An inspection was made of the above referenced site plan on
September 20, 1994.
The Planning Board recommends that a Certificate of Occupancy
(COO.) be issued after evergreens are planted along the clearing
limits at the south side of the property.
The applicant has been informed that the lighting on the west
side of the building must be shielded so as not to shine on
eastbound traffic.

Dear Dr. Andresen:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday October 25, 1993:
WHEREAS, Charles A. Timpone is the contract vendee of the
property known and designated as Mattituck-Laurel Veterinary
Hospital, located on Franklinville Road in Laurel, SCTM9
1000-127-2-5.1; and
WHEREAS, a formal application for the approval of this site plan
was submitted on August 1, 1993; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself lead agency, and issued a Negative Declaration
on September 13, 1993; and
WHEREAS, a variance and.special exception was granted by the
Zoning Board of Appeals'on August 18, 1993; and
WHEREAS, all the requirements of the Site Plan Regulations of
the Town of Southold have been met; and now therefore

BE IT RESOLVED, that the Southold Town Planning Board grant
conditional final approval, with a one year review from date of
building permit, and authorize the Chairman to endorse the final
survey last revised on September 30, 1993, subject to

This condition must be met within six (6) months of the date of
this resolution.

Dear Sir:
It has recently come to our attention that there is the need for a fence
around the proposed Mattituck-Laurel Veterinary Hospital. This fence would
prevent animals from running on to Route 25 in Laurel. Initially, we would
like to fence the south side of the building, thereby reducing our liability
and potential for negligence in the case of a stray animal escape. In
addition, a fence is necessary around our cesspool-drainage expansion areas
to prevent any potential traffic.
The proposed fences would be of board, stand* four and one half feet in
height, and be buffered by landscape trees and bushes. I have contacted the
building department for a permit and have enclosed a site plan with the
sketch of fencing. All that is needed at this time is your approval.

A recent inspection of the above referenced project showed that
the proposed clearing limits to the south of the large animal
wing may have been partially cleared. The purpose for the
clearing limits was to screen the buildings.
The Board requests that black pines be planted in this area to
accomplish the screening.

Application of JOHN E. ANDRESEN and others as contract
vendees. This is a reqUest to amend Special Exception under
Article III, Section 10i0-31B(10) to include new large-animal
wing (animal hospital) Rnd other revisions as shown on the site
plan map amended September 30, 1993. The original Special
Exception plan providedI for a one-story, 3,584 sq. ft. building
for veterinary office and uses related to the veterinary
clinic. The new plan shows a total floor area of 4,598 sq. ft.
at one-story height. Location of Property: 1625 Main Road and
Franklinville Road West, Laurel, NY; District 1000, Section
127, Block 2, Lot 5.1. The area of this parcel is nonconforming
at 59,984 sq. ft. in this R-80 Residential Zone District.
WHEREAS, after due notice, a public hearing was held on
November 8, 1993, and all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. By this application, applicants are proposing to amend
the Special Exception establishing a new veterinarian office and
animal hospital at vacant premises (presently owned by Thomas N.
Anshutz, Jr.) and more particularly referred to as 1625 Main
Road, Laurel, New York? identified on the Suffolk County Tax
Maps as District 1000, Section 127, Block 2, Lot 5.1. The
applicants are contractl vendees under an executed contract of
sale dated June 9, 1993~ between John Andresen, Maribeth
Andresen, Charles Timpone, Debra Timpone, and the current owner,
Thomas N. Anshutz, Jr. (which contract was confirmed to be
extended to the pre~ent time period).

