Enclosed herewith is an executed copy of a Declaration of Covenants
and Restrictions dated September 1, 1982, filed by Hilary A. Pridgen
in connection with her minor subdivision at Laurel. The ribbon copy
is being filed with the Suffolk County Clerk in accordance with your
letter of August 24, 1982.
Also enclosed are three copies of the final map for the minor sub-
division. Would you please approve the map and return two signed
copies to me.

premises acquired by the Declarant by deed of Charlotte B. A.
Finney dated October 27, 1972, and recorded in the Office of the
Clerk of the County of Suffolk on October 30, 1972, in Liber 7272
of Conveyances at Page 158 and by deed of Charlotte B. A. Finney
dated October 9, 1973 and recorded in the Office of the Clerk of
the County of Suffolk on October 9, 1973 in Liber 7505 of Convey-
ances at Page 599, and referred to herein as the "pre~ises';
and
WHEREAS, the Declarant intends to subdivide said premises
for residential purposes and desires to subject said premises to
certain conditions, covenants and restrictions in order to preserve
the maximum open space, natural scenic beauty, natural vegetation
and thereby to prevent overcrowding and to conserve the ground
~ater resources of the Town of Southold; and
WHEREAS, the Declarant has applied to the Planning Board
of the Town of Southold for approval of the subdivision and
development of the premises as a Minor Subdivision, to contain
three lots or parcels;
NOW, THEREFORE, the Declarant does hereby declare that

the aforesaid premises and every portion thereof is hereby held and
shall be conveyed subject to the conditions, covenants and restric-
tions hereinafter set forth, and that every purchaser of said
premises, or any portion thereof, by the acceptance of a deed
thereto, covenants and agrees that the premises so purchased shall
be held subject to the conditions, covenants and restrictions here-
inafter set forth:
1 . No lot or plot as shown and designated on the Minor
Subdivision map approved by and filed with the Southold Town Plan-
ning Board, a copy of which is annexed hereto and made a part here-
of, shall be further subdivided.
2. That all the conditions, covenants and restrictions
containe.d herein shall be construed as real covenants running wi th
the land and shall continue and remain in full force and effect at
all times as against the owner of the premises, or any portion
thereof, in perpetuity. Said conditions, covenants and restric-
tions shall be binding upon, inure to the benefit of and be
enforceable by the Declarant, her heirs, successors and assigns;
any owner of any portion of the aforesaid premises, their heirs,
successors and assigns; and the Town of Southold, and its succes-
sors and assigns; and the failure of any of the foregoing to
enforce any of such conditions, covenants and restrictions shall in
no event be deemed a waiver of the right to do so thereafter.
3. No new residential structure shall be constructed
within one hundred (100) feet of the shoreline of the peconic Bay.
4. No new sanitary di sposal facil i ty shall be installed
or constructed within one hundred (100) feet along the shoreline of
the peconic Bay.
5. No storm water runoff resulting from the development

of the subdivision, or any of the lots, shall be discharged into
the peconic Bay.
6. Suffolk County Control Monument No. 10-115B is
located near the westerly line of the premises. This monument
shall not be disturbed. Before construction is undertaken in the
vicinity of this monument, the Suffolk County Department of Public
Works, Division of Control Monumentation, shall be notified.
7. No lot shall be changed in any manner at any future
date unless authorized by the Southold Town Planning Board.
B. The requirements and standards of the Suffolk County
Department of Health Services for this subdivision shall be met.
Upon the sale of Lots 1 or 2 on said Subdivision Map, consideration
shall be given by the prospective purchasers to Southold Town Plan-
ning Board Inspector's Report No. 169.
9. The owner of Lot 1 as shown on said Minor Subdivision
of Hilary pridgen shall have a right-of-way for ingress and egress
to and from. the peconic Bay over the most westerly ten (10) feet of
Lots 2 and 3 as shown on said Minor Subdivison Map.
10. The owner of Lot 2 as shown on said Minor Subdi vi-
sion of Hilary pridgen shall have a right-of-way for ingress and
egress to and from the peconic Bay over the most westerly ten (10)
feet of Lot 3 as shown on said Minor Subdivison Map.
11. Owners of Lots 1 and 2 on said Minor Subdivision Map
shall have no right other than as provided in Articles 9 and 10
above to the use of the beach and waters of the peconic Bay adja-
cent to Lot 3 on said Minor Subdivision Map to the southeast.
12. Upon a sale or transfer of title to either Lots 1 or
2 of said Minor Subdivision, a twenty-five (25) foot surfaced
right-of-way for ingress, egress and public util i ties shall be

