolk County Department of Health Services, these being
the other agencies involved with approvals on this property.
I am enclosing for your information the findings of the
Suffolk County Department of Health Services. You will note
that their determination will be at least partly based on the
determination of the DEC. The following note was received from
the DEC. "This proposed action does not conform to tidal wetland
development restrictions which require a minimum of 40,000 square
feet on proposed lots in unsewered areas. NYS DEC approval is
required of all new subdivisions of land extending into tidal
wetlands and areas adjacent to them. No application has been
received. Forms will be sent."
All processing on this application has ceased and will not
be reopened until such time as any environmental questions are
settled.

After investigation and inspection, the Board finds that the
applicant wishes approval of insufficient area and width'as well as
approval of insufficient road frontage in order to subdivide this
property. The neighboring lots also have road frontage and area
and width less than' that required in the Zoning Ordinance, and
thereby gives a pattern in the neighborhood.
The Board finds that strict application of the Ordinance would
produce practical difficulties.or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the immediate vicinity of the property and in the same use district;
and the variance will not change the character of the neighborhood
and will observe the spirit of the Ordinance.
On.motion.by Mr. Tuthill, seconded by Mr. Grigonis, it was
