We are in receipt of your August 22, 1983 letter with
enclosures concerning the above matter.
The variance application pending before this board is
for area and lot width as shown on the 4/16/82 survey in our
file. Since the applicants will be amending their original
plan, the amendment should be re-filed with the Building
Inspector in order to determine whether or not a setback
variance will be needed. On August 9, 1983 the Town Board
adopted Local Law No.9 "...in Relation to Area and Yard
Regulations...." One of the amendments includes a minimum
35-foot front yard setback for lots under 40,000 square feet
in area (depicted as "A" on the attached schedule).
We are forwarding a copy of this letter to the applicants'
attorney and request that three copies of the amended and .
approved survey/plan be filed with our office in order that
the board may review same for further processing.
Also enclosed are a yellow form and cardboard Notice
(95-20-1) which appears to have been enclosed with your
letter in error.

Dear Mr. Scheinberg:
The following action was taken by the Southold Town Planning Board,
Monday, March 7, 1983.
RESOLVED that whereas, a formal application for the atProval of a
subdivision plat entitled Marion Sadick and Murrav Sc lussel located
at Cutchogue was submitted to the Planning Board on October 4, 1982
and, a filing fee in the amount of $50 was paid on December 7, 1982,
and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, SouthOld, New York on February 7, 1983 at
7 : 3 0 p. m., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Marion Sadick
and Murrav Schlussel for approval of said subdivision plat prepared
by Roderick Van Tuyl, P.C. dated September B, 1981 and amended Nov-
ember 10, 1982, be approved and the Chairman be authorized to endors~
approval on said subdivision plat subject to approval by the Zoning

The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency. Applicant should be aware
that a permit may be required because of the proximity
to the wetlands.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency deSignation.
The installation of subsurface sewage disposal systems will
require the removal of any impervious materials and the re-
placement with clean sand and gravel. Information on private
wells in the area indicate a sufficient quanity of potable water.
Prior to occupancy of the proposed houses, a complete water
analyses will be required.

A regular meeting of the Southold Town Planning Board was held at
7:30 p.m. Monday, February 7, 1983 at the Town Hall, Main Road,
Southold, New York. Present were:

7:30 p.m. Public Hearing on the question of the approval of the
minor subdivision of Marion Sadick & Murray Schlussel, located at
Cutchogue.
On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board dispense with the
reading of the metes and bounds on the property of the minor subdiv-
ision of Marion Sadick & Murray Schlussel.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Mr. Raynor: We should make notice that there is a incorrect state-
ment :Ln the legal notice in this particular proposed subdivision and
that is the fact that the area contains .50 acres which in fact is
not the case. The area contains one and three quarters. The original
transcript that came down from. . . to this office was in error. We
have a copy of the proof of publicatjon from the Suffolk Times which
ran one week commencing on the 27th day of January 1983. (proof of
publication was from the Long Island Traveler-Watchman as the Suffolk
Times affidavit had not been received) signed by Pat Wood and noterized
by C1E,ment Thompson_ And on review of the file from the SuffOlk County'
Plannj.nq Commission: T'he Suffolk County Planning Commission at its
regular meeting on February 2, 1983, reviewed the proPQseq sUbdivision
plat entitled, "Minor Subdivision~Marion Sadick and Murray schfussel",
referred to it pursuant to Section .1333 of the Suffolk County 'Charter.

After due study and deliberation it resolved to approve said map
subj'~ct to the fOllowing four conditions deemed necessary to help
preserve the natural and aesthetic attributes of the shoreline of
Eugene's Creek:
1. No lot shall be subdivided or its lot lines changed in any
manner at any future date unless authorized by the Town of
Southold Planning Board.
2. No stormwater runoff resulting from the development of the
subdivision or any of the lots shall be discharged directly
into the adjacent body of water.
3. No sanitary disposal facility shall be installed or con-
structed within 100 feet of the upland edge of the tidal
wetlands along the shoreline of the dredge canal.
4. Conditions 1-3, inclusive, shall be filed as covenants and
restirctions in the office of the County Clerk on or prior
to the granting of approval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority
plus one of the Town Board of the Town of Southold after a public
hearing. Adjoining property owners shall be entitled to notice of
such public hearing but their consent to such modification shall not
be required. The Commission also offers the following comment on the
map for your use and consideration: It is suggested that the approval
of thi.s subdivision be made subject to the subdivision's meeting the
requirement s and standards of the Suffolk County Department of Health

