The final public hearing for the lot line change of James and Mary Ann Abbott, was closed. WHEREAS, James and Mary Ann Abbott and J. McGuone Abbott are the owners of the property known and designated as SCTM# 1000-126.5-2 & 3, located on Peconic Bay Blvd. In Mattituck, and WHEREAS, this lot line change is to subtract 4,440 square feet from a 35,890 square foot parcel and add it to a 27,750 square foot parcel; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on October 24, 1994; and Page 2 Lot line change for James and Mary Ann Abbott October 24, 1994 ~FY WHEREAS, a variance was granted by the Zoning Board of Appeals on September 7, 1994; and WHEREAS, a final public hearing was closed on said lot line change application at Town Hall, Southold, New York on October 24, 1994; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore, RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated June 25, 1994 and authorize the Chairman to endorse the final surveys subject to fulfillment of the following condition. This condition must be met within six (6) months of the date of this resolution. 1. This property is to ted in the R-40 Low-Density Residential Zone District which requires 40,000 sq. ft. of lot area per new lot to be created (Article Iil, Section 100-30A.3, Bulk Schedule applicable to the R-40 Zone District). Since the two lots are substandard in size as exis (before this proposed change in the lot division line), an area var ce is required to reduce the lot area of one - while at the a time increasing the lot area of the other. A single-and-sepa to search was submitted to show that these two lots were existin in single and separate ownership since prior to enactment of one-are zoning in 1971. Each of the two lots is improved. 4. The percentage of relief sought by this application is zero for the reason that there i merely an exchange in lot size between Lot 1 and Lot 2 - without any other conveyance or split, and there is no increase in density o affect on the total area of the lots (combined total). 5.
