THIS INDENTURE made this :z4J#ctay of February, 1982, by
WILLIAM LAKOWITZ, residing at (No #) pequash Avenue, Cutchogue, New
York, and JON C. KERBS, residing at 510 Main Street, Greenport, New
York, hereinafter called the Declarant.
WHEREAS, the Declarant is the owner in fee simple of a
certain parcel of land situate at Cutchogue, Town of Southold, Suffolk
County, New York, and designated on the Suffolk County Tax Map as
District 1000, Section 137, Block 02, and Lots 008, 018, and 019,
containing approximately 73,621 square feet, being the same premises
acquired by the Declarant by deed dated December 17, 1981, and
recorded ~n the Suffolk County Clerk's Offece on December 22, 1981,

sources of the Town of Southold, and

the Town of Southold for approval of the subdivision and development
of the premises as a Minor Subdivision, to contain not more than four

aforesaid premises and every portion thereof is hereby held' and shall

hereinafter set forth, and that every purchaser of said premises, or
any portion thereof, by the acceptance of a deed thereto, covenants
and agrees that the premises so purchased shall be held subject to
the covenants, conditionS, and restrictions hereinafter set forth.

1. No lot or plot as shown and designated on the Minor
Subdivision map approved by and filed with the Southold Town Planning
Board shall be further subdivided.
2. That all of the covenants, conditions and restrictions
contained herein shall be construed as real covenants running with
the land and shall continue and remain in full force and effect at

March 8, 1982
Pursuant to Article 8 of the Environmental Conservation Law
state Envrionmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Jon C. Kerbs/William Lakowitz is a
four lot minor located at Cutchogue.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Based upon the water supply and sewage disposal information
obtained from existing houses in the area and the fact that
the four houses are already existing, this Department has
no objection to the proposed subdivision plan.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Dear Mr. McKeever:
As per our telephone conversation last week, I enclose a portion
of the minutes that were taken at a Public Hearing held on the
question of approval of the minor subdivision of Jon C. Kerbs/William
Lakowitz.
I have underlined a portion in red ink which refers to the Planning
Boards resolution on the movement or demolition of the existing struc-
ture on lot number two. Our filed maps also designate movement of

Mr. Mullen: I do not believe there have been several meetings on
this. . on this situation. Maybe you're talking between the Zoning
Board and us.
Mr. Kerbs: No, as a matter of fact, I got a list of them right here
and I've got the papers. If you would. . if you would like me to
show them to you . . because I made a Ii . . I sat down today and I
said to myself, gee, it's been a long time, I'd like to make a point
that it's been a long time. So what I did is made a list of them.
I've got the correspondence from the meetings. If you would like to
see it, I do have it. It has been several meetings that this proposal
has been before you, plus the time that the field inspection was made,
so if you would like to see it, I have it.
Mr. Raynor: Do you have any other comments?
Mr. Kerbs: No, I don't.
Mr. Raynor: O.K., does the board members have any other comments?
Mr. Mullen: ~nother words, what I understand you to say: if this
~~ructure on lot number two, that rear structure, if you're unable to

Mr. Kerbs: I believe we can do that, I believe that's legal. If it's
not, tell me, that's what we plan on doing. Yes, we feel it's better
if we have a rental. We've gotta use it, we just can't tear it down.
It would be about $10,000 probably out of our pocket just to tear that
thing down.- So if we can't, if we can't make use of that other lot,
we would just keep it right there.
Mr. Orlowski: Do you feel you could move the house though?
Mr. Kerbs: I am not sure. You know it is going to be venturous. I
think we can, but, I don't see that as a point, as I say, if we can't,
we will leave it there so to the standpoint of the Board of Appeals,
I feel the right thing to do is to have everybody. . . is to say,
you know there's ZQur lot, you got four houses, you've got four lots.
That's what the Board of Appeals felt, the health department felt.
four houses, four lots, and we will make the best of the situation we
can of it. I've done other things similar to this before and I do a
good job, if I can afford to.
Mr. Latham: Will you move it yourself or have a house mover?
Mr. Kerbs: We'll have a house mover. It might have to be taken down
in parts and moved or something like that, but the point is we would
like to get that fourth lot and I think that we should because the
four houses there and the alternative is is to have that house. It's
not even sitting on the lot properly, so. . as I say, the alternative
is to use it that way. It certainly is not going to be an advantage
to anybody.

