Dear Mr. Bruer:
The following took place at the September 13, 1993 Planning
Board public meeting:
The final public hearing for the lot line change of Henrietta
Mormile and Arthur and Marion Mormile was closed.
WHEREAS, Henrietta Mormile and Arthur and Marion Mormile are
the owners of the property known and designated as SCTM#
1000-128-4-9, 15 & 16 located on peconic Bay Blvd.; and
WHEREAS, this lot line change, to be known as lot line change
for Henrietta Mormile and Arthur and Marion Mormile is for a
lot line change is to subtract 2,322 square feet from a 6,935
square foot parcel and add it to a 7,500 square foot parcel; and
to subtract 4,613 square feet from the same 6,935 square foot
parcel and add it to a 10,648 square foot parcel, thus creating
two parcels from three existing parcels.

WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
March 22, 1993; and
WHEREAS, a final public hearing was closed on said lot line
change application at the Town Hall, Southold, New York on
September 13, 1993; and
WHEREAS, all the requirements of the Subdivision Regulations of
the Town of Southold have been met; and be it therefore
RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the surveys dated November 9, 1992
and authorize the Chairman to endorse the final surveys Subject
to fulfillment of the following condition. This condition must
be met within six (6) months of the date of this resolution.
1. The filing of new deeds pertaining to the merger of the
2,322 square feet from the 6,935 square foot parcel SCTMi
1000-128-4-15 with the 7,500 square foot parcel SCTMi 1000-
128-4-9 and the merger of the 4,613 square foot parcel from
the 6,935 square foot parcel SCTMi 1000-128-4-15 with the
10,648 square foot parcel SCTMi 1000-128-4-16
A copy of the recorded deed must be presented to the Planning
Board prior to endorsement of the final survey.

reasonable? The reviewer is not expected to be an expert environmental analyst.

I am in the process of preparing the paperWork to satisfy the condition relative to the granting
of final approval of the subject lot line change as outlined in your letter dated September 14,
1993.
With reference to the filing of a new deed merging the 2,322 square foot parcel (plo lot 15)
with lot 9: Henrietta A. Mormile is currently in title to both of these parcels. Please advise
the undersigned if you will require a deed conveying plo lot 15 from the Estate of Henrietta A.
Mormile to the Estate of Henrietta A. Mormile. It seems to me that the title is already merged
and a deed from the estate to the estate would merely confuse matters.

ACTION OF THE BOARD OF APPEALS
Upon Application of HENRIETTA AND ARTHUR MORMILE.
Variance to the Zoning Ordinance, Article IlIA, 100-30A.3, Bulk
Schedule, for approval of nonconforming lot area of two parcels
in the pending application for re-division of land. Location of
Property: 270 Private Road *6, Laurel, NY; County Tax Map
Parcel No. 1000-128-4-9, 15, 16. Total area combined is
approximately 23,000 sq. ft.
WHEREAS, on May 7, 1993 a Notice of Disapproval was issued,
by the Building Inspector concerning an application to
re-separate and place a new division line for two parcels
improved, each with a single-family dwelling; and
WHEREAS, on June 1, 1993, an application for variances
concerning lot area and width for each of the two parcels was
filed; and
WHEREAS, after due notice, a public hearing were held by
the Board of Appeals on June 22, 1993, at which time all those
who desired to be heard were heard and their testimony recorded;
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application;
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. This is an application concerning two parcels of land,
all as shown on the November 9, 1992 survey map prepared by
peconic Surveyors, P.C. submitted with this application:
a) Parcell consists of a combined lot area of 12,113
sq. ft. - also referred to as Tax Map Nos. 9 and 15, Block 04,
which is in the name of Henrietta Mormile. This lot area was
combined inadvertently due to lack of continuous
single-and-separate ownership.

