We received the Army Corp. approval and we are awaiting the DEC permit. The last item requested by the DEC were photographs of the staking. When Bob Fox went out to re-stake the ends of the dock this week he found that the adjacent owner had extended their dock and boats over their property line onto my client's property. Bob Fox has provided a drawing of the adjacent dock and boats which is attached. As you can see the neighbor's dock and Boat significantly impacts our approved dock. We ask that the Board review this matter, we were not given notice of a permit. My client objects to the placement of dock and float so close to his property. The neighbor's expanded dock impacts my client's approved dock. Please advise. Very tr~y yours, Patricia C. Moore, Esq. 51020 Main Road Southold, NY 11971 RE: THOMAS LUNIEWSKI 470 JOHN'S ROAD, MATTITUCK SCTM# 122-3-25.2 Dear Ms. Moore, The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 21, 2006 regarding the above matter: WHEREAS, Patricia C. Moore as agent for THOMAS LUNIEWSKI applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 8, 2006, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed wilt not affect the health, safety and general welfare of the people of the town, WHEREAS, the Board has determined that the project will be consistent with the LWRP under Policy 6 of the LWRP, and, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of THOMAS LUNIEWSKI to construct a 4' x 32' dock, 4' x 12' ramp and 6' x 20' float. The landward edge of the dock is to start no less than 15' landward of the edge of the bog. The total length of the dock, ramp, and float is not to extend more than 30' seaward from the edge of the bog, and all as depicted on the plan surveyed by Sea Level Mapping last dated 4/3/06. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the LWRP provided that the reviewing agency demonstrates the action meets Chapter 97 specifically § 275-11. Construction and operation standards: I Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. ] 6.3 Protect and restore tidal and freshwater wetlands. A.