Enclosed please find a subdivision referral of Jon C. Kerbs/William
Lakowitz, located at Cutchogue. The initial submission of this proposal
was submitted September 28, 1981. This subdivision has already received
approval from the Suffolk County Department of Health, (see enclosed)
and a variance from the Southold Town Board of Appeals (also enclosed) .
Because this board was not in agreement of such actions, we scheduled
a meeting with the Town Attorney to discuss this matter. He referred
to his letter, dated November 12, 1981, stating: once a variance has
been granted, the lots in question are then conforming. He also stated
the proposed lots were conforming with the surrounding lots in the area.
After due deliberation, this board has taken actions to proceed with the
subdivision procedures. If we can supply additional information that
might assist you with this referral, please contact us. I am not certain
whether this is within your jurisdiction.

Enclosed herewith is a copy of Cohalan v. Schermerhorn 77 Misc 2d 23;
which was a case in Islip dealing with the questions of undersized lots
being proposed in a subdivision. The court dealt with the questions of
which board should take jurisdiction first and also the consequences of
variances being granted to reduce the size of lots.
You will note on page 28 of the decision that Judge Lazer notes that once
a variance has been granted, the lots in question are then conforming
when they appear on a subdivision map.

1. A corporation purchased a lot which has 396 feet of frontage on the
atreet by 110 feet in depth - that is, 43,560 square feet or exactly one acre.
This one-acre lot is shown on an old llled map. 1t is part of a large area
which is zoned as follows: one-family dwellings only, on lots having at least
11,250 square feet of area and having at least 75 feet of street frontage. The
75 front-foot restriction would amply allow the corporation to build five one-
family dwelJings; hut the 11,250 square foot restriction would limit the cor-
poration to only three one-family dwellings, even though each such dwelling
would have 132 feet of street frontage. The town's Zoning Board of Appeals
granted the corporation a variance allowing the corporation to build five one-
family dwellings, provided that the corporation first obtained the approval'
of the town's Planning Board. This comparatively minor area variance did
not usurp the legislative zoning power of the Town Board, nor did it usurp the
Planning Board's original jurisdiction to approve or disapprove proposed sub-
division plats (ef. Town Law, U 277, 280-a).
2. However, the Zoning Board of Appeals' conclusion, that the corporation
would otherwise suffer significant economic injury, is based on unacceptably
conclusory findings of fact, founded perhaps on facts known to members of
that board, but not stated in the llndings. Accordingly, in this CPLR arlicle
78 proceeding instituted hy the Town Board to annul the variance granted by
the ZQning Board of Appeals, Special Term remands the matter to the Zoning
Board of Appeals to take proof of any economic injury to the corporation and
to make findings of fact which can be intelligently reviewed by a court.

trative determination the board's action did not constitute an
appropriation of the town's legislative function.
THE VARIANCES DO NOT CONSTITUTE AN UNAUTHORIZED
SUBDIVISION OF LAND.
Although the variances ..were gra!\t~dJlllbject _to.. Planning
Board approval, .!h.~ town relies on Van Deusen v. Jackson
. (supra), to support ftstlleory that the jurisdiction of the plan-
ning agency was illegally infringed by variances based upon
subdivision into five lots.
In Van Deusen, a 7.365 acre parcel which lay in a 15,000-
square foot district had originally been subdivided. The land
was subsequently rezoned into a 40,000-square foot district and
the owner then obtained from the board of appeals approval
of a map showing nine 25,000-square-foot lots. Characterizing
the object of the variance as the" sanction of the development
of his land as a subdivision at odds with the ordinance," the
conrt found that " the other factors in the case, coupled with
size, lead to the conclusion that the variance . . . overran
the powers of the respondents." (p. 61; emphasis supplied).
In Van Deusen the owner sought to by-pass the Planning Board.
Here the boar.dhas l1ipedfically conditioned its .grant on approval
J,ly.the Planning Board. There size was a determinative factor.
Here the parcel is small.
That the instant owners must obtain approval from the pJjl.n-
ning_~oard_"to subdiVide into"flvelolSis beyond"dispute (see
Incorporated Vii. of Nissequogue v. Meixsell, 55 Mise 2d 1069,
affd. 32A D 2dl029; Ashmill Homes v. Town of Islip, N. Y. L. J.,
Dec. 4, 1969, p.1S, col. 2). The.real issue is, which of the t.wo
administrative agencies has priority of jurisdiction. The board
has approved the applications subject to Planning Board
approval, but the town urges that plat approval was a prerequi-
site to the variances. Rathkopf supports this view, reasoning
that lot variances of restrictions relating to nonexistent lots and
lot lines mandate that " the proper procedural order in New
York is first to secure approval of the subdivision and then to
apply for such variances as may be necessary" (3 Rathkopf,
supra, ~ 71-49). The New Jersey .supreme Court reached a
similar conclusion, suggesting that upon an application to the
planning board conditional on subsequent approval of a vari-
ance, the " planning board may, with ,its approval express its
nonbinding opinion as to whether the variance would be con-
ducive to or detrimental to the planning sllheme because of the

