The fOllowing action was taken by the Southold Town
Planning Board, Tuesday, October 11, 1983.
RESOLVED that the Southold Town Planning Board approve
an amendment to Condition #3 of "Vincent Annabel Minor Sub-
division" to reduce the 100 foot setback to a 75 foot set-
back from the upland edge of tidal wetlands and shoreline
of Eugenes Creek for the construction of a residential
structure.

has recommended that the Planning Commission append specific
language to actions that call for the modification of
covenants and restrictions that are imposed by the Commission
relative to Commission approval, and
the language suggested as follows:
These covenants and restrictions can be modified only at the
request of the then owner of the premises yith the approval
of a majority plus one of the Town Board of the Town of
after a public hearing. Adjoining property owners shall be
entitled to notice such public hearing but their consent
to such modification shall not be required.
after a brief discussion the Planning Commission concurred that
this recommendation is in the best interest of the County,

to include such suitable language in all future actions where-

Dear Mr. Annabel:
The following action was taken by the Southold Town Planning Board,
Monday, September 20, 1982.
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "Vincent Annabel" ., located at
Cutchogue was submitted to the Planning Board on December 23, 1980
and, a filing fee in the amount of $50 was paid July 12, 1982, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, SouthOld, New York, on August 30, 1982 at
7:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Vincent
Annabel" for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated March 15, 1981 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the fOllowing conditions:
1. No lot shall be subdivided or its lot lines changed
in any manner at any future date unless authorized by
the Southold Planning Board.

2. No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged
directly into the adjacent body of water.
3. No residential structure shall be constructed within 100
feet of the upland edge of the tidal wetlands and the
shoreline of Eugene's Creek.
4. No sanitary disposal facility shall be installed or
constructed within 100 feet of the upland edge of the
tidal wetlands and the shoreline of Eugene's Creek.
5. The above conditions shall be filed .as covenants and
restrictions in the office of the County Clerk on or
prior to the granting of approval to this subdivision.
Upon receipt of a copy of the filed covenants and restrictions and
four (4) copies of the final map, within six (6) months from date of
resolution, the Chairman will endorse approval; two copies will be
returned to you for your records.
If you have any questions concerning the above, please don't hesitate
to contact this office.

Dear Henry:
Receipt is acknowledged of your September 14, 1982 letter with enclosures.
It would appear from the minutes of your August 30, 1982 meeting with respect
to this subdivision that there may be a question among various property owners
in the area as to possible right-of-ways over a paper street known as
"Stillwater Road". The question of who does and who does not have right-of-
ways over this parcel could only be ascertained by an exhaustive title search
as well as an investigation of its use over the years. It is not the function of
the Planning Board to determine title and right-of-ways in land. Such juris-
diction is lodged with the courts. In any event, I do not believe that the
Planning Board should get involved in questions of title.
Even if other persons in the area have a right-of-way over Stillwater Road
it does not seem to me that this should enter into the question of whether 0r
not the Planning Board should approve or disapprove the map.
For the foregoing reasons, I believe that the Planning Board should proceed to
consider this matter without regard to whether or not certain persons have the
right to cross the southerly portion of the Annabel property. This is alSO in
view of the fact that Lot No. 2 has an area of 55,000 sq. ft., far in excess of
the minimum lot size.

at our regular meeting August 30, 1982. Mr. Krukowski, an
adjacent property owner, questioned legal access over a por-
tion of the property being subdivided not only for himself,
but for eight other property owners in this area.
In order to avoid possible problems in the approval of this
subdivision we would greatly appreciate your reviewing the
enclosed information and advising our board of your determin-

Dear Mr. Raynor:
We are the attorneys for Edward Tashjian and Louise
Tashjian, the purchasers of the Vincent Annabel property which
appeared on your August 30 calendar for Approval of a Minor
Sub-division.
We were advised by Mr. Tashjian who was present that
Mr. Krukowski alleged at that meeting a right-of-way over the
property and objected to the approval on the grounds that no
right-of-way appeared on the sub-division map that was presented
for approval to the Board.
please be advised that it is Mr. Tashjian's position
that whether or not a right-of-way exists should have no effect
upon the granting of the Application for this Minor Sub-division
since the sub-divided lot in question has 55,000 square feet.
Further, it is Mr. Tashjian's position that Mr.
Krukowski's source of title, Ravatone Realty corporation of
5 Audrey Avenue, Oyster Bay, New York, did not receive such right-
of-way across Mr. Annabel's property from his grantor, Norma H.
Fleet. In sup~ort of that contention we enclose herewith an
abstract furn1shed by the Title Guarantee Company of the full
Covenant and Warranty Deed dated July 16, 1926 liber 1202 pages
242-245 filed in the office of the clerk of the County of
Suffolk which includes under parcel 5 the property of Mr.
Krukowski and the others claiming a right-of-way. It is to be
noted that there is no right-of-way to the water across the
Annabel property which was granted directly by deed from the