2. Article III, Section 100-31B(10) authorizes by approval
of 'the Board of Appeals, (and subject to site plan approval by
the Planning Board):
... a veterinarian office and animal hospital, subject to
the following requirement:
(a)
The housing of all animals shall be in a fully
enclosedlstructure, if nearer than one-hundred
fifty (150) feet to any lot line...
3. The subject premises consists of a total lot area of
59,984 square feet (1.377 acres) with street frontage along
three sides: to the north and west along Franklinville Road
West (a/k/a S.H. 8181), and to the south 370+- feet along New
York State Highway 25 (a/k/a Main Road). This property is
presently vacant and is,densely wooded with high, natural berm
areas.
4. The applicantslhave submitted an amended site plan map
last revised 9-2-93 prepared by E.S. Kalogeras, P.E. showing an
expansion of 1,014 sq. ft. for a proposed one-story animal wing,
for a total requested floor area of 4,598 sq. ft. The building
is proposed at one-story height, and at a Regular Meeting held
October 25, 1993 the applicants received conditional site plan
approval from the Town Planning Board subject to certification
by the Building Inspector as required by the Southold Town
Zoning Code. As of this date, the Building Inspector has not
certified the plan, pending the outcome of the final
determination on the Amended Special Exception application
(which was also filed on October 25, 1993).
5. The plans before the Board indicate that the existing
natural wooded areas and high elevations (berms up to 28 ft.
high) along the southerly and westerly yard areas will remain
undisturbed. The principal building, as proposed and shown on
this new plan, for the veterinarian office and animal hospital
uses is shown to be situated as follows:
(a)
Setback at 84+- feet from the northerly front property
line (the minimum requirement is the same for a
principal dwelling structure at 60 feet);
(b)
Setback at 105 feet from the westerly front property
line, at its closest point;
(c)
Setback at not less than 30 feet in the southerly
front property line at its closest points {Not~:

6. It is noted for record purposes that although the size
of this property is nonconforming in this R-80 Residential Zone
District, the property is quite suitable and does adequately
provide for parking and other site plan elements necessary for
this project. Additionally, applicants are satisfied with the
characteristics of this parcel and have assured the Town of
their intentions to comply with all provisions of the Zoning
Code pertaining to this~proposed use of the building and
screened/buffered areas~
7. In consideringithis application, the Board also finds
and determines: (1) th~ proposed use will not prevent the
orderly and reasonable ~se of adjacent properties or of
properties in adjacent ~se districts; (2) the use will not
adversely affect the safety, welfare, comfort, convenience, or
order of the Town; (3) the use is in harmony with and will
promote the general purposes and intent of zoning. The Board
has also considered sub~ections (a) through (1) of Article XXVI,
Section 100-263 A through F ("standards"), and Section 100-264,
A through P ("other considerations"), applicable to special
exception reviews. The Board agrees that the use of the
building, as proposed herein, meets all standards and conditions
prescribed in the South01d Town Zoning Code for such land use.
Accordingly, on motion by Chairman Goehringer, seconded by
Member Dinizio, it was
RESOLVED, to GRANTan Amendment under the Special Exception
(Special Permit) for a Proposed building of 4,600+- square feet
with occupancy as a Veterinarian Office and Animal Hospital, as
requested and provided bY Article III, Section 100-31B(10) of
the Zoning Code, SUBJECT TO THE FOLLOWING CONDITIONS:
1. Medical treatment of animals must be conducted
internally, inside the Principal building;
2. This use granted under this Special Exception is
limited to a"Veterinari~n Office and Animal Hospital" Uses
within the interior of the principal building.
3. Any future proposal for the outside keeping, breeding,
boarding, and/or treating of animals, or similar activity, will
require an additional Special Exception application and approval
by the Board of Appealsl

This memorandum is being sent as an update to communications
received yesterday (from Bob Kassner, Site Plan Reviewer)
concerning the above application.
We concur that the applicant should not be prevented from
receiving action for final site plan approval from the Planning
Board for an outstanding determination or review by the ZBA
concerning the Special Exception for the expansion of the
building. The only condition of this approval, we understand
is for a certification from the Building Inspector (which is
expected shortly after the Board of Appeals determines the need
or otherwise approves the pending application for an amended
Special Exception). The Building Inspector at the time of
receiving the amended pilan last week reviewed the town files,
and shortly thereafter ~he Planning Board sent a memorandum
inquiring whether or not the new plan, as amended 9/13/93 and
9/30/93, conforms to th~ Special Exception determination and
understanding of the ZB~ at that time.
A determination will be made by the ZBA during a public hearing
advertised for November 8, 1993 as requested by
Peter Danowski, attorney for the applicant.

