Dear Mr. Cuddy:
The Bpard of Town Trustees took the following action during its regular meeting held on
Wedn~sday, April 24, 2002 regarding the above matter:
WH:tAS, Charles R. Cuddy, Esq. on behalf of ARTHUR W. & FRANCES JUNE
LEU ESDORF applied to the Southold Town Trustees for a permit under the provisions of the
Wet! d Ordinance of the Town of South old, application dated March 20, 2002, and,
WHEtkEAS, said application was referred to the Southold Town Conservation Advisory Council
for th~ir findings and recommendations, and,
,
WHEtkEAS, a Public Hearing was held by the Town Trustees with respect to said application on
April ~4, 2002, at which time all interested persons were given an opportunity to be heard, and,
WHEJ!rnAS, the Board members have personally viewed and are familiar with the premises in
questi~n and the surrounding area, and,
WHEtkEAS, the Board has considered all the testimony and documentation submitted
conceJining this application, and,
WHEhAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of ARTHUR W. & FRANCES
JUNE LEUDESDORF to construct a stairway down the face of the bluff to access the beach.
The stairway shall be approx. 4' wide by 130' long with landings 4' wide by 4' long at intervals
along the length ofthe stairway. The landing nearest the beach shall be 6' wide by 8' long to
accommodate a storage box.
BE IT fURTHER RESOLVED that this determination should not be considered a determination
made i\>r any other Department or Agency, which may also have an application pending for the
same ot similar project.
Permit ~o construct and complete project will expire two years from the date it is signed. Fees
must b~ paid, if applicable, and permit issued within six months of the date of this notification.
Two in/;pections are required and the Trustees are to be notified upon completion of said project.

substan al cut back or ravine on the west property boundary.

LocatiO~ of the proposed house is behind the high point of the bluff and set back towards the
road. Alii of the land slopes .way from the bluff along here. No visible problems exist WIth the
prop~ house location.

Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and ~intenance of the facility or facilities authorized by the permit in compliance or non-compliance with
the terms and conditions of the permit.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibilily to comply with this permit, including all special conditions while acting as the permittee's agent with
respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the
Environmental Conservation law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The p~rmittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that
may be req~ired to carry out the activities that are authorized by this permit.
Item D: Nq Right to Trespass or Interfere with Riparian Rights
This p~rmit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian
rights of ot~ers in order to perform the permitted work nor does it authorize the impairment of any rights, title, or
interest in rl'al or personal property held or vested in a person not a party to the permit.
. GENERAL CONDITIONS
General Cqndition 1: Facility Inspection by the Department
The p~rmitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals
by an auth rized representative of the Department of Environmental Conservation (the Department) to determine
whether th permittee is complying with this permit and the ECl. Such representative may order the work suspended
pursuant to ECl 71-0301 and SAPA 401(3).
The p rmittee shall provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A cop of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection ~y the Department at all times at the project site or facility. Failure to produce a copy of the permit upon
request by ~ Department representative is a violation of this permit.
General Cqndition 2: Relationship of this Permit to Other Department Orders and Determinations
Unles~ expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order ~r determination previously issued by the Department or any of the terms, conditions or requirements
contained i~ such order or determination.
General C ndition 3: Applications for Permit Renewals or Modifications
The pe mittee must submit a separate written application to the Department for renewal, modification or transfer
of this per it. Such application must include any forms or supplemental information the Department requires. Any
renewal, m dification or transfer granted by the Department must be in writing.
The pe mittee must submit a renewal application at least:
a) i 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
! Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
i Management Facilities (SWMF); and
b) t30 days before expiration of all other permit types.
Submi sion of applications for permit renewal or modification are to be submitted to:

General C~dition 4: Permit Modifications, Suspensions and Revocations by the Department
The D partment reserves the right to modify, suspend or revoke this permit. The grounds for modification,
suspension r revocation include:
a) ! the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
! of the ECl and pertinent regulations is found;
b) ! the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) i new material information is discovered; or
d) i environmental conditions, relevant technology, or applicable law or re9ulation have materially

1. If future ope~ations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonabie
obstru~tion to the free navigation of said waters or flood fiows or endanger the health, safety or welfare of the
peoplel of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered
by the iPepartmentto remove oralterthe structural work, obstructions, or hazards caused thereby without expense
to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modifiqation of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to
the Stale, and to such extent and in such time and manner as the Department of Environmental Conservation may
requir* remove all or any portion of the uncompieted structure or fill and restore to its former condition the
naviga ie and fiood capacity of the watercourse. No claim shall be made against the State of New York on
accou t of any such removal or alteration.
2. The S~te of New York shall in no case be Iiabie for any damage or injury to the structure or work herein
authori ed which may be caused by or result from future operations undertaken by the State for the conservation
or imp vement of navigation, or for other purposes, and no ciaim or right to compensation shall accrue from any
such d mage.
3. Granti~g of this permit does not relieve the applicant of the responsibility of obtaining any other permission,
conse tor approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General
Servic s or local government which may be required.

4. Ail nectssary precautions shall be taken to preciude contamination of any wetland or waterway by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other
env;ro mentaily deleterious materials associated with the project.

