Adjoining property owners shall be entitled to notice such public hearing but their consent to such modification shall not be required. after a brief discussion the Planning Commission concurred that this recommendation is in the best interest of the County, Be It Therefore RESOLVED, That the Suffolk County Planning Commission directs the staff to include such suitable language in all future actions where- covenants and restrictions are suggested for Commission action. . . It would appear from the minutes of your August 30, 1982 meeting with respect to this subdivision that there may be a question among various property owners in the area as to possible right-of-ways over a paper street known as "Stillwater Road". The question of who does and who does not have right-of- ways over this parcel could only be ascertained by an exhaustive title search as well as an investigation of its use over the years. It is not the function of the Planning Board to determine title and right-of-ways in land. Such juris- diction is lodged with the courts. In any event, I do not believe that the Planning Board should get involved in questions of title. Even if other persons in the area have a right-of-way over Stillwater Road it does not seem to me that this should enter into the question of whether 0r not the Planning Board should approve or disapprove the map. For the foregoing reasons, I believe that the Planning Board should proceed to consider this matter without regard to whether or not certain persons have the right to cross the southerly portion of the Annabel property. Mr. Krukowski, an adjacent property owner, questioned legal access over a por- tion of the property being subdivided not only for himself, but for eight other property owners in this area. We were advised by Mr. Tashjian who was present that Mr. Krukowski alleged at that meeting a right-of-way over the property and objected to the approval on the grounds that no right-of-way appeared on the sub-division map that was presented for approval to the Board. please be advised that it is Mr. Tashjian's position that whether or not a right-of-way exists should have no effect upon the granting of the Application for this Minor Sub-division since the sub-divided lot in question has 55,000 square feet. Further, it is Mr. Tashjian's position that Mr. Krukowski's source of title, Ravatone Realty corporation of 5 Audrey Avenue, Oyster Bay, New York, did not receive such right- of-way across Mr. Annabel's property from his grantor, Norma H. Fleet. In sup~ort of that contention we enclose herewith an abstract furn1shed by the Title Guarantee Company of the full Covenant and Warranty Deed dated July 16, 1926 liber 1202 pages 242-245 filed in the office of the clerk of the County of Suffolk which includes under parcel 5 the property of Mr. Krukowski and the others claiming a right-of-way. It is to be noted that there is no right-of-way to the water across the Annabel property which was granted directly by deed from the . DAWSON a SCHWARTZ . said Norma Fleet on October 2, 1930. The fact that Ravatone Realty may have deeded rights across my client's property without having such rights in itself cannot and does not give Mr. Krukowski or the others any rights over or across the Annabel property since Ravatone was never deeded such rights by Ms. Fleet and therefore could not grant to its grantees, which included Mr. Krukowski and the others, rights which it did not have itself. It further asks that I request relief from those offices. The Planning Board should know that I have followed this course of action and learned that it is not an avenue for redress. In fact, the S.C.P.C. defers decisions on such matters to the local munici- pality. It appears I have travelled up a blind alley. Let me share with you the enclosed copy of Resolution number 4 - dated October 13, 1982 from the Suffolk County Planning Commission which places the final decision for modifications on covenants and restrictions with the local municipality. Moreover, I have been advised by the S.C.P.C. that their role in such requests is merely advisory and subordinated to the home rule prerogative. All this indicates that the disposition of my request rests solely and squarely with the Southold Planning Board. In the hope that I have correctly identified the place of respon- sibility, I would appreciate the Board's consideration of an amended set-back request from my original 50' distance to 75 feet. As you deliberate I strongly urge that you weigh these arguments: 1. First, I would like to quote from a letter to the Board from the Suffolk County Planning Commission dated August 5, 1982 that offers the following statement for the conditions imposed on the sub- division..." to help preserve the natural and aesthetic attributes of the shoreline of Eugene's Creek". Since my two parcels represent the last two building lots on Eugene's Creek, one can conclude that the character and appearance of the shore- line has long since been established by the clutter . . . Mr. Henry Raynor Jr. Chairman August 29, 1983 Page 2 of dozens of homes, all situated on smaller lots, with lesser frontages and much closer proximity to the waterfront. I ask that you ponder how a set-back