said Norma Fleet on October 2, 1930.
The fact that Ravatone Realty may have deeded rights
across my client's property without having such rights in
itself cannot and does not give Mr. Krukowski or the others any
rights over or across the Annabel property since Ravatone was
never deeded such rights by Ms. Fleet and therefore could not
grant to its grantees, which included Mr. Krukowski and the
others, rights which it did not have itself.
Under the circumstances, it is respectfully submitted
that the Planning Board should approve the Application of
Mr. Annabel as submitted.

Dear Mr. Raynor:
Your letter of August 25, 1983 indicates a refusal by the Planning
Board to relinquish the third of 5 restrictions imposed by the
Suffolk County Planning Commission. It further asks that I request
relief from those offices.
The Planning Board should know that I have followed this course of
action and learned that it is not an avenue for redress. In fact,
the S.C.P.C. defers decisions on such matters to the local munici-
pality. It appears I have travelled up a blind alley.
Let me share with you the enclosed copy of Resolution number 4 -
dated October 13, 1982 from the Suffolk County Planning Commission
which places the final decision for modifications on covenants and
restrictions with the local municipality. Moreover, I have been
advised by the S.C.P.C. that their role in such requests is merely
advisory and subordinated to the home rule prerogative. All this
indicates that the disposition of my request rests solely and
squarely with the Southold Planning Board.
In the hope that I have correctly identified the place of respon-
sibility, I would appreciate the Board's consideration of an amended
set-back request from my original 50' distance to 75 feet. As you
deliberate I strongly urge that you weigh these arguments:
1. First, I would like to quote from a letter to the
Board from the Suffolk County Planning Commission
dated August 5, 1982 that offers the following
statement for the conditions imposed on the sub-
division..." to help preserve the natural and
aesthetic attributes of the shoreline of Eugene's
Creek".
Since my two parcels represent the last two
building lots on Eugene's Creek, one can conclude
that the character and appearance of the shore-
line has long since been established by the clutter

of dozens of homes, all situated on smaller lots,
with lesser frontages and much closer proximity
to the waterfront. I ask that you ponder how a
set-back difference from 100 feet to 75 feet could
have even the slighest aesthetic effect on but a
small fraction of shoreline that is dominated by
an eclectic variety of structures. It almost
appears that I alone am being asked to atone for
all the sins of the past.
2. The average set-back of waterfront structures, up
to 500 feet on either side of my parcels average
about 30 feet. It would appear inconsistent and
unfair to require more than 3 times the set-back
on my property. I'm simply asking for slightly
less than that multiple, 2~ times the average
set-back.
3. The 75 foot set-back distance is consistent with
that established by yet another jurisdiction - the
Department of Environmental Conservation. Since
this state body is, in fact, concerned with the
preservation of tidal wetlands, it would appear
logical for the Board to follow D.E.C. guidelines
on environmental regulations.
4. Needless to say I am aggrieved by the 100 feet set-
back requirement which deprives me of full use and
enjoyment of property I paid dearly for. As long
as I am conforming to all the other requirements
imposed on these parcels, I would think that a
partial restoration to 75 feet would reconcile me
to the sacrifices that have been legislated against
me.
In closing, I am asking the Board to weigh the fairness and reason-
ableness of my request. I further ask that the Board view my case
not as adversaries, but as representatives of a consituent, tax-
payer,and future citizen of the community.

feet.

1. I have filed an appeal with the D.E.C. requesting a

variance I am confident to secure.

Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following five conditions deemed necessary to help preserve the
natural and aesthetic attributes of the shoreline of Eugene's Creek:
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Planning Board.
2. No stormwater runoff resulting from the development of the subdivision
or any of the lots shall be discharged directly into the adjacent body
of water.
3. No residential structure shall be constructed within 100 feet of the
upland edge of the tidal wetlands and the shoreline of Eugene's Creek.
4. No sanitary disposal facility shall be installed or constructed within
100 feet of the upland edge of the tidal wetlands and the shoreline of
Eugene's Creek.
5. Tbe above conditions shall be filed as covenants and restrictions in
the office of the County Clerk on or prior to the granting of approval
to this subdivision.

GENERAL CONDITIONS
1. The permittee shall file in the office of the appropriate Regional
Permit Administrator, a notice of intention to commenCf! work at feast 48
hours in advance of the time of commencement and shall also notify him
promptly in writing of the completion of the work.
2. The ~rmitted work shall be subject to inspection by an authorized
representative of the Department of Environmental Conservation who may
order the work suspended if the public interest so requires.
3. As a condition of the issuance of this permit, the applicant has ac-
cepted expressly, by the execution of the application, the full legal respon-
sibility for all damages, direct or indirect, of whatever nature, and by whom-
ever suffered, arising out of the project described herein and has agreed to
indemnify and save harmless the State from suits, actions, damages and
costs of every name and description resulting from the said project.
4. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across the
bed of the waterway or flood plain or deep holes that may have a tendency to
cause injury to navigable channels or to the banks of the waterway.
5. Any material to be deposited or dumped under this permit, either in
the waterway or on shore above high.water mark, shall be deposited or dumped
at the locality shown on the drawing hereto attached, and, if so prescribed
thereon, within or behind a good and substantial bulkhead or bulkheads, such
as will prevent escape of the material into the waterway.
6. There shall be no unreasonable interference with navigation by the
work herein authorized.
7. That if future operations by the State of New York require an alteration
in the position of the structure or work herein authorized, or if, in the opinion
of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood f1'ows.or endanger
the health, safety or welfare of the people of the State, or loss or destruction
of the natural resources of the State, the owner may be ordered by the Depart.
ment to remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State; and if, upon the expiration or revocation
of this permit, the structure, fill, excavation, or other modification of the
watercourse hereby authorized shall not be completed, the owners shall,
without expense to the State, and to such extent and in such time and manner
as the Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore to its former
condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or
alteration.

8. That the State of New York shall in no case be liable for any damage
or injury to the structure or work herein authorized which may be caused by or
result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to
compensation shall accrue from any such damage.
9. That if the display of lights and signals on any work hereby authorized
is not otherwise provided for by law, such lights and signals as may be pre.
scribed by the United States Coast Guard shall be installed and maintained
by and at the expense of the owner.
10. All work carried out under this permit shall be performed in accor.
dance with established engineering practice and in a workmanlike manner.
11. If granted under Articles 24 or 25, the Department reserves the right
to reconsider this approval at any time and after due notice and hearing to
continue, rescind or modify this permit in such a manner as may be found to
be just and equitable. If upon the expiration or revocation of this permit, the
modification of the wetland hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such
time and manner as the Department of Environmental Conservation may require,
remove all or any portion of the uncompleted structure or fill and restore the
site to its former condition. No claim shall be made against the State ot New
York on account of any such removal or alteration.
12. This permit shall not be construed as conveying to the applicant any
right to trespass upon the lands or interfere with the riparian rights of others
to perform the permitted work or as authorizing the impairment of any rights,
title or interest in real or personal property held or vested in a person not a
party to the permit.
13. The permittee is responSible for obtaining any other permits, ap.
provals, lands, easements and rights.of.way which may be required for this
project.
14. If granted under Article 36, this permit is granted solely on the basis
of the requirements of Article 36 of the Environmental Conservation Law and
Part 500 of 6 NYCRR (Construction in Flood Plain Areas having Special Flood
Hazards - Building Permits) and in no way signifies that the project will be
free from flooding.
15. ~y acceptance of this permit the permittee agrees that the permit
is contingent upon strict compliance with the special conditions on the
reverse side.