SITE PLANS
Final Determinations:
Mr. Ward: Mattituck-LaurellVeterinary Hospital - This site plan is for a 3,656 square
foot Veterinary Hospital on~ 1.377 acres located on Route 25 in Laurel. SCTM#
1000-127-2-5.1. The applicant's attorney is here, so you may speak.
Pete Danowski: I'm not sune what the content of the resolution may say, I'm here
only to speak on behalf of the resolution. As you may know I appeared before the
Zoning Board of Appeals when the Zoning Board granted us permission for the use
and also granted us permission for the setbacks. Subsequent to that time, my
clients, Dr. Andresen and his wife, and Dr. Timpone and his wife, have individually
and perhaps together met with various people on the Planning Staff, and
addressed some issues that may have been raised with this Board, which resolved
in the final site plan that you're now considering.
I did speak to some staff today concerning a question that apparently may have
arisen, but I'd like to perhaps put to bed before you vote on the final resolution.
That concerned itself with somehow the possibility of perhaps someone saying,
and I don't even know if this Board said it or the staff said it or some stranger said
It, but somehow we should be going back, perhaps, to the Zoning Board of
Appeals. I don't think we should ever have to do that because the two issues
heard before the Zoning BOard of Appeals was one, should there be a Veterinary
Hospital, and they voted yes, and two should there be a certain setback, and again
they voted yes.
The revisions done to a site plan really have nothing to do with those two issues
before the Zoning Board of Appeals. Specifically some question was asked of me
about a question that was originally asked of me in the Zoning Board of Appeals,
and that was would my client be having animals in paddocks outside the building
and in essence would we be renting out space or housing animals outside. My
answer to that was, we're tlere to treat animals in an emergency situation. This is a
hospital and we operate. Obviously, a horse will come in that has to be operated
on that may not be able tO be operated out in the field or maybe we choose for
health standard reasons to operate in the hospital. That horse will be taken care of
and then hopefully will survive and be sent back home. But we don't plan on
having outside paddocks, tlhere on none on the site plan that has been submitted
to you, that I know of. And therefore, I see no reason to have any conditions on
the site plan approval that would suggest going back to the Zoning Board of

Appeals.
The interesting part is I also appreciate any contact, with myself as an attorney, to
alert me to the fact that if it's going to go back there, there are time frames to
get it in the paper, and l'm trying to save time. So anticipating, I come here
tonight I said, I better come and fill out a new application. It's the same
application to the Zoning Board of Appeals; it doesn't change at all. It merely just
shows them the most recent site plan. The setback stays the same, the 30 feet in
the back, and the use is the same, and we're not asking for the building of
paddocks and the storing of animals outside, which I had agreed with before the
Zoning Board of Appeals, would require a further application.
So I don't know whether someone stated some misinformation, but if you look at
the site plan which the Planning Board properly considers and the changes we
have made since the original application, you certainly have a right to delve into
questions about the building, and I think this final site plan addresses all the issues
that have been made known to my client. So, I would like to think that the
resolution, although I don't Know it's content, won't make us go back to the Zoning
Board of Appeals, because I really don't see the right to make us go back there.
Not that I mind the people, they've granted us the use variance and the setbacks,
so I love them now, but the end line here is it's duplicitous. The same application
would have to be considered, and there's no purpose for it. So if someone is
going to tell me or explain to me that that's going to be a suggestion here, then
I'd like to continue to discuss it and perhaps have my clients individually speak to
that issue, but I really would like to have a resolution of approval tonight, which
won't be conditioned upon any further Zoning Board of Appeals application. We've
gotten the Health Dept. permission, we've been through SEQRA and it's an unlisted
action, we've had no comments in the allotted time period, and we've tried to
cooperate back and forth without my presence, which is probably a benefit, in
dealing with this Board.
Mr. Ward: Alright, maybe before we do a resolution on it, Bob what conversation
did we have with the Zoning Board?
Robert Kassner: We had planned to give final approval tonight to this site plan, but
as part of the approval process we send it to the Building Inspector In Charge for
his certification. This was done after Dr. Timpone delivered the site plans with the
Health Dept. stamp. He informed me today that he couldn't certify it, that it was a
different site plan then was given to the Board of Appeals by Mr. Danowski. I
informed him that I thought that the Special Exception was granted for a use as
opposed to a configuration. I asked Linda in the Zoning Board of Appeals if she
could poll her Board and see if the changes were of such a nature that we could
continue with our resolution. She polled the Board and apparently they came back
and said they wanted an amended Special Exception. And I believe Mr. Danowski
conversed with Linda down at the ZBA as to the reasons for this.
Mr. Danowskh I don't want to put Bob in a bad light here either because I haven't
had a chance to get back to him since this afternoon, I appreciated him contacting
me, but I've since talked to Mrs. Andresen, who is here, and Dr. Andresen and Dr.
Timpone and it's beside ourselves, we've cooperated, we've got the uses, I certainly