Shepard Scheinberg, Esq.: I would just like to say that the application
sets forth all of the background as to the particular subdivision. As
to the Health Department, we already had obtained Health Department
approval for this particular subdivision. I believe a copy of the
survey with their approval has been included.
Mr. Raynor: Yes, we have that. The Board of Appeals should have a
copy of it.
Mr. Scheinberg: I think we had sent along a copy to them as well. So
I would ask the approval of this Board.
Mr. Raynor: Okay, Thank you counsel. Is there anyone else present
this evening who would like to speak in favor of this proposed minor
subdivision? (Negative) Hearing none, is there anyone present this
evening that may be neither pro nor con but should have some information
with regard to this minor subdivision that should come before this

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on February 2,
1983, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Marion Sadick and Murray Schlussel", referred to it pursuant to Section 1333 of
the Suffolk County Charter. After due study and deliberation it resolved to
approve said map subject to the following four conditions deemed necessary to
help preserve the natural and aesthetic attributes of the shoreline of Eugene's
Creek:
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Town of Southold Planning
Board.
2. No stormwater runoff resulting from the development of the subdivision
or any of the lots shall be discharged directly into the adjacent body
of water.
3. No sanitary disposal facility shall be installed or constructed within
100 feet of the upland edge of the tidal wetlands along the shoreline
of the dredged canal.
4. Conditions 1-3, inclusive, shall be filed as covenants and restrictions
in the office of the County Clerk on or prior to the granting of ap-
proval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority plus
one of the Town Board of the Town of Southold after a public hearing.
Adjoining property owners shall be entitled to notice of such public
hearing but their consent to such modification shall not be required.

the above referenced subdivision.
This Department is in agreement with your designation of lead agency.
The installation of subsurface sewage disposal systems will require
the removal of any impervious materials and the replacement with clean
sand and gravel. Information on private wells in the area indicate a suf-
ficient quantity of potable water. However, prior to occupancy of the pro-
posed houses, a complete water analyses will be required.

Dear Mr. Raynor:
Recelpt is acknowledged of your letter dated December 6, 1982
rE.lative to the above-entitled matter, granting approval of
the sketch map of the minor subdivision referenced above, sub-
ject to receipt of approval of an area variance from the
Zoning Board of Appeals. I have had new maps made which set
forth the following information:
1. The legal lot line as determined by George Flsher in
our meetlng with him of October 19, 1982. You will note that
it is Mr. Fisher's determination that at this point in time,
the overall property has heretofore been divided into two
lots, one with a 70' frontage comprising the lot containinq
22,000 square feet and representing the most easterly portion
of the property and the other legal lot comprising the balance
of the property lying to the west incorporatinq the two par-
cels, having 20,000 square feet and 20,500 square feet.
2. The three lots are described under deeds placing owner-
Shlp of the most easterly lot in Murray SChlussel, the center
lot In Richard L. Sadick (now Marion Sadick) and Murray
Schlussel and the most easterly lot in the name of Richard L.
Sadick.
3. The proposed subdivision of the property into two lots,

had requested of Hr. Van Tuyl to send us an additional 24

Department of Environmental Conservation. I have been advised
that Mr. Van Tuyl no longer is in business and have been un-

An initial determination of nonsignificance has been made.
It was the concensus of the Board to make an on site field inspection