. SUPPLEMENTARY SPECIAL CONDIT.
The following conditions apply to all permits:
A. If any of the permit conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address and telephone noted below.
B. A copy of this permit or approval and supplementary conditions shall be avail-
able at the project site whenever authorized work is in progress.
C. The permit sign enclosed with this permit or a copy of spproval letter shall be
protected from the weather and posted in a conspicious location at the work
site until completion of authorized work.
D. At least 48 hours prior to commencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt f~' certifying
that he is fully aware of and understands all provisions and conditions of
this permit. Within one week of completion of the permitted work the bottom
portion of that form shall also be completed and returned.
E. For projects involving activities to be accomplished over a period of more
than one year, the permittee shall notify the Regional Permit Administrator in
writing at least 48 hours to the commencement of" resumption of work each year.
F. If project design modifications take place after permit issuance, the permit-
tee shall submit the appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such modifications. The permit-
tee is advised that substantial modification may require submission of a new
application for permit.
G. All necessary precautions shall be taken to preclude contamination of any wet-
lands or waterway by suspended solids, sediment, fuels, solvents, lubricants,
epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project work.
H. Any failure to comply precisely with all of the terms and conditions of this
permit, unless authorized in writing, shall be treated as a violation of the
Environmental Conservation Law.
I. The permittee is advised to obtain any permits or approvals that may be re-
quired from the U.S. Department of Army Corps of Engineers, New York District,
26 Federal Plaza, New York, NY 10007, (Attention Regulatory Functions Branch),
prior to commencing work authorized herein.
J. The granting of this permit does not relieve the permittee of the responsib-
ility of obtaining a grant, easement, or other necessary approval from the
Division of Land Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, New York 12242, which may be required for any
encroachment upon State-owned lands under water.

Dear Mr. Raynor:
This letter is in response to a call from your office on June 17,
1982, in regards to the above referenced permit.
Please be advised that if there is any proposed change in the
permitted activity, the permittee will need to submit the appropriate
plan changes for approval by the NYSDEC Division of Regulatory Affairs
prior to undertaking any such modifications. All concerned are advised
that substantial modifications may require submission of a new applica-
tion for permit (see Supplementary Special Conditions to the permit,
Item F).
The applicant obtained approval from the department for a division
of land that creates two lots upon which residential construction can be
made in conformance with NYSDEC Tidal Wetlands Land Use Regulations
(TWLUR) .
A change in this plan will likely cause proposed construction on
the southerly lot to be too close to the wetlands because of the extent
and configuration of wetlands upon it. For this reason construction
will be limited to a northwesterly portion of lot (while meeting Town
setback requirements) even with the plan DEC has approved. NYSDEC may
need to oppose a change in this plan.

I spoke with Henry this morning regarding Annabel subdivision.
He is aware of the possible problems with the DEC. I called
DEC and spoke with Bob Thurber. He will be sending the Planning
Board a letter stating the problems that would be involved if
the applicant moved his lot line 20 feet south. When we are in
receipt of this letter, we will place it on our agenda for the
board to take necessary action. (we expect the letter within
the next week) .
If and when there are any changes on the resolution dated
June 15, they will be sent to your office immediately.

13. The deed shall be the usual Bargain and Sale with covenants against theGraniDr' Acts
deed in proper statutory short form for record and shall be duly executed and acknowledged 50 as to convey to the purcha~er
the fee simple of the said premises, free of all encumbrances, except as herein stated, and shall contain the covenant required by
subdivision 5 of Section 13 of the Lien Law.
If the seller is a corporation, it will deliver to the purchaser at the time of the delivery of the deed hereunder a resolution of
its Board of Directors authorizing the sale and delivery of the deed, and a certificate by the Secretary or Assistant Secretary
of the corporation certifying such resolution and setting forth facts showing that the conveyance is in conformity with the
requirements of Section 909 of the Business Corporation Law. The deed in such case shall contain a recital sufficient to
establish compliance with said section,
14. At the closing of the title the seller shall deliver to the purchaser a certified check to the order of the recording officer of
the county in which the deed is to be recorded for the amount of the documentary stamps to be affixed thereto in accordance
with Article 31 of the Tax Law, and a certified check to the order of the appropriate county officer for any other tax payable
by reason of the delivery of the deed, and a return, if any be required, duly signed and sworn to by the seller; and the
purchaser also agrees to sign and swear to the return and to cause the check and the return to be delivered to the appro-
priate county officer promptly after the closing of title.
15. In addition, the seller shall at the same time deliver to the purchaser a certified check to the order of the Finance Admin~
, istrator for the amount of the Real Property Transfer Tax imposed by Title II of Chapter 46 of the Administrative Code of
I the City of New York and will also deliver to the purchaser the return required by the said statute and the regulations issued
pursuant to the authority thereof, duly signed and sworn to by the seller; the purchaser agrees to sign and swear to the
return and to cause the check and the return to be delivered to the City Register promptly after the closing of the title.