difference from 100 feet to 75 feet could have even the slighest aesthetic effect on but a small fraction of shoreline that is dominated by an eclectic variety of structures. It almost appears that I alone am being asked to atone for all the sins of the past. 2. The average set-back of waterfront structures, up to 500 feet on either side of my parcels average about 30 feet. It would appear inconsistent and unfair to require more than 3 times the set-back on my property. I'm simply asking for slightly less than that multiple, 2~ times the average set-back. 3. The 75 foot set-back distance is consistent with that established by yet another jurisdiction - the Department of Environmental Conservation. Since this state body is, in fact, concerned with the preservation of tidal wetlands, it would appear logical for the Board to follow D.E.C. guidelines on environmental regulations. 4. Needless to say I am aggrieved by the 100 feet set- back requirement which deprives me of full use and enjoyment of property I paid dearly for. That if future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood f1'ows.or endanger the health, safety or welfare of the people of the State, or loss or destruction of the natural resources of the State, the owner may be ordered by the Depart. ment to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State; and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. That the State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 9. That if the display of lights and signals on any work hereby authorized is not otherwise provided for by law, such lights and signals as may be pre. scribed by the United States Coast Guard shall be installed and maintained by and at the expense of the owner. 10. If granted under Articles 24 or 25, the Department reserves the right to reconsider this approval at any time and after due notice and hearing to continue, rescind or modify this permit in such a manner as may be found to be just and equitable. If upon the expiration or revocation of this permit, the modification of the wetland hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. If at the date of closing there may be any other liens or encumbrances which the seller is obligated to pay and discharge, the seller may use any portion of the balance of the purchase price to satisfy the same, provided the seller shall simultaneously either deliver to the purchaser at the closing of title instruments in recordable form and sufficient to satisfy such liens and en~ cumbrances of record together with the cost of recording or filing said instruments; or, provided that the seller has made arrangements with the title company employed by the purchaser in advance of closing, seller will deposit with said company sufficient monies, acceptable to and required by it to insure obtaining and the recording of such satisfactions and the issuance of title insurance to the purchaser either free of any such liens and encumbrances, or with insurance against enforcement of same out of the insured premises. All notes or notices of violations of law or municipal ordinances, orders or requirements noted in or issued by the Depart~ ments of Housing and Buildings, Fire, Labor, Health, or other State or Municipal Department having jurisdiction, against or alfeeting the premises at the date hereof. shall be complied with by the seller and the premises shall be conveyed free of the same, and this provision of this contract shall survive delivery of the deed hereunder. The seller shall furnish the purchaser with an authorization to make the necessary searches therefor. 8. All obligations affecting the premises incurred under the Emergency Repairs provisions of the Administrative Code of the City of New York (Sections 564-18.0. etc.) prior to the delivery of the deed shall be paid and discharged by the seller upon the delivery of the deed. This provision shall survive the delivery of the deed. 9. If. at the time of the delivery of the deed, the premises or any part thereof shall be or shall have been affected by an assess~ ment or assessments which are or may become payable in annual installments, of which the first installment is then a charge or lien, or has been paid, then for the purposes of this contract all the unpaid installments of any such assessment. including those which are to become due and payable after the delivery of the deed. shall be deemed to be due and payable and to be liens upon the premises alfeeted thereby and shall be paid and discharged by the seller, upon the delivery of the deed. 10. Parcel I will contain a minimum area of 40,000 square feet, having 110' frontage on Eugene's Creek; and Parcel II will contain an area of approximately 55,000 square feet, having 300' frontage on Eugene's Creek and 158.60' (and 50.27' at an angle) frontage on Still- water Avenue. The premises are zoned "A" Residential and Agricultural. Appellant has received permission from the N.Y.S. Department of Environmental Conservation to subdivide this 2.2-acre parcel into two lots under Tidal Wetlands Permit #TW l5276-0320"A" dated May 3, 1982. Appellant has also received sketch-map approval on this proposed subdivision from the Southold Town Planning Board June 28, 1982.
