Southold Unit 8785 ("eSEA") and the'Southold Town PBA, Inc. (UPBAn). WHEREAS, due to staffing shortages, the Town wishes to utilize PBA unit members as public safety dispatchers; and WJIEREAS, the PBA has no objection to swne because dispatching is an inheTl!lnt and traditional part ofapolice officer's duties and the To""n has previously utilized PBA unit members lor this purpose; and WHEREAS, the CSEA has no objection to same provided that it is oflirnited duration and does not breach whatever claims to exclusivity over this work that !he CSEA believes it has; . and WHEREAS, the parties have engaged in negotiations in good faith in an effort to arrive at an agreement regarding this benefit; and WHEREAS, the parties have arrived at a tentative agreement; NOW, THEREFORE, in consideration of the mutual covcmants cOlltained herein, the parties stipulate and agree. as folloWS: 1. The Town shall have the discretion to utilize PBA unit members as dispatchers when and as it deems appropriate until December 31, 2006. 2 The parties agree that nothing in tbis Agreement in any way diminishCl! the Town's and PBA's assertions that the Town has the unilateral right to utilize PBA unit members as dispatchers when and as the Town deems appropriate. This Agreement represents the totality of the Town's duty, if any, to bargain with the eSEA and/or 'PBA over it. decision to utilize PBA unit members to perform dispatching dutiC5 through December 31, 2006, and the impact of that decision. 4. This Agreement shan constitute the entire agreement between the parties with regard to the issue of utilizing PBA unit members as dispatchers through December 31. 2006.