Gentlemen:
Attached hereto is the application of Sadick and
Schlussel for a minor subdivision covering a parcel
of land located on the north side of Stillwater Ave-
nue, Cutchogue, Town of Southold, New York.
On July 27, 1972, Richard L. Sadick and Murray Schlussel
purchased three lots on the north side of Stillwater
Avenue in Cutchogue, New York. Enclosed herewith please
find photocopies of map of property surveyed for Richard
L. Sadick and Murray Schlussel, said survey dated June
9, 1972 and showing three lots. The most westerly situ-
ate lot was taken in the name of Murray Schlussel. The
center lot was taken in the name of Richard L. Sadick
and Murray Schlussel and the most easterly lot was taken
in the name of Richard L. Sadick.
Each of the lots was a legal building lot by reason of
the decision of the Zoning Board of Appeals under appeal
number 1174 dated March 29, 1968, a copy of which is at-
tached hereto.
Messrs Sadick and Schlussel had made application to New
York State Department of Environmental Conservation for
approval to fill to bring to grade and for the construc-
tion of three houses on the subject properties. Said
permission was granted on November 6, 1974, with the pro-
viso that no construction or fill be within fifty feet
of the line of the mean high water mark. A copy of said
approval is attached hereto.

Messrs. Sadick and Schlussel then applied to the Suffolk
County Department of Health for Health Department permits
to construct the three houses. The Suffolk County Health
Department, however, denied their application by reason
of the fact that the Health Department would not approve
the construction of the houses by reason of the fact that
cesspools and wells could not be placed on the three lots
which would maintain a one-hundred foot distance between
cesspools and wells as well as maintain a one-hundred foot
setback of the cesspools from the dredged canal.
In the year 1978, Richard L. Sadick died and his Will was
probated naming his wife, Marion W. Sadick as his Executrix
as well as the owner of his interest in the subject real
property.
By reason of the disapproval by the Health Department of the
application to construct three houses on the property,
Marion W. Sadick and Murray Schlussel submitted to the
Suffolk County Health Department an application to construct
only two houses on the area comprising the three lots.
Approval was granted on June 18, 1982 for the construction
of two houses on the area comprising of the three lots, pro-
vided that two lots be created out of the three lots. At-
tached hereto is a copy of the survey of the subject proper-
ty showing the approval by the Suffolk County Health Depart-
ment.
The within application to your Board seeks permission to
subdivide the center lot owned by Sadick and Schlussel into
two segments wherein the westerly portion of the center lot
would be merged with the westerly lot owned by Schlussel
and the easterly portion of the center lot would be merged
with the easterly lot owned by Sadick so as to create two
lots out of the three lots.
Neither Marion W. Sadick, Murray Schlussel, nor the under-
signed, nor any of their immediate families are members of
any governmental agency, whether Town, County or State,
which would have jurisdiction over the within application.

Gentlemen:
Your petition for a Tidal Wetlands Moratorium Permit has
been reviewecby this office. As a result, we have determined
that filling to bring to grade and construction of 3 houses,
on 3 areas, 43 x 30 and 3 areas, 20 x 20, southerly 60' of ~
lots and northerly 50' of 3 lots, on Eugene's Creek, cutchogue,
Town of Southold, Suffolk County, New York
will have no adverse effect upon adjacent tidal wetlands. No
construction or fill within 50' of line of MEW.
Therefore, pursuant to Section 25-0202 of the Environmental
Conservation Law and 6 NYCRR, Part 660.3 (c), you are hereby
notified that no permit will be necessary.
A copy of this determination must be availabLe at the job
site at all times during construction activity.

Health Dept. on these lots I see no reason why they cannot be filled
in to the edge of the swampy land along the canal and a one family
home built on each as they were aDproved by the Appeals Board in
action # 1174.

In answer to your letter of July 11, 1972,
the Planning Board has this under advisement., "-r'
but there seems to be some additional problems.
On May 16, 1967, this Board send to Mr. Petrucci
a letter stating that the Planning Board approved
this canal subject to four conditions. Some of
these conditions have never actually been met. In
addition, we find that Mr..Petrucci in one way or
another disposed of the rights of way on each side
of his subdivision thereby reducing the total width.
of his subdivision by 80 feet. I am sure you can
understand that under these circumstances there are
a few more questions we want answers to as regard
these rights of way. As far as we are concerned
it would seem that the subdivision map submitted
by Mr. Petrucci is in fact invalid.
We would suggest that you came to the next
Planning Board meeting on October 3, 1972, at 7:30 p.m.,
at the Town Office, Main Road, Southold, N.Y., as
their representative and discuss the complete situation.