b) Parcel 2 consists of a lot area of 15,261 sq. ft. -
also referred to as County Tax Map No. 16 - which is owned by
Arthur and Marian Mormile.
2. By this variance application, appellants are requesting
permission to re-divide this 25,083 sq. ft. of land (to continue
two lots) without an increase in lot density, by establishing a
new lot line (shown as running South 15 degrees 47 minutes 50
seconds East 82.07 feet). The placement of this new lot line
will alter the combined Tax Map Lot Nos. 9 and 15 from 12,113
sq. ft. to the proposed 9,822 sq. ft., and Tax Map Lot No. 16
will increase from its present size of 10,648 sq. ft. to 15,261
square feet.
3. This property is located in the R-40 Low-Density
Residential Zone District which requires 40,000 sq. ft. of lot
area per lot (Article III, Section 100-30A.3, Bulk Schedule
applicable to the R-40 Zone District). Since the two lots are
substandard in size as exists (before this proposed change in
the lot division line), an area variance is required to reduce
the lot area of one. Information has been submitted to show
that these two lots (rather than three) were existing in single
and separate ownership prior to zoning. Each of the two lots
is improved with a single-family dwelling structure.
4. The percentage of relief sought by this application is
applicable to Parcel 1 at 18 percent for a reduction in size
from 12,113 sq. ft. to 9,822 sq. ft. -- or 2,291 sq. ft. less
than the present lot size. Since this proposal is for an
adjustment to increase Parcel 2 by the same difference, there is
no increase in density or affect on the total area of the lots
(combined total).
5. In considering this application, the Board also finds
and determines:
(a) the relief as granted is not substantial in
relation to lots established in the close vicinity of this
property;
(b) the circumstances are uniquely related to the
property and there is no method feasible for appellant to pursue
other than a variance;
(c) the relief requested will not cause a substantial
effect on available governmental facilities;
(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, or be adverse to neighboring properties

(e) the relief sought by applicant cannot be
achieved by a method other than an area variance;
(f) the proposed variance will not have an adverse
effect or impact on the physical or environmental conditions in
this neighborhood or zone district - the new location of the
division line is for record purposes and is not visible to the
lands;
(g) the difficulty is related to the uniqueness of
the property and is not self-created;
(h) the relief requested will be the minimum
necessary to afford relief.
(i) that in view of the manner in which the
difficulties arose, and in considering all the above factors,
the interests of justice will be served by granting the
variance, as conditionally noted below.
Accordingly, on motion by Member Wilton, seconded by
Member Dinizio, it was
RESOLVED, to GRANT the relief as requested under Appeal No.
4174 in the Matter of ARTHUR & HENRIETTA MORMILE, for the
re-adjustment of lot lines for two substandard parcels, shown as
Parcel 1 and Parcel 2 on the survey map prepared by Peconic
Surveyors, Inc. (dated November 9, 1992) plus amendment to show
both existing dwellings.
Vote of the Board: Ayes: Messrs. Goehringer, Dinizio,
Wilton and Villa. (Member Doyen was absent.) This resolution
was duly adopted.

The deeds for lots number nine (9) and fifteen (15) for the
above project are both in the name of Henrietta Mormile. As
both lots are undersized for this Low Density Residential R-40
District, and are owned by the same person, the lots are
considered merged by the Building Department and the Zoning
Board of Appeals.
Consequently, in order for this Board to give final
approval on this lot line change, an area variance must be
received from the Zoning Board of Appeals to further reduce the
area of the nonconforming merged lot from 14,435 square feet to
9,822 square feet. A Notice of Disapproval from the Building
Department will be needed to apply to the Board of Appeals for
the variance.

Description of Action:
This lot line change is to subtract 2,322 square feet from

parcel, and to subtract 4,613 square feet from the same 6,935

thus creating two parcels from three existing parcels in Laurel.

Reasons Supporting This Determination:
This project involves a lot line change that will result in
two lots both with existing houses being created from three
existing parcels; thus the change will not be a more
intensive use of the land.
All three lots are non-conforming in area. The applicant
has applied to the Board of Appeals for an area variance.
This change will increase the size of the two surviving
lots in this R-40 zone in keeping with zoning in this area.
The applicant will have to comply with the requirements of
the Suffolk County Sanitary Code (SCSC) and all relevant
standards of water supply and sewage disposal systems.
Design and flow specifications, subsurface soil conditions,
and site details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This
impact is not considered significant due to the anticipated
project compliance with established requirements of the
Suffolk County Sanitary Code (SCSC) and the Suffolk
County Department of Health Services (SCDHS) and the
required obtainment of the relevant permits.
An Environmental Assessment has been submitted and
reviewed. It was determined that no significant effects to
the environment were likely to occur should the project be
implemented as planned.

Richard Ward VS in his letter of February 17, 1993 is absolutely correct. Tax Map
lots 15 & 16 are owned by the same person. It is as clear as mud to me why it is required that
where you have two (2) non-complying lots (A. Mormile and H. Mormile) and a lot line
change is requested which, if granted, will result in two (2) non-complying lots of the same
composite area, that a variance is needed because one of the non-complying lots, by the laws
of physics, must be, thereafter be smaller and the other lot larger. I am merely surprised that
the fact that the one lot that is being expanded does not also need a separate variance because
its size and configuration make it more in conformity with the zoning code. It is even clearer
to me why the Planning Board does not consider this an unnecessary hardship and grant a vari-
ance from the strict compliance with the regulations under Article V of Chapter 106. It is
perfectly clear to me why a lot line change should require three or four trips to the Town Hall
or appearances before various boards and six or seven months to change two lots into two lots
with a different boundary line.
I truly appreciate your efforts in this matter. I will contact Mr. A. Mormile and let
him know of the status. I am sure he will be ecstatic.

