Dea~ Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on August 7,
1985, reviewed the proposed subdivision plat entitled, Minor Subdivision - Marie
Patterson referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to disapprove said map for the
following three reasons:
This proposed subdivision creates a landlocked parcel; that is, a
parcel that does not have frontage on an existing or proposed public
road. The creation of such a lot is contrary to good planning prin-
ciples as it creates problems as far as access by emergency and ser-
vice equipment is concerned; this could result in health, safety and
welfare problems for the future residents of the landlocked lot.
Creation of a landlocked lot also places the Zoning Board of Appeals
in the awkward position of having to grant a building permit for the
lot under Section 280-a of Town Law as the future owner of the lot
cannot be held responsible for the landlocked nature of the parcel.
Creation of a subdivision with substandard lots, that is, lots whose
areas are considered less than the minimum required by the zoning
classification of the property, constitutes an overintensification of
land use in a groundwater sensitive area in what is meant to be a low
density area. Such action could establish a precedence for future
subdivisions of this kind which would essentially be a circumvention
of the Town Board's action taken over the past years to ~pzone these
groundwater sensitive areas. The Co~mission feels that the Town Plan-
ning Board should have the prerogative to review this type of applica-
tion rather than it being left to the sole discretion of ~he Zoning
Board of Appeals.

The map appears to be incomplete as there is no indication on the map
that the 5 foot path is a right-of-way to Peconic Bay for the use of
Lot 1.

The board made the following findings and determination:
This is an appeal from Article III, Section lO0-31, Bulk Schedule
of the Zoning Ordinance for approval of insufficient area (and width)
of two proposed parcels: (a) Parcel 1 proposed with an area of 23,171
sq. ft. and lot width of 85 feet [exclusive of 15' right-of-way] and
(b) Parcel 1 proposed with an area of 22,700 sq. ft. Existing on
proposed Parcel 2, the southerly parcel are a two-story, one-family
dwelling and accessory storage-garage structure which is located in
the "frontyard" area. Parcel 2 fronts along Peconic Bay approxi-
mately 101 feet and is bulkheaded. Parcel No~ 1 is vacant.
The board members have personal~y visited the site in question
and are familiar with the character Of the residential neighborhood.
Abutting the subject premises on the west are improved lots of
approximately 1'0,000 sq. ft. in area..Abutting the subject premises
on the east. are lots of approximately~15,000 sq. ft. in area.
The board members ha~e taken all testimony in behalf and in
opposition at the public hearings, Which were held on November 15,
1984 and January 10, 1985, in rendering this determination.
The board has found as follows: i(]) that this proposal '
would not be out of character of the neighborhood since there are
lots improved with one-family dwellings substantially smaller than
that proposed herein; (2) no adverse effects will be produced on
available governmental facilities of any increased population since
this is a request for one additional building lot; (3) that the
circumstances of this appeal are unique since the applicant's