without limiting the generality of the foregoing, such fixtures and articles of personal property include plumbing, heating,

and kitchen cabinets, mantels, door mirrors, venetian blinds, shades, screens, awnings, storm windows, window boxes, storm

on the premises. .
19. The amount 'of any unpaid taxes, assessments, water charges and sewer rents which the seller is obligated to pay and dis-
charge, with the interest and penalties thereon to a date not less than two business days after the date of closing title, may at the
option of the seller be allowed to the purchaser out of the balance of the purchase price, provided official bills therefor with
interest and penalties thereon figured to said date are furnished by the seller at the closing.
20. If at the date of closing there may be any other liens or encumbrances which the seller is obligated to pay and discharge,
the seller may use any portion of the balance of the purchase price to satisfy the same, provided the seller shall simultaneously
either deliver to the purchaser at the closing of title instruments in recordable form and sufficient to satisfy such liens and en~
cumbrances of record together with the cost of recording or filing said instruments; or, provided that the seller has made
arrangements with the title company employed by the purchaser in advance of closing, seller will deposit with said company
sufficient monies, acceptable to and required by it to insure obtaining and the recording of such satisfactions and the issuance
of title insurance to the purchaser either free of any such liens and encumbrances, or with insurance against enforcement of
same out of the insured premises. The purchaser, if request is made within a reasonable time prior to the date of closing of
title, agrees to provide at the closing separate certified checks as requested, aggregating the amount of the balance of the
purchase price, to facilitate the satisfaction of any such liens or encumbrances. The existence of any such taxes or other liens
and encumbrances shaH not be deemed objections to title if the seller shall comply with the foregoing requirements.
21. If a search of the title discloses judgments, bankruptcies or other returns against other persons having names the same as or
similar to that of the seller, the seBer will on request deliver to the purchaser an affidavit showing that such judgments, bank-
ruptcies or other returns are not against the seUer.
22. In the event that the seller is unable to convey title in accordance with the terms of this contract, the sole liability of the seller
wiH be to refund to the purchaser the amount paid on account of the purchase price and to pay- the net cost of examining the
title, which cost is not to exceed the charges fixed by the New York Board of Title Underwriters, and the net cost of any
survey made in connection therewith incurred by the purchaser, and upon such refund and payment being made this contract
shall be considered canceled.