The deeds for lots number nine (9) and fifteen (15) for the
above project are both in the name of Henrietta Mormile. As
both lots are undersized for this Low Density Residential R-40
District, and are owned by the same person, the lots are
considered merged by the Building Department and the Zoning
Board of Appeals.
Consequently, in order for this Board to give final
approval on this lot line change, an area variance must be
received from the Zoning Board of Appeals to further reduce the
area of the nonconforming merged lot from 14,435 square feet to
9,822 square feet. A Notice of Disapproval from the Building
Department will be needed to apply to the Board of Appeals for
the variance.

The Suffolk County Deparunent of Health Services (SCDHS) bas received your letter dated December 16, 1992,
concerning the above-referenced application, and bas no objection to the Town's designation as lead agency.
1his correspondence is intended primarily to expedite tbe procedural requirements of SBQRA pertaining to the
establishment of lead agency. The comments provided below are, therefore, general in nature, representing several of our
most common concerns regarding Suffolk County projects. The department wishes, however, to reserve its right to
provide more detailed information within the comment period(s) establisbed for this action.
I. Suffolk County Sanitary Code (SCSC)
1. The SCDHS maintains jurisdiction over the final location of sewage disposal and water supply systems, pursuant to
the authority and requirements of Articles 4, 5, 6 and 7 of the SCSC. Applications must comply with all relevant
density and construction standards for water supply and sewage disposal. Applicants should not undertake the
construction of, or connection to, either system without Health Deparunent approval.
2. Where applicable, the department regulates the storage, handling and discharge of restricted toxic and hazardous
materials pursuant to the requirements of Articles 7 & 12 of the SCSC.
3. If an application has not yet been submitted to the SCDHS, one should be filed at the earliest date to allow for the
technical review of the proposed action. Project designs submitted to the deparunent should be fully consistent with
any action currently nnder review through the SBQRA process.
4. Design and flow specifications, information regarding subsurface soil conditions, water supply information, and
complete design details are essential to the review of this project, and are evaluated fully at the time of application
review. Should the town require additional environmental information (such as a DBIS), discussion of the compliance
requirements of the SCDHS should be required.
5. Of particular concern to the deparunent are those areas which because of elevated groundwater conditions, or soils
which are not conducive to the proper functioning of conventional subsurface sanitary sewage disposal systems. Your
agency should be aware that such conditions frequently require the use of fill or the excavation of subsurface soils to
accommodate subsurface sanitary disposal systems constructed in conformance with the requirements of tbe SCSe.

6. The department is also significantly concerned with areas where access to potable water may be constrained by
unacceptable groundwater quality and the lack of an available public water supply. All private water supply systems
must be constructed in conformance with requirements of the sesC.
II. NATURAL RESOURCES:
1. The SCDHS fully supports all efforts to maximize protection of natural resources which may be impacted upon by
construction and development activities. It is the position of the department that the SEQRA review process provides
the greatest opportunity for comprehensive consideration of these resources, and that all practicable planning
measures should be employed to help ensure their protection.
Of particular concern to department is the adequate protection of wetlands, surface waters, natural communities,
contiguous natural habitats, and rare, threatened and endangered species. In addition, efforts to protect sensitive
physical resources such groundwaters, dunes, bluffS, shorelines, natural drainage channels, groundwater recharge
areas, and steep slopes are fully supported and encouraged by the SCDHS.
In general, the department encourages the following land use measures be considered (where appropriate) to actions
being reviewed pursuant to SEQRA.
1. Maximum practicable setbacks from all wetlands, surface waters, dunes, and bluffs.
2. Non-disturbance buffers between wetland limits and required structural setbacks.
3. Clustering of subdivision lots to provide for maximum preservation of large contiguous areas of dedicated open
space.
4. Stringent clearing limitations which can reduce potential impacts to wildlife habitats, vegetative communities, and
unconsolidated soils.
5. Maximum practicable confinement of development to areas with slopes of less than 10%.
6. Maximum use of native species for land~caping purposes.
7. Construction of recharge areas, so as to minimize the amount of disturbance and structural modification to the site.
8. Maximum use of land-banked parldng on commercial sites.
9. Minimal use of fertilizer-dependant turf and landscaping.
10. Employment of stormwater runoff control measures necessary to maintain runoff on-site.

The full EAF is designed to help applicants and agencies determine, in an -anner, whet1-;er a project
Purpose:
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.