don't mind if you granted us the site plan approval. If there's a further application
that's necessary for some additional amended grant of some further approval,
whether it's paddocks or whatever, I don't mind doing that. I think the problem
you have in any town is where you start first. And here, as in many towns, we
have some sort of coordinated effort in the very beginning saying OK you need a
variance, go to the Zoning Board, but we'd like to see a little bit of the sketch of
the site plan, and you try to cooperate in the beginning stages, which we did. We
showed a building and a set,back. The setback for the 50 feet is consistent with
both plans, so no one's saying to us well you've changed the setback distance.
The use is still the same, there's no problem there. And I also don't want to not
cooperate with the Zoning Board. The problem I have is that I have a contract
that's conditioned on a time period that's about to expire, I still have to get my
building plans done and SL~bmitted, and I'm racing these time frames and I'd like to
think that we've satisfied the design criteria of this Board. So I would like to think
that you would not condition on anything. I appreciate Mr. Kassners comments,
but it's kind of, I don't want to say late in the game, but it is late in the game to
hear it today, that somehow, someone informally might want to see the plan
again, and I say for what purpose? No one is saying to us it's a different use, no
one is saying it's a different setback. And you'll have the same problem forever if
as you get back, after havihg left the Zoning Board, you correctly come here and
after discussions you change plans back and forth, with good discussions back and
forth, and revise plans, that every time we're going to end up saying after you got
permission from the Zoning Board and you come before the Planning Board, we're
going to send you back to ithe Zoning Board. It doesn't make sense, and so I think
this Board appreciates, and Mr. Kassner appreciates, that when you go before the
Zoning Board in any town, and not specifically on this project, you ask for a
particular use. For that purpose, you could just use a perimeter survey without
even showing a building on it. We want to build a veterinary hospital and office on
the site, you dent even need to show a structure. You don't need a site plan at
all.
Secondly, when you want to have a setback line, certain you show where the
setback line is. In this case $0 feet. That would be all a Zoning Board would be
interested in and certainly conversations that I've put on the record, I certainly can
live with, and we can live ~Vith the conditions that I stated on the record. And
there is no, that I know of, construction called here of outdoor paddocks, so
somebody may have whispered something about that or said something that
caused someone else to say wait a second, the attorney said there are outdoor
paddocks and we were going to store horses on the site, you come back before
us, which we would. So, I'm asking you to certainly delete any reference to making
us go back to the Zoning Beard of Appeals. Linda at the Zoning Board has been a
delight, she always has been, I have no problem with dealing with her. I met with
her today and I said look here's a bunch of new plans and here's the very same
application, the very same. Typed it up, say the same words, same setback, same
use. It doesn't make any sense (inaudible) I submitted It to her.
Mr. Kassner: What did she say, what was her reason?
Mr. Danowski: I have no explanation other than the same things we're talking

