Board, Monday, December 3, 1984.
RESOLVED that the Southold Town Planning Board override the
Suffolk County planning Commission's resolution of disapproval
with regard to the set-off for Norman J. Murray located at

The following action was taken by the Southold Town
Planning Board, Monday, November 7, 1983.
RESOLVED that the Southold Town Planning Board approve
a set off (106-13) as indicated on the minor subdivision
map of Norman Murray, dated August 19, 1981, amended Septem-
ber 6, 1983, located at Laurel, subject to filing of coven-
ants and restrictions stating no further subdivision will
be made on any of the lots in the future and approval from
the Zoning Board of Appeals, and Planning Board consideration
of Suffolk County Planning Commission's recommendations.
Please forward six copies of the final map for our refer-
als to the County (list of requirements enclosed).

WHEREAS, the Declarant is the owner in fee simple of a certain
parcel of land situate at Laurel, Town of Southold, County of Suffolk
and State of New York, being a portion of the premises described in deed
dated Januazy 4, 1941 made by JAMES METCALFE MURRAY to NORMAN JAMES
MEl'CALFE MURRAY, recorded in the Suffolk County Clerk I s Office on
Januazy 8, 1941 in Liber 2132 at page 552, a metes and bounds
description of which is shown on Schedule A attached hereto and made a
part hereof, hereinafter referred to as the "premises".
WHEREAS, th~ Declarant intends to subdivide said premises into
two lots for residential purposes and desires to subject said premises
...to certain conditions, covenants and restrictions, said two lots being
described as (1) Lot 37 and the southerly.portion of Lot 38; and (2)
Lots 39, 40 and the northerly portion of Lot 38, on the aforesaid Map of
Laurel Park.
NCM, THEREFORE, "the Declarant does hereby declare that the
aforesaid premises and every portion thereof is hereby held and shall be

Gentlemen:
We have already met the objection of the Suffolk County
Planning Commission in that a Variance was obtained from
the Zoning Board of Appeals on November 30, 1983.
We therefore believe that this compels the overriding
of the Suffolk County Planning Commission's disapproval.
We have scheduled a closing on this matter for
Wednesday, November 28, 1984 and have asked the Building
Department to have the Certificate of Pre-existing Use
available on the 27th. The Building Department cannot
issue the Certificate without a Resolution from you in-
dicating the subdivision has been finally approved. I would
therefore request that you contact them as early as possible
on Tuesday, the 27th with your determination.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on October
10, 1984, reviewed the proposed subdivision plat entitled, '~inor Subdivision _
Norman Murray", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map
for the following reason:
The lots do not meet the minimum lot area requirement of the zoning class-
ification of the property.
The Commission also offers the following comment on the map for your use
and consideration:
It is felt that the subdivider should go to the Town of Southold and point
out the inequalities resulting from the recent blanket upgrading of the zoning
requirements. The subdivider should request that the Town of Southold correct
these inequalities by rezoning parcels rather than requiring that a subdivider
of a parcel such as his having to apply to the Zoning Board of Appeals for re-
lie f.

Upon application for NORMAN J.MURRAY, by Wickham, Wickham and
Bressler, P.C., Main Road, Mattituck, NY for a.Variance to the Zoning--
Ordinance, Article III, Section 100-31 for permission to divide Lots
37 through 40 of Laurel Park Subdivision into two separate substandard
lots located at the east. side of Oakwood Road, Laurel, NY; County Tax
Map Parcel No. 1000~127-8~8...
The board made the following findings and determination:
By this appeal, appiicant seeks permission to divide a 2.05-
acre parcel into two lots, Parcels 1 and 2 containing approximately
56,000 sq. ft. and 33,200 sq. ft. in area, and 200' and 120' road
frontage, respectively. Parcell is improved with a two~story,
one-family, framed house with porch; Parcel 2 is improved with a
one-family, one-story framed house with small porch. The premises
in question are known as Lots 37, 38, 39 and 40 of "Laurel Park"
subdivision Map #212, dated October 5, 1925 and were conveyed to
the applicant January 4, 1941.
For the record it is noted that applicant has received
approvals from the Southold Town Planning Board dated November 7,
1983 and from the N.Y.S. Department of Environmental Conservation,
Permit #10-82-0143 as amended October 13, 1983 for the two-lot
division.
In considering this appeal, the board determines: (1) that
the practical difficulties have been shown and are sufficient to
warrant the granting of the application as noted below; (2) that
the relief as noted below is not substantial in relation to the
requirements of the zoning code; (3) that the circumstances are
unique; (4) that the relief as approved will be in harmony with
and promote the general purposes of zofiing of the protection and
promotion of the public health, safety and welfare; (5) that the
interests of justice would be served by approving the application
as noted below. In allowing the relief requested, it is the
opinion of the board that no change will be made of the property

RESOLVED, that Appeal No. 3007, application for NORMAN J.
MURRAY for approval of insufficient area and/or width of two---
parcels as shown on the survey map revised September 6, 1983,
by Roderick VanTuyl, P.C., BE AND HEREBY IS APPROVED, SUBJECT
TO THE FOLLOWING CONDITIONS:
1. All new construction shall comply with sideyard set-
back requirements of the zoning code;
2. Each dwelling shall have a minimum of 850 sq. ft. of
living area, pursuant to Article III, Section 100-31, Bulk
Schedule of the Zoning Code.
Location of Property: East Side Oakwood Road, Laurel;
Lots 37 through 40, inclusive, of "Laurel Park" Subdivision