, Had a subdivision ;plat which contained the five nonconforming
lots first been filed with the Planning Board that agency would
have been obligated to conduct a public hearing to consider it
(see Matter of Northern Operating Corp. v. Chamberlain, 34
A D 2d 686, affd. 31 N Y 2d 704). The town cites Matter of
Weinstein v. Planning Bd. of ViI. of Great Neck (28 .A D 2d
862, affd.21 NY ,2d 1001), for the proposition that a planning
board is without power to approve a map which violates the
zoning ordinance. Matter of Northern Operating Corp. (supra)
establishes the doctrine that the failure of a planning ,board
to conduot a public hearing mandates issuance of a certificate
of approval after 45 days even if the plat is nonconforming.
Nevertheless, it is clear from the ,opinion of the ,Court of Appeals
that such certificate of approval does not relieve an applicant
from compliance with local law. A planning board cannot con-
sider..economic hardshipjn~pproving a'S'ubdivisionmap (Matter
of Diamond v. Specter, 39 A If2ir942;~atter of McEnroe v.
Planning Bd. of Town of Clinton, 61 Misc 2d 937) and neither
the approval nor the filing of a noncomplying map can change
the zon.ing or create an estoppel that will work such change
(Shapiro .v. Town of Oyster Bay, 27 Misc 2d 844, affd. 20 A D
2d 850). Whether Matter of Northern Operating Corp. can
be read to authorizea'piliiming board to approve a nonconrorm-
ing plat under section 277 of the Town Law is doubtful. It is
more likely that the case represents judiCiarreaction to the
use of technicalities to delay processing of subdivision plats.
Nevertheless, the practical result of such a certificate of approval
is the ming of a nonconforming subdivision map.

required, it was not a condition precedent to. an .application
for a variance under section 280-a of the Town Law.
Compliance with modern day subdivision regUlations for the
submission of a plat requires an owner to obtain professional
assistance at substantial expense and imposes upon a ~launing
board both technical and philosophical evaluation of the multiple
criteria set forth in the statute (Town Law, ~ 277 j see Fullam
v. Kronman, 31 A D 2d 947). Such study necessarily is time-
consuming and sometimes results in delay of an extensive nature.
Boards of appeals, however, move with less formality and more
dispatch. Requirements for both filing and technical assist-
ance are less formidable. The grantipE of a variance changes
the zoning requirements applicable t2 the 'pr9peitY it'll.fi'ilcts
by permitting its use in a manner forbidden by the_~ning ordi-
nance (Balodis v. FaZZwood Park Homes, 54 Misc 2d 936). Thjl
use then becomes a .conforJDing.JlDe (Industria! Lessors v. City
of Garfield, 119 N. J. Super. 181). Lots l'lhic.ll.Dl}ye been modi-

subdivision map. Consideration of such a map therefore is
nOt an exerCise in planning academics. A reversal of the order
in which the instant owner made his submissions would have
inflicted hypothetical zoning problems upon the Plauning Board
and involVlld it in a .controversy over which it had no true
jurisdiction. That jurisaiction has not beeilinfringed by the
instant application .to the Board of Appeals.
THE RESPONDENT BOARD'S CONCLUSIONS ARE INADEQUATELY
SUPPORTED IN ITS FINDmGS AND IN THE REOORD.
The reduction in lot area, and the consequent increase in
density, characterize as area variances the relief granted by the
board (McInroy v. Grunewald, 14 A D 2d 547; Matter of Satitl .
v. Board of Stds. & Appeals of City of N. Y., 28 MUsc 2d 931,
affd. 15 AD 2d 531). In order for such variances to stand the
record must establish that the restrictions of the ordinance
create a practical difficulty in the use of the property (Matter
, of ViZZage of BronxviZZe v. Francis, 1 A D 2d 236). The stand-
. ards set forth by Justice MEYER in Matter of Wachsberger v.
MichaUs (19 Misc 2d 909, affd. 18 A D 2d 921) contin!le to
prevail as a principal guide for zoning boards and conrts
alike in making area variance determinations. If, however, an
applicant can show that he suffered "significant economic
injury" as a result of the area standards of the ordinance, he
may be entitled to a variance (Matter of Fulling v. Palumbo,
21 N Y 2d 30). Thus an area variance may be predicated on