about on the record. I also know the path of least resistance many times is to do
whatever someone tells me to do, if I have to do it 10 times. But from a clients
prospective, they're spending money and time and they need an explanation as to
why, if this is going to happen, they're being made to do something that doesnt
seem to be required. And I know Marybeth would stand up and go crazy on the
subject but I don't really want her to, because I think that this Board would see the
reasoning here.
See, I don't know. Even if, voluntarily, this Board passed the resolution approving
the site plan, I11 deal with the Building Dept. and maybe the natural course of
things, the Zoning Board will see that amended plan anyway. I think the whole
system here allows for the interchange of these maps and part of the Zoning
Board of Appeals decision says when the final site plan Is approved, send them a
copy of that final map so they can have it for their files. So, they're going to have
the map for their files. And if they see the need, because of that plan, for
something then they can send me a letter and address it. In the meantime, to
save time, I'm saying here'S the papers, here's some extra maps, the next Board
meeting is coming up but I don't want to waive my client's rights because theyve
already had the approval, and so I have to be careful of what I say to the Zoning
Board and say it's the very same application you granted, there's not a need for
this application but here's a bunch of maps and another application. So I would
like to have this Board vote and we'll take our chances with the Building Dept. or
whatever else. Just grant us the final site plan approval. To save time, if you're
not about to do that then II think Marybeth would like to get up...
Mr. Ward: OK, what's the pleasure of the Board? I'd like to offer the following
resolution,
WHEREAS, Charles A.Timpone is the contract vendee of the property known and
designated as Mattituck-Laurel Veterinary Hospital, located on Franklinville Road in
Laurel, SCTM# 1000-127-2-5.1; and
WHEREAS, a formal application for the approval of this site plan was submitted on
August I, 199:5; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency, and issued a
Negative Declaration on September 13, 1993; and
WHEREAS, a variance and special exception was granted by the Zoning Board of
Appeals on August 18, 1993; and
WHEREAS, ail the requirements of the Site Plan Regulations of the Town of
Southold have been met; be it therefore,
RESOLVED, that the Southold Town Planning Board grant conditional final approval
subject to a one year review from date of building permit, and authorize the
Chairman to endorse the final survey last revised on September :50, 1993, subject
to the following condition:

In response to your memo submitting amended map (dated August 3,
1993), this will confirm that a Special Exception application to
the Board of Appeals for the amendments adding the large-animal
wing and other site changes will be required under the Special
Exception.
A Notice of Disapproval from the Building Inspector is not
required for this Special Exception submission.
If the application, $400.00 filing fee and supporting
documentation are all filed with our office today together with
the amendment map, neighbor notices and proof of mailing, and a
copy of the Planning Board's SEQRA determination, we would agree
to place it on the November 8, 1993 Regular Meeting calendar for
a public hearing. The next hearings calendar is December 8,
1993.

Reasons Supporting This Determination:
This project involves the construction of a 3~656 square
foot Veterinary Hospital on an existing vacant 59,984
square foot lot. The applicant has obtained a set back
variance and a special exception to establish a Veterinary
Hospital in this Low-Density Residential (R-80) Zone
from the Board of ~ppeals, thus the proposed
action is consisteht with zoning.
An Environmental A~sessment Form has been submitted and
reviewed, and it was determined that no significant adverse
effects to the environment were likely to occur should the
project be implemented as planned.
There has not beenlany correspondence received from the
New York State Department of Environmental Conservation
in the allotted time. Therefore, it is assumed that there
are no comments or !objections from that agency.
The applicant will :have to comply with the requirements of
the Suffolk County iSanitary Code (SCSC) and all relevant
standards of water isupply and sewage disposal systems.
Design and flow specification, subsurface soil conditions,
and site plan details will have to be approved by the
Suffolk County Dep~rtment of Health Services (SCDHS).
This impact is not considered significant due to the
anticipated projectcompliance with established
requirements of the SCSC and the SCDHS and the
required relevant permits.

