Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
May 17, 2006 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of VISHNUDAT SEODAT applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated April 26,
2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 17, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board ofTrustees approve the application ofVISHNUDAT
SEODA T to replace approx. 183 linear ft. of terrace retaining walls and to truck in
approx. 190 cy. of clean sand fill from an upland source. Limits of washed out portion of
bluff face to be re-filled and replanted with beach grass, Rugosa Rose and Bayberry,
and a 35' non-turf buffer to be supplemented with additional beach grass, as necessary,
and as depicted on the plans prepared by En-Consultants, Inc. last dated May 8, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., May 10,
2006, the following recommendation was made:
Moved by Don Wilder, seconded by Peter Young, it was
RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH
A CONDITION of the Wetland. Permit and Coastal Erosion Permit applications of
VISHNUDA T SEODA T to reconstruct (in-place) approx. 129 linear ft. of previously
authorized bluff terrace retaining walls, which collapsed during washout event; repair or
replace (in-place) adjacent, damaged sections of terraces as necessary; re-grade
vertical lip at bluff crest and use approx. 15 cy. resultant material. along with approx.
115 cy. clean sand to be trucked in from an upland source, to re-fiIl washed out portion
of bluff face; and replant washed out portion of bluff face and non-turf buffer landward of
bluff crest (as needed) with beachgrass, bayberry, and rugosa rose.

The CAC recommends Approval of the application with the Condition of a non-turf buffer
50% of the distance between the pool and the top of the bluff.

VISHNUDAT SEODAT requests a Wetland Permit & Coastal Erosion Permit to

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review
ofthe Town of South old Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency ofthe proposed action.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. * Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt

Dear Mr. King:
Wetlands and Coastal Erosion Management Permit Applications were filed for the captioned property
last week. Please substitute the attached project plans, last dated 8 May 2006, for those submitted with
the application and note that the project description should be modified to request the replacement of
approximately 183 (rather than 121) linear feet of terrace retaining walls and to truck in approximately
190 (rather than 115) cubic yards of clean sand fill from an upland source.
Because terminating the replacement of the terrace walls along an imaginary seaward extension of the
property line shared with the westerly adjacent owners would leave an unstabilized, unfilled, and
unvegetated gulley that would likely undermine the repair work, the project has been modified to
include restoration of that area, including connection of the applicant's repaired terrace walls to the
easterly ends of those present on the property to the west. Therefore, I am also attaching herewith an
authorization letter signed by the adjacent owners, James and Liliana Mihalios, along with a copy of a
26 June 2000 letter from the Honeysuckle Hills Property Owners Association, Inc., requiring the
Mihalios' to maintain the integrity of their structures once constructed.

We, James and Liliana Mihalios, own property known as 640 Lloyd's Lane, Mattituck, and
as SCTM No. 1000-99-3-4.1, which is located west of and adjacent to that owned by Dr.
Vishnudat Seodat, known as 580 Lloyd's Lane, Mattituck. We are aware of, in favor of,
and have no objection to Dr. Seodat's proposal to reconnect his reconstructed and/or
repaired bluff terrace walls to our bluff terrace walls and reconstruct or repair as necessary
sections of our terrace walls to facilitate such connections. We are also aware of, in favor
of, and have no objection to Dr. Seodat's proposal to place fill and plant the bluff face, as
some portions of such work would occur on or in front of our property.
We assume full responsibility, fmancial and otherwise, for any and all portions of work
that will occur on or in front of our property.

Honeysuckle Hilts Property Owners Association have responded with their vote
regarding the bulkhead installation proposed. All votes received were In favor of
the proposal. Therefor you are authorized to construct such bulkhead with the
following caveats:
1, You, and your contractor, assume full responsibility for constructing such
bulkhead and maintaining Its integrity after construction.
2. The Association bears no liability for damage to, or resulting from, the
bulkhead or construction thereof.
