REF: Minor Subdivision of Sadick and Schlussel
Pursuant to your request, I reviewed this file. It
appears that the three lots were reduced to a two lot subdivision
when presented to the Planning Board due to a denial by the
Suffolk County Health Department for three lots. The Planning
Board approved two lots subject to ZBA approval. You have
advised that the application for ZBA approval was withdrawn by
the applicant in 1983 .
Also noted in file is a permit from the DEC for
construction of three single family dwellings, dated 2/29/88.
Did the applicant submit the original three lots to DEC? Has the
Suffolk County Health Department changed their position?
In any event, vacant lot C.O. ' s should not have been
issued for either the two lot subdivision, since that has not
been completed, nor for the three original lots.

at Town Harbor Terrace , ;Southold. The contract was
immediately let to Irving Latham or Orient who started
the work . The roads have been roughed out in that they
have been cleared, however, the inclemency of the weather
has been such that it has not been possible for Mr. Latham
to complete his phase of the work. For that reason it
is necessary at this time , since the contract has been let,
the work started and the money available, to ask for an
` extension to complete the same .

Dear Richard:
Enclosed is the material which you gave me to review
and a copy of two pages of the new regulationa that will
go into effect shortly regarding tidal wetlands in New York
State.
As you can see, Section 661.22 indicates that if the
Environmental Conservation Department of the State issued
a final decision prior to the effective date of these new
regulations then that decision will stand. In your case
you had a favorable decision in 1974 authorizing you to
build three houses and I am of the opi.nion, as are our
• attorneys, that it is still valid and cannot be changed
under the new regulati.ons.
If I can be of any other help, please do not hesitate

that the dredged qanal shown on the survey was constructed in
compliance with the requirements set forth in your letter add-
ressed to Angelo Fetrucci under date of May 16, 1967.
For qour further information, I enclose a zerox copy of the
face page of the Contract indicating that there was three parcels
of land conveyed to Sadick and Schlussel which did not include
any conveyance of Reserved Plot "A". If this is not sufficient
evidence for you or Eor your meeting of October 3rd, I would be
very pleased to cmme to your next meeting providing it doesnot

In anawer to your letter of July 11, 1972,
the Planninq Board has this undes advisement,
but there seems to be �ome addit�onnl problems.
On May 16, 1967, this Board aend to Mr. Petrucei
a letter etating that the Planning Board approved
thia oanal aub�ect to four conditions. Some of
these conditiohs have never actually bcen met. In
addition, we find that Mr. ,Petrucai in one wny or
another diaposed oE the rights of way on each side
of hia subdivision thereby reducing the tc�ll width -
of his subdivi8ion by 80 feet. I am sure you can
understand that under theee circumatancea there are
a few more qu�stions we want anawere to as regard
theae rights oP way. As far as we are conceraed
it would seem that the subdiviaion map submitted
by Mr. Petrucci ia in fact lnvalid.
We would e�ugqest t:hst you came to the next
Planning Board meetinq on October 3, 1972, at 7 :30 p.m. ,
