DECLARATION OF PROTECTIVE COVENANTS made this
day of
OJ., 1968 by PETER J. WARREN and SUSAN E. W.A'R'R'R'N' , his wife,
(hereinafter referred to as "Warren"), residing at Peconic Bay
Boulevard, Laurel, Southo1d Town, Suffolk County, New York.
WHEREAS, Warren is the owner of certain lands at Laurel,
New York, described as follows:
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying
and being at Laurel, in the Town of Southold, County of
Suffolk and State of New York, bounded and described as
follows:
BEGINNING at a monument on the southeasterly side of
Great Peconic Bay Boulevard where the same is intersected
by the easterly line of land now or formerly of Regel, which
monument is about 3600 feet northeasterly from Laurel Lane
measured along said southeasterly side of Great Peconic Bay
Boulevard; running thence North 320 49' 20" East, along
the southeasterly side of Great Peconic Bay Boulevard
340.15 feet to a monument; thence South 120 32' 40" East,
along land now or formerly of Powell, 564 feet to ordinary
high water mark of Great Peconic Bay; thence along ordinary
high water mark of Great Peconic Bay a tie line course and
distance of South 350 30' 50" West, 326.13 feet; thence
North 120 29' 20" West, along land now or formerly of Regel,
543 feet to the southeasterly side of Great Peconic Bay
Boulevard, at the point or place of BEGINNING,
which said premises were conveyed by Robert B. Grady and Irma L.
Grady, his wife, by deed dated April 1, 1968, and recorded in
Suffolk County Clerk's Office on April 11,1968 in Liber6330 of
Deeds, at Page 261; and
WHEREAS, Warren proposes to subdivide said premises in accord-
ance with the survey attached hereto, made by Van Tuy1 & Son on
May 13. 1968
and in order to provide for the beneficial and
harmonious use of said premises, Warren desires to impose certain

restrictions and covenants upon said premises which shall be bind-
ing on all of the purchasers, mortgagees of individual lots, their
heirs, executors, administrators and assigns.
NOW, THEREFORE, the following coveAants and restrictions are
hereby imposed upon the premises above described:

1. That no lot shall be used except for resident1~1 purposes
and that no structure of a temporary character, including but not
limited to trailers, mobile homes, basements, tents, shacks, gar-
ages, barns or other out buildings shall be used on any lot at any
time for residential purposes of either a temporary or permanent
nature, except buildings now erected on the premises. Anyone stort
dwelling thereon shall have a ground floor area of not less than
1500 square feet, exclusive of garage and open porch areas, ex-
cept a 1-1/2 or 2 story building which shall have a ground floor
area of not less than 1000 square feet and a second story floor
area of not less than 500 square feet. All buildings shall con-
form to Colonial architecture.
2. The lots shown on said map shall be used for residential
purposes suitable for year-round occupancy. No building other thaI
one private dwelling with attached garage for the use and occupanc
of one family shall be erected on any lot.
3. Fences - Only split rail fences shall be erected on the
boundaries of said premises, except along the East and West bound-
aries of said premises, and except that there shall be picket
fences along peconic Bay Boulevard.
4. Roadways - The expense of maintaining the roadway shall
be borne equally between Lots Nos. 1 and 5, except that if access
to Lots No. 3 and 4 is permitted from said roadway then each lot
shall bear its proportionate share.
5. There shall be no unreasonable destruction of trees or
shrubbery on said premises.
6. That no lot shall be sub-divided for sale or otherwise
except as shown on the survey attached hereto.

mitted to be done thereon which shall be an annoyance or nuisance
to the neighborhood.
10. That no birds, livestock or animals 01' any kind whatso-
ever, except no more than two household pets shall be kept, housed
or permitted on ,any premises, nor shall any person breed domestic
pets for resale upon the premises.
11. These covenants are to run with the land and shall be
binding on all parties claiming under these for a period 01' fifteet
(15) years from the date these covenants are recorded. Said cov-
enants may be altered or changed by an instrument in writing signer
by the owner of Lot No. 5 and two other lot owners as shown on the
enclosed map.
12. Enforcement shall be by proceedings at law or in equity
against any person or persons violating or attempting to violate
any covenant either to restrain violation or to recover damages.
13. Invalidation of anyone of these covenants by judgment ox
court order shall in no wise affect any of the other provisions
which shall remain in full force and effect.

Re: Dr. Ralph Dickinson
Dear Henry:
We represent Dr. Dickinson who owns Lot #1 as shown on
the attached survey. I do not have a copy of the final map but
I understand that the Planning Board approved the subdivision of
the property several years ago with the right-of-way as shown on
the enclosed map.
Dr. Dickinson has applied for a building permit and
would like to change the right-of-way as I have indicated on the
map so that it would run directly into his property. The exist-
ing right-of-way would continue to the eastward bend for the
benefit of the house on lot #5. However, the existing eastward
extension of the right-of-way into lot #1 would be eliminated.
George Fisher stated that revising the right-of-way
as proposed would require the approval of the Planning Board.
Please advise as to how you would like me to proceed.

Met Mr. Norman Reilly, builder, who is in charge of the R.O.W. change. The area in-
volved is shown in the shaded portion of the sketch shown below with measurements
from Mr. Reilly. The existing entrance is one way only in the 20 ft. R.O.W. The
road section is stable, apparently is bankrun, has bluestone surface and does not
appear to have any drainage problems. The revised section .Till have the same kind
of materials. The R.O.W. beyond the revision will be taken over by another property
owner. The first 150 ft. of the road cannot be widened in the aJ ft. R.O.W. without
removing +,rees which I do not +,hink is necessary. The presen"'; road provides access for
emergency vehicles. Fire t~lcks have used it, and in my opinion, it is satisfactory for
+,he small amount of traffic that will use it.

Gentlemen:
I have been directed to inform you as follows regardirgthe
Minor Subdivision #3 of Peter Warren. As far as the Southold
Town Planning Board can determine, this is an accepted subdivision
by the Town. Therefore, any changes of the right-af-way
within the subdivision comes under the jurisdiction of the
Planning Board.
The Planning Board informed the Building Inspector in
letter of October 11, 1979, that it approved the revision of the
right-of-way. As it is within a subdivision, the Planning Board
Inspector will make recommendations as to the improvement of the
right-of-way.

Gentlemen:
You may recall that Mr. Peter Warren and I
submitted to you a few weeks ago an informal request
for a minor subdivision of the property he is pur-
chasing on Peconie Bay Boulevard, which was known
as the Levine property. At that time, we made
statements that all the lots, with the exception of
one, would have an area of over 20,000 square feet.
After the meeting Mr. Van Tuyl was asked to perfect
this subdivision, and we now find that the lots are
of less area than we first mentioned.
We enclose a sketch of the present pro-
posals and express our regrets for our initial errors
in calculations. Mr. Van Tuyl is now preparing final
prints for formal submission to you.