created as shown on said Minor Subdivision Map along the easterly
I ine of the subject premises over Lots 1 and 2 for the use and
benefit of Lots 1, 2 and 3.
13. No residence, no addi tions to any residence and no
accessory buildings shall be erected on any portion of the premises
known as Lots 1 and 2 on said Minor Subdivision Map without first
obtaining prior written approval of the plans and specifications by
Hilary A. Pridgen. One signed and approved copy of said plans and
specifications shall remain in the possession of Hilary A. Pridgen
and another signed and approved copy shall remain in the possession
of the building plot owner. No changes to the exterior of any such
residence shall be made without the prior written approval of
Hilary A. Pridgen.
14. No residence shall be erected on Lots 1 and 2 on
said Minor Subdivision Map without obtaining prior written approval
by Hilary A. Pridgen of the plot plan showing the proposed location
of the residence upon the building plot.
15. No structure shall be erected or permitted on Lots.
1, 2 and 3 as shown on said Minor Subdivision Map other than a
single-family, detached, residential dwelling with a minimum ground
floor area, exclusive of open porches and garages, of 1200 square
feet.
16. No house trailer or mobile home shall be erected or
. located on any portion of the subject premises.
17. No trucks, cars, boats, mobile homes, campers or
trailers shall be stored out-of-doors on the subject premises, with
the exception that no more than two regularly used automobiles may
be parked in the driveway of each residence, and with the further
exception that no more than one boat, not to exceed 18 feet in

length, may be temporarily stored in the rear of a residence.
18. Owners of Lots 1, 2 and 3 on said Minor subdivision
Map shall share equally in the cost of construction and mainte-
nance, incl uding snow plowing, of a gravel, oiled surface roadway
along the easterly line of Lots 1, 2 and 3.
The pro rata cost of
maintenance, repair and snow plowing shall constitute a lien on the
subject premises.
19. No signs other. than one displaying the owner I s name
or professional occupation shall be erected. Such signs shall not
exceed six inches in height or twenty-four inches in width.
20. In the event of the death or incapacity of Hilary A.
Pridgen, those requests for approvals to be obtained as provided
herein shall be made to the then owner of Lot 3 as shown on said
Minor Subdivision Map.

Pursuant to Article 8 of the Environmental Conservation Law
state Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board ~s lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Hilary Pridgen is a three lot sub-
division located at Laurel.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency. Applicant should be aware
that a permit may be required because of the proximity
to the wetlands.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
It has reviewed the project and finds this area has a
questionable water supply. Prior to commenting, they
would normally require a test well.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Pridgen", referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to approve said map subject to the
following nine conditions deemed necessary to help preserve the natural and aes-
thetic attributes of the shoreline of Peconic Bay:
1. No new residential structure shall be constructed within 100 feet
of the shoreline of Peconic Bay.
2. No new sanitary disposal facility shall be installed or constructed
within 100 feet along the shoreline of Peconic Bay.
3. No stormwater runoff resulting from the development of the subdivi-