proof or what would appear to be hardship standards (see 2
Anderson, New York Zoning Law and Practice, ~ 18.40). . What-
ever the proof, however, the board is required to set forth in
its grant the findings of fact upon which the variance is based.
Such findings are necessary in order .to subject a determination
to intelligent judicial review (Gilbert v. Stevens, 284 App. Div.
1016). They may be based upon the board's own survey (Matter
;of Levy v. Board of Stds. & Appeals, 267 N. ,Y.347, supra)
or upon facts known to board members, but in either such event
the board must set forth in its return the facts known to its
members but not otherwise disclosed (People ex reI. Fordham
Manor Ref. Church v. Walsh, 244 N. Y. 280). Here the board
found that as a result of the various offsite improvements which
were to be provided, compliance with street frontage require-
ments would impose" unique additional cost" upon the owner
who would suffer" economic injury". The testimony proffered
by the owner included no evidence of a financial nature and the
. board's findings are in unacceptable conclusory language
(Matter of Ennis v. Crowley, 12 A D 2d 999). Since an inspec-
tion of the property was made before the board rendered its
grants, the court assumes the variances were granted on facts
known to its members but not reported in the decisions. There~
fore, the matters will be remanded to the respondent board
for the taking of such further proceedings as it may deem
necessary with reference to proof of economic injury and the
making of findings of fact which are susceptible to intelligent
judicial review.

Gentlemen:
As you will recall, correspondence was exchanged during the early
part of September concerning this appeal (at which time the
Planning Board was asked to review the matter and comment on
their proposal as laid out).
The Board of Appeals held a public hearing on this matter on
September 3, 1981, and the Board: (a) approved the insufficient
area and width of proposed Lots 1, 2, 3 and 4, having an area of
approximately 18,500, 18,500, 18,500 and 17,710 square feet and
width of approximately 78, 78, 78, and 75 feet, respectively; and
(b) approved the location of the house on proposed Lot 4 as shown
in Sketch No. 1 stamped 8/24/81 in which the house setbacks were
indicated as follows: approximately 40 feet from the north-
easterly line; approximately 50 feet from the northwesterly line,
and approximately 12 feet from the southwesterly property line.
The following two conditions were made part of the Board's
favorable decision: (1) that applicants obtain approval from
the Southold Town Planning Board; and (2) that Sketch No. 1
received by this Board on 8/24/81 shall be used in determining
the yard areas.
Once your Board has made a final determination on the proposed
subdivision, we request a copy to k~ep our records up-to-date.

At a regular meeting of the Southold Town Planning Board, Monday
October 19, 1981 it was the concensus of the board that you schedule
an appointment, with the secretary, to meet with the board to dis-
cuss your proposal at the November 9th meeting.
The field inspection committee noted the existing structures as be-
ing in poor condition and question the feasibility of moving the
dwelling from lot number two, to lot number four. It is their opinion
that the structures do not qualify as being habitable structures. As
a result, the board feels it would be beneficial to discuss this mat-
ter with you.

Dear Henry:
The Board of Appeals recently wrote to you asking for your
determination with respect to the appeals of .,zQ!l. C._.K~;-bs.and
William and Ann Zoldessy. You have indicated that you do not
understand what is requested of the Planning Board.
With respect to the Kerbs Appeal, this is a proposed sub-
division of a parcel of land on the north side of Fleet Neck
Road into four substandard lots. As has previously been discussed
with you, since the Planning Board must approve this subdivision
as a minor subdivision and since the Planning Board may require
the lot lines to be established in a minor different than that
proposed by Mr. Kerbs, the Board of Appeals believes that before
it entertains an application for any variance that may be
required that the Planning Board first determine how the lot
lines are to be established. If the Board of Appeals proceeds
first and grants variances for certain lot lines and then the
matter is presented to the Planning Board for minor subdivision
approval, the Planning Board may not agree with the configuration
presented to the Board of Appeals and upon which it has acted.
It would seem the better procedure for Planning Board to first
review the matter and determine whether or not they will favor-
ably consider the subdivision as laid out. Then if variances
are required the matter could then be considered by the Board of
Appeals.
With respect to the Zoldessy Appeal, this involves the

division of a parcel at the south side of Bergen Avenue, Mattituck,
into two lots. Under the provisions of Section 106-13 of the rules
and regulations of the Planning Board as amended on September 23,
1980, the definition of "subdivision" was amended to provide that
the set-off of one lot may not be considered to be a subdivision
if the matter is presented to the Planning Board and they approve
of the set-off. At the time that this new amendment was made,
it was the understanding of the Board of Appeals that whenever it
received an appeal involving the set-off of one lot that the proce-
dures set forth in Section 106-13 were to be followed and accordingly
when such appeals are received they are referred to your Board for
a determination of whether or not the set-off will be deemed a
subdivision or not be deemed a subdivision.
For the above reasons, these appeals have been submitted to
the Planning Board for consideration.