The Suffolk County Department of Health Services (SCDHS) has received your letter, conceming the above-
referenced application, and has no objection to the Town's designation as lead agency.
This correspondence is intended p~arily to expedite the procedural requirements of SEQRA pertaining to the
establishment of lead agency. The comments provided below are, therefore, general in nature, representing several of our
most common concerns regarding Suffolk County projects. The department wishes, however, to reserve its right to
provide more detailed information within the comment period(s) established for this action.
L Suffolk County Sanitary Code (SCSC)
The SCDHS maintains jurisdiction over tie final location of sewage disposal and water supply systems, pursuant to
the authority and requirements of Articles 4, 5, 6 and 7 of the SCSC. Applications must comply with all relevant
density and construction standards for water supply and sewage disposal. Applicants should not undertake the
construction of, or connection to, either system without Health Department approval.
Where applicable, the depa~ment regulates the storage, handling and discharge of restricted toxic and hazardous
materials pursuant to the requliements of Articles 7 & 12 of the SCSC.
If an application has not yet been submitted to the SCDHS, one should be filed at the earliest date to allow for the
technical review of the proposed action. Project designs submitted to the department should be fully consistent with
any action currently under review through the SEQRA process.
Design and flow specifications, information regarding subsurface soil conditions, water supply information, and
complete design details are essential to the review of this project, and are evaluated fully at the time of application
review. Should the town require additional env/ronmental information (such as a DEIS), discussion of the compliance
requirements of the SCDHS should be required.
5. Of particular concern to the depamnent are those areas which becanse of elevated groundwater conditions, or soils
which are not conducive to the proper functioning of conventional subsurface sanitary sewage disposal systems. Your
agency should be aware that such conditions frequently require the use of fill or the excavation of subsurface soils to
accommodate subsurface sanitary disposal systems constructed in conformance with the requirements of the SCSC.

The deparlment is also significantly concerned with areas where access to potable water may be constrained by
unacceptable groundwater quality and the lack of an available public water supply. All private water supply systems
must be conslmcted in conformance with requirements of the SCSC.
1I. NATURAL RESOURCES:
The SCDHS fully supports all efforts to maximize protection of natural resources which may be impacted upon by
construction and developmem activities. It is the position of the department that the SEQRA review process provides
the greatest opportunity for comprehensive consideration of these resources, and that all practicable planning
measures should he employed to help ensure their protection.
Of particular concern to depa~ment is the adequate protection of wetlands, surface watem, natural communities,
contiguous natural habitats, and rare, threatened and endangered species. In addition, efforts to protect sensitive
physical resources such groundwat~rs, dunes, bluffs, shorelines, natural drainage channels, groundwater recharge
areas, and steep slopes are fully supported and encouraged by the SCDHS.
In general, the deparanent encourages the following land use measures be considered (where appropriate) to actions
being reviewed pursuant to SEQRA.
1. Maximum practicable setbacks f~om all wetlands, surface waters, dunes, and bluffs.
2. Non-disturbance buffets hetwee$ wetland limits and required structural setbacks.
3. Clustering of subdivision lots to provide for maximum preservation of large contiguous areas of dedicated open
space.
4. Stringent clearing limitations which can reduce potential impacts to wildlife habitats, vegetative communities, and
unconsolidated soils.
5. Maximum practicable confinam~nt of development to areas with slopes of less than 10%.
6. Maximum use of native species for landscaping purposes.
7. Construction of recharge areas, so as to minimize the amount of disturbance and s~xuctural modification to the site.
8. Maximum use of land-banked patqdng on commem'ial sites.
9. Minimal use of fextilizer-depandSnt tuff and landscaping.
10. Employment of stonnwater mndff comxol measures necessary to maintain runoff on-site.

Application of JOHN E. ANDRESEN and others as contract
vendees (Current Owner: Thomas N. Anshutz, Jr.) concerning
premises known as 1625 Main Road and Franklinville Road West,
Laurel, NY; District 1000, Section 127, Block 2, Lot 5.1,
containing 59,984 sq. ft. in this R-80 Residential Zone
District, requesting a Variance to the Zoning Ordinance, Article
III, Section 100-32, Bulk Schedule, for permission to locate
principal building with a reduced setback from the southerly
(front) property line along the Main Road (S.R. 25).
WHEREAS, after due notice, a public hearing was held on
August 18, 1993, and all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. By this application, applicants are proposing to
establish a new veterinarian office and animal hospital at
vacant premises (presently owned by Thomas N. Anshutz, Jr.)
and more particularly referred to as 1625 Main Road, Laurel,
New York, identified on the Suffolk County Tax Maps as District
1000, Section 127, Block 2, Lot 5.1. The applicants are
contract vendees under an executed contract of sale dated
June 9, 1993 between John Andresen, Maribeth Andresen, Charles
Timpone, Debra Timpone, and the current owner, Thomas N.
Anshutz, Jr.
2. The basis of this appeal is Article III, Section 100-32
(Bulk Schedule pertaining to setbacks of a principal building)
as noted in the July 29, 1993 Notice of Disapproval issued by
the Building Inspector, which reads in part:

non-residential use (as permitted) density and minimum
lot size schedule for residential district - lot has
insufficient lot area. Interpretation requested on
lot line setbacks. Action required by the Zoning