This residentially developed 2.949 acre parcel has a frontage of 200 feet
on Peconic Bay. Along Peconic Bay there is a bulkhead in front of which there
is a 30 foot wide strip of beach. There are four buildings situated on the parcel;
two one story houses and two garages. The parcel is generally level and for the
most part wooded.
The applicant is dividing the parcel into three lots. Lot 1, the northern-
most lot, is vacant and has an area of 43,229 square feet. Lot 2, the center lot,
has a house and garage situated on it and has an area of 40,310 square feet. Lot
3, on Peconic Bay, also has a house and garage situated on it and has an area of
44,927 square feet.
Access to the lots will be provided by a 20 foot wide right-of-way. TIlis
right-of-way runs along the northeasterly boundary of the parcel until it reaches
one of the garages where it makes a right angle turn. A short distance beyond
this turn the right-of-Hay makes another right angle turn to pass betHeen the garage
and one of the houses. The right-of-way terminates at the northwesterly boundary
line of the southerly lot. Use of this right-of-way will be difficult because of
the tHO right bends in its alignment. The staff Honders ,,,hy the existing driveHay,
a short distance to the west, is not being utilized for access and a new access is
being created. It is the opinion of the staff that the proposed right-of-Hay should

1. ~esent access to Lot No.3 consists of a one-way looping driveway 10 ft.:
1n width that meanders through Lots No.1 and No.2. to the new house on
Lot No.3. I assume it was used for entrance and exit. It consists of hard-
packed original ground. Could see no evidence of other material in this
dri veway. However, it appears to have handled house building equipment.
If it is to be used for any future purpose, I would recommend upgrading with
the addition of 6" of bankrun with 20% gravel.
2. Proposed 25 ft. R.O.W. along easterly property line:
'!his R.O.W. would require tree removal both large and small, including
stumps throughout. 'lbpsoil would have to be removed for c driveway width
of say 15 ft. Also, some grading will be neces8ary; the ground is higher at
Peconic Bay Boulevard. After grading would recommend a 6" course of bank
run containing 20% of gravel. Could see no drainage problem along the east
property line.
3. Proposed R.O.W. along westerly property line:
'!he same existing conditions as to trees, topsoil, etc., as noted for the
easterly R.O. W. are found here. I would not recommend this R.O.W. due
to a low area in the northwest corner of Lot No. I. Fill would be re-
quired to meet Peconic Bay Boulevard and might create a drainage problem.

Dear Mr. Davis:
I am enclosing map of the property of Pridgen. The Planning
Board reviewed this map at a regular meeting held April 6, 1981.
Mr. Pridgen owns both houses on the property. Originally,
he went to the Zoning Board of Appeals requesting that he be allowed
to have two residences on one piece of property as he has no
intention of selling at the present time. The ZBA turned him down
and told him to go to the Planning Board for a minor subdivision which
he did.
When the Planning Board approved the sketch map they made it
subject to the right-of-way going along the easterly line of the
property, through the garage and 150 feet into the property to denote
the front yard. Mr. Pridgen requested that the Planning Board not
require the construction of the right-of-way until such time as he
sells anyone of the lots. The Planning Board then got involved in
the sufficiency of the present driveway.
Therefore, the Planning Board would like your recommendations
on the right-of-way construction for each of the alternatives; -
(1) the present driveway for access to lot 3, (2) on the easterly
side of the property, (3) on the westerly side of the property.

Application is requesting permission to construct second
dwelling on a single parcel containing approximately 2.95 acres,
located at the south side of Great Peconic Bay Boulevard,
Laurel, New York. This is an appeal from a Notice of Disapproval
of the Building Inspector dated May 7, 1980 which seeks a vari-
ance of Section 100-30A(l) and Section 100-32.
At the outset it should be noted that although a~plication
seeks a variance to construct a second dwelling on the premises,
the fact is that the second dwelling has already been constructed
on the premises as observed by the members of this Board when
visiting the site. The written application states that the
premises contains "enough area for a subdivision to two lots
under present zoning." This being the case, it is the deter-
mination of this Board that the appellant apply to the Planning
Board for approval of a subdivision of the premises into two
lots.
It is the further determination of this Board that this
decision be without prejudice to the applicant to reapply to
this Board for any lot width or other variance which may be
required as a result of the division of the premises into two
lots.

On motion by Mr. Tuthill, seconded by Mr. Grigonis, it
RESOLVED, that Eccles Pridgen by Horton Construction Co. as
agent, be DENIED WITHOUT PREJUDICE the variance requested in
Appeal No. 2702 dated May 15, 1980, and that applicant apply
to the Planning Board for approval of a subdivision of the
premises into two lots.