3. Any bond or note and mortgage to be given hereunder shall be drawn on the standard forms of New Yark Board of Title
Underwriters for mortgages of like lien; and shall be drawn by the attorney for the seller at the expense of the purchaser,
who shall also pay the mortgage recording tax and recording fees.
4. If such purchase money mortgage is to be a subordinate mortgage on the premises it shall provide that it shall be subject
and subordinate to the lien of the existing mortgage of $ . any extensions
thereof and to any mortgage or consolidated mortgage which may be placed on the premises in lieu thereof, and to any
I extensions thereof provided (a) that the interest rate thereof shall not be greater than per cent per annum and (b)
I that, if the principal amount thereof shall exceed the amount of principal owing and unpaid on said existing mortgage at
the time of placing such new mortgage or consolidated mortgage, the excess be paid to the holder of such purchase money
mortgage in reduction of the principal thereof. Such purchase money mortgage shall also provide that such payment to the
holder thereof shall not alter or affect the regular installments, if any. of principal payable thereunder and shall further
provide that the holder thereof will, on demand and without charge therefor, execute, acknowledge and deliver any agree-
ment or agreements further to effectuate such subordination.
5. If there be a mortgage on the premises the seller agrees to deliver to the purchaser at the time of delivery of the deed a proper
certificate executed and acknowledged by the holder of such mortgage and in form for recording, certifying as to the amount
of the unpaid principal and interest thereon, date of maturity thereof and rate of interest thereon, and the seller shall pay the
fees for recording such certificate. Should the mortgagee be a bank or other institution as defined in Section 2 7 4~a, Real
Property Law, the mortgagee may. in lieu of the said certificate, furnish a letter signed by a duly authorized officer, or em~
ployee, or agent, containing the information required to be set forth in said certificate. Seller represents that such mortgage
will not be in default at or as a result of the delivery of the deed hereunder and that neither said mortgage, nor any modification
thereof contains any provision to accelerate payment, or to change any of the other terms or provisions thereof by reason of the
delivery of the deed hereunder.
6. Said premises are sold and are to be conveyed subject to:
a. Zoning regulations and ordinances of the city, town or village in which the premises lie which are not violated by
existing structures.
b. Consents by the seller or any former owner of premises for the erection of any structure or structures on, under
or above any street or streets on which said premises may abut.
c. Encroachments of stoops. areas, cellar steps, trim and cornices. if any, upon any street or highway.
7. All notes or notices of violations of law or municipal ordinances, orders or requirements noted in or issued by the Depart~
ments of Housing and Buildings, Fire, Labor, Health, or other State or Municipal Department having jurisdiction, against
or alfeeting the premises at the date hereof. shall be complied with by the seller and the premises shall be conveyed free of
the same, and this provision of this contract shall survive delivery of the deed hereunder. The seller shall furnish the purchaser
with an authorization to make the necessary searches therefor.
8. All obligations affecting the premises incurred under the Emergency Repairs provisions of the Administrative Code of
the City of New York (Sections 564-18.0. etc.) prior to the delivery of the deed shall be paid and discharged by the seller
upon the delivery of the deed. This provision shall survive the delivery of the deed.
9. If. at the time of the delivery of the deed, the premises or any part thereof shall be or shall have been affected by an assess~
ment or assessments which are or may become payable in annual installments, of which the first installment is then a charge
or lien, or has been paid, then for the purposes of this contract all the unpaid installments of any such assessment. including
those which are to become due and payable after the delivery of the deed. shall be deemed to be due and payable and
to be liens upon the premises alfeeted thereby and shall be paid and discharged by the seller, upon the delivery of the deed.

The public hearing on this matter was held on June 17, 1982 and July 8,
1982.
Upon application of VINCENT W. ANNABEL, Stillwater Avenue, Cutchogue,
NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for
approval of insufficient road frontage of one parcel proposed in a two-lot
division of property located at Stillwater Avenue, Cutchogue, NY; bounded
north by Stillwater Avenue, Kiernan, Annabel; west and south by Stillwater
Road; east by East (or Eugene's) Creek; County Tax Map Parcel No. 1000-137-
3-8.
The board made the following findings and determination:
By this appeal, appellant seeks approval of an insufficient road
frontage of one parcel at 120 feet in a proposed two-lot division of
property. The premises in question is located at Stillwater Avenue in
Cutchogue. Parcel I will contain a minimum area of 40,000 square feet,
having 110' frontage on Eugene's Creek; and Parcel II will contain an
area of approximately 55,000 square feet, having 300' frontage on
Eugene's Creek and 158.60' (and 50.27' at an angle) frontage on Still-
water Avenue. The premises are zoned "A" Residential and Agricultural.
Appellant has received permission from the N.Y.S. Department of
Environmental Conservation to subdivide this 2.2-acre parcel into two
lots under Tidal Wetlands Permit #TW l5276-0320"A" dated May 3, 1982.
Appellant has also received sketch-map approval on this proposed
subdivision from the Southold Town Planning Board June 28, 1982.
In considering this appeal, the board determines that the variance
request is not substantial in relation to the code requirements; that
the circumstances herein are unique; that by allowing the variance no
substantial detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method feasible to appellant other
than a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the relief
requested will be in harmony with and promote the general purposes of
zoning; and that the interests of justice will be served by allowing
the variance as applied for and as specified below.

Dear Mr. Annabel:
I am writing in reference to your proposed minor subdivision
on Stillwater Avenue in Cutchogue.
The Code of the Town of Southold Bulk and Parking Schedule
requires that you have 150 foot frontage at the building line and
an area of not less than 40,000 square feet. As you know, your
proposal does not meet these standards.
If you feel you cannot comply for whatever reason your
recourse is with the Zoning Board of Appeals for a variance from
the regulations.
Be advised that the building inspector will refuse a
building permit on any lot that is not legally subdivided by the
Southold Town Planning Board.
