Parts 20, 21, and 22, issued by the New York State Department of Law) . f) These requirements are necessary not only to protect the taxpayers of the Town of Southold but to prevent the county from having to acquire the property as the result of failure of the homeowners' association to pay the taxes on the "Open Space Areas and the Agricultural Preserve Area" and put these areas up for sale at an auction of tax delinquent parcels. g) Dissolution of the homeowners' association shall be prohibited without the approval of the Town Board or Planning Board. 3. Rail Road Drive shall be clearly designated as being reserved for future highway use and be offered for dedication to the Town for such use. Provision should be made to insure that this 40,287 square foot parcel will not end up as County-owned because of non-payment of taxes and shall be kept separate from the open space which would preclude its use for highway purposes. 4. Conditions 1-3, inclusive, shall be filed as covenants and restrictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board or Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. 5. The final map shall bear the following note: A Declaration of Covenants and Restrictions has been filed in the Suffolk County Clerk's office which affects lots in this subdivision. The highway specifications require a maximum time of concentration of 28 minutes for the design of drainage systems . The concentration times for this design, for the most part, exceed 28 minutes. The pipe flows should be recalculated using the code maximum of 28 minutes, since this may result in the need for larger pipe sizes and/or pipe slopes. 2. Drainage should be provided for by catch basins at the curb line, connected to leaching basins. The use of drainage swales along the road , as proposed, is not advisable. 3. The ponding area, as proposed, is eight feet deep. If this depth is maintained, a fence and screen planting should be provided. As an alternative to cutting this deep , the developer can use a combination of the following to provide the required storage volume: a. Additional leaching basins along the road. b.