3. The subject Premises consists of a total lot area of
59,984 square feet (1.377 acres) with street frontage along
three sides: to the no~th and west along Franklinville Road
West (a/k/a S.H. 8181), land to the south New York State Highway
25 (a/k/a Main Road). This property is presently vacant and is
improved with heavily treed, and natural high berm areas.
4. The applicants have submitted a site plan map dated
July 13, 1993 prepared by E.S. Kalogeras, P.E. for consideration
by this Board. This Plan indicates that the existing natural
wooded areas and high elevations (berms up to 28 ft. high) along
the southerly and westerly yard areas will remain undisturbed.
The principal building within which the veterinarian office and
animal hospital uses are to be established is shown to be
situated on this parcel as follows:
(a)
Setback at 73 feet from the northerly front property
line (the minimum requirement is the same for a
principal dwelling structure at 60 feet);
(b)
Setback at not less than 60 feet from the westerly
front property line, at its closest point;
(c)
Setback at not less than 30 feet in the southerly
front property line at its closest point which is the
subject of this variance.
5. It ~s noted for record purposes that although the size
of this property is nonconforming with a preexisting lot size of
59,984 square feet in this R-80 Residential Zone District, the
property is most suitable and does adequately provide for the
necessary building (floOr) area and parking and other site plan
elements necessary for this project. Additionally, applicants
have indicated their satisfaction with the characteristics of
this parcel and have assured the Town of their intentions to
comply with all provisions of the Zoning Code pertaining to this
proposed use of the building and land areas.
6. It is also noted for the record that a conditional
Special Exception was g~anted under this date for the requested
Animal Hospital with related veterinarian office uses.

7. In considering this application, the Board also finds
and determines:
a) the benefit to the applicant, as weighed against
the detriment to the health, safety, welfare of the community,
is greater, and the benefit afforded is not unreasonable in
light of the unique characteristics and land contours,
substandard size, location of the property with three front yard
areas;
b) the benefit sought by the applicants cannot be
reasonably achieved by another, method without affecting the
neighboring land;
c) the relief requested for a front yard reduction at
not less than 30 feet is not unreasonable and will not have an
adverse effect or impact on the physical or environmental
conditions in the neighborhood or the surrounding district;
d) the difficulties created are related to the
uniqueness of the land, its location, its topography, shape and
characteristics, and are not personal to the landowner or future
landowners (contract vendees-applicants);
e) the relief as granted will not be adverse to the
preservation and protection of the character of the neighborhood
and the health, safety, and welfare of the community, and will
not alter the essential character of the district;
(f) the setback at 30 feet from the proposed southerly
property line is substantial in relation to the requirements,
that is, meeting 50 percent of the 60 ft. setback requirement,
however, this land contour in this yard area is screened with
natural high berm (up to 28 feet high) and is heavily treed -
which will remain as a condition of approvals;
(g) in view of all the above, the interests of justice
will be served by granting the relief, as requested.
Accordingly, on motion by Chairman Goehringer, seconded by
Member Wilton, it was
RESOLVED, to INTERPRET, as requested by the Building
Inspector in his Noticelof Disapproval dated July 29, 1993, that
the minimum setbacks for a principal dwelling structure shall
also apply to other types of principal uses on vacant lots as
may be permitted or expressly conditioned in the R-80 Zone
Districts; and be it

FURTHER RESOLVED, to GRANT a reduction from the required 60
feet to 30 feet from the southerly front property line (along
the Main State Road) for a proposed principal building to be

and documentation submitted concerning this application; and
WHEREAS, the Board ,members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. By this application, applicants are proposing to
establish a new veterinarian office and animal hospital at
vacant premises (presently owned by Thomas N. Anshutz, Jr.)
and more particularly reiferred to as 1625 Main Road, Laurel,
New York, identified on the Suffolk coUnty Tax Maps as District
1000, Section 127, Bloc~ 2, Lot 5.1. The applicants are
contract vendees under an executed contract of sale dated
June 9, 1993 between John Andresen, Maribeth Andresen, Charles
Timpone, Debra Timpone, iand the current owner, Thomas N.
Anshutz, Jr.
2. The provisions under which this Special Exception is
requested is Article III, Section 100-31B(10) which permits by
authority of the Board o!f Appeals, and subject to site plan
approval by the Planning! Board, a veterinarian office and animal
hospital, subject to the following requirement:

The housing of all animals shall be in a fully
enclosed structure, if nearer than one-hundred
fifty (150) feet to any lot line.
3. The subject premises consists of a total lot area of
59,984 square feet (1.377 acres) with street frontage along
three sides: to the no~th and west along Franklinville Road
West (a/k/a S.H. 8181), and to the south New York State Highway
25 (a/k/a Main Road). This property is presently vacant and is
improved with densely wooded, and high berm areas.
4. The applicants have submitted a site plan map dated
July 13, 1993 prepared by E.S. Kalogeras, P.E. for consideration
by the Board Members. This plan indicates that the existing
natural wooded areas and high elevations (berms up to 28 ft.
high) along the southerly and westerly yard areas will remain
undisturbed. The principal building within which the
veterinarian office and ianimal hospital uses are to be
established is shown to ibe situated on this parcel as follows:
(a)
Setback at 73 feet from the northerly front property
line (the minimum requirement is the same for a
principal dwelling structure at 60 feet);
(b) Setback at not less than 60 feet from the westerly
front property line, at its closest point;
(c)
Setback at no< less than 30 feet in the southerly
front property line at its closest point {Note:
An appeal for .a relief from this front yard was filed
simultaneously with this application - see Appeal
No. 4186}.
5. It is noted four record purposes that although the size
of this property is noncbnforming in this R-80 Residential Zone
District, the property ~s very suitable and adequately provides
for the necessary building (floor) area, and the required
parking and other site p!lan elements necessary for this
project. Additionally, applicants are satisfied with the
characteristics of this parcel and have assured the Town of
their intentions to comp,ly with all provisions of the Zoning
Code pertaining to this proposed use of the building and land
areas.
6. In considering this application, the Board also finds
and determines: (1) the proposed use will not prevent the
orderly and reasonable use of adjacent properties or of
properties in adjacent use districts; (2) the use will not
adversely affect the safety, welfare, comfort, convenience, or
order of the Town; (3) the use is in harmony with and will
promote the general purppses and intent of zoning. The Board

RESOLVED, to GRANT ~ Special Exception for a Veterinarian
Office and Animal Hospital Uses, as requested and provided by
Article III, Section 100~31B(10) of the Zoning Code, SUBJECT TO
THE FOLLOWING CONDITIONS!:

On August 11, 1993, I met with Mr. E. S. Kalogeras your.
consulting Engineer regarding your site plan for the above
referenced project.
As discussed with Mr. Kalogeras, following are the Planning
Board's comments:
1. Entrance, exit and parking area to be paved.
2. Show location of any proposed dumpster.
3. Elevation drawings.
4. Sketch of any proposed outdoor ground sign.
5. Details, including wattage, of any outdoor lighting.
All lighting must be shielded to the property.
6. Tighter clearing limits as indicated on plan given to
Mr. Kalogeras.
7. A five foot (5') landscaped strip in front of the
building.
8. Provide parking space for vehicle and horse trailer.
9. Relocate handicapped parking space closer to the
building if possible.
In addition to the above, Suffolk County Department of Health
Services review is required.

The applicant in the above project has confirmed with our office
that he did meet yesterday, on a preliminary level with Planning
Board Members, and thatihe expects to file the above site plan
application and supporting documents with your office within the
next few days.
Since the application before this Department concerns a request
for an allowable use by Special Exception as well as a front
yard setback variance, we would like to provide you with an
opportunity at this time to comment on those elements which may
affect the site plan elements under Article XXV (Site Plan
Regulations). You willlnote that the property is substandard in
size in this R-80 Zone District and has three front yard areas
along two streets, although access will be provided only from
Franklinville Road. Much of the screening and natural berm
area along the Main (State Route 25) Road will remain, we
understand.