5. Any m~erial dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse iles, ridges across the bed of a waterway or fioodplain or deep holes that may have a tendency to cause
damag to navigable channels or to the banks of a waterway.
6. There ~hall be no unreasonable interference with navigation by the work herein authorized.
1. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applica t shail, without expense to the State, and to such extent and in such time and manner as the Department
of Envi onmentai Conservation may require, remove ail or any portion of the uncompleted structure or fill and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
such relloval or alteration.

8. If grant~d under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effiuentlimitations or other limitations or standards under Sections 301, 302,
303, 30 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are
met.

9. At least~8 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion f the enciosed notification form certifying that they are fully aware of and understand all terms and
conditio s of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed a d returned, along with photographs of the completed work and, if required, a survey.
10. All actiJties authorized by this permit must be in strict conformance with the approved plans submitted by the
apPlicaft or his agent as part of the permit application.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and/or
protected buffer areas.

2. Alteration of the existing grade of the bluff or hill during construction of the stairway is prohibited.
3. The st<ilirway must be elevated a minimum of 3 feet over grade to minimize disturbance or loss of the natural
vegetation and reduce the potential for causing or accelerating erosion of the bluff or hill. Disturbance to the
naturalivegetation or topography seaward of the crest (top) of the bluff or hill must be restricted to an 8 foot wide
area, including the width of the stairway, as shown on the approved plans.
4. The stQrage of construction equipment and materials shall be confined to upland areas landward of the crest of
the blUr or hill.

As Mr. Horton and Mr. Krupski know, I have been a strong advocate of protecting and
pre~rving our town's natural resources. To those ends, I have written letters, with supporting
Pi~ctes and other documentation from time to time, pointing out problems and requesting
cha es - some close to home and some that concern the whole community. Unfortunately,
th efforts have resulted in little or no action. Unfortunately, the Town's inaction has led to a
gre loss, a scar on the land...one that, like a disease, may spread and inflict great harm. In
fact, ,'t already has,
THE INCIDENT
With ut regards for their neighbors or the natural beauty and fragility of the bluff, the
Le sdorfs at 1700 Hyatt Road have decimated a wide swath of old, removing hard wood
tree from the bluff line down towards the beach - a wetlands designated area. As my mother
put i when her eyes welled up with tears upon seeing the destruction, "It looks like a Civil War
or I war zone picture where only trees trunks remain on a smoking, scarred battlefield."
I re rted this action to the Bay Constable on Saturday, November 6 when work began.
Unfo unately, the officer handling the call did not know that the Constable was on duty and
rout d me to voicemail instead. On Sunday as work progressed, I called the Bay Constable
agai ,in hopes of stopping this tragic assault on the land, but was told that he wes on the water
and as sent to voicemail again. The Constable did return my calls on Monday, upset that calls
were not routed to him and promising to look into the matter. I believe he did inspect the
dam ge that morning.
THE UNDERLYING PROBLEM
Earti r this year, I reported not one but several incidents at 1900 Hyatt Road, regarding tree
work being done at and below the bluff line, as well as the use of heavy equipment on the bluff,
som thing the Town Board said in an open hearing could not take place on that property.
Des ite my calls, letters, faxes and accompanying pictures, little action was taken. Yes, the Bay
Con table inspected the property. But against his suggestion, the Town Board chose not to be
invol ed - even though they had previously inspected the property and had knowledge of the
pro rty's previous condition that the Constable did not - and the Dept. Of Environmental
Con ervation (DEC) chose not to fine the property owners, even though they were in agreement
that n infraction had occurred.
Be use of that inaction - although I understand that the DEC is reconsidering whether to fine
the ers of 1900 Hyatt Road because they believe that the infraction was more severe than
first t ought -I'm sure that the Leudesdorfs felt that they could do the same - or in this case,
muc worse - and get away with it. As I said above, the disease has spread. And with several
new roperty owners on this section of the bluff, the odds of it spreading even further are great.
Whe Is this town going to get tough on enforcing its environmental codes and policies?
La and codes mean nothing if they are not enforced.

NEXT STEPS
With ,this letter. I am asking you to put the full weight of your offices behind the Bay Constable in
this rj'latter. Please do not just leave the matter to him. Join him and petition the DEC to take
deci$ive action. The town itself must impart a meaningful penalty.
My 9fcIndparents moved to this town because they loved its natural beauty and wanted to be
part pf the community because of what it was. This new breed of residents say that they come
here Ifor the same reason. except they insist on modifying the natural beauty to fit within their
needs and they want to improve the community by destroying some of the very things that make
it SOJreat.
The roblem is that money means nothing to this new breed of town resident. They look at the
curr nt codes and take a "risk managemenr approach. calculating that they break the code and
get aught and get fined $10.000. so what. That's part of the cost of doing things their way.
In addition to enforcing the code and making sure the Leudesdorfs are heavily fined, would you
plea,e consider applying the following steps:

1!. Require that the land be replanted in the spring, and not with two-foot saplings but with
i full-sized trees to restore the ecosystem to its previous state. To do anything less would
I mean that the Leudesdorfs will have still accomplished their goal of getting a view at the
.J expense of the bluff and the stability of their neighbors' properties.
~. Require the Leudesdorf to pay for printing, mailing and publication costs of a letter of
apology to not only their immediate neighbors but to all town residents. admitting their
wrong doing, expressing their regret for their actions and stating that they are supporting
the town in enforcement of environmental protection policies. As I said above. money
means nothing to such people, but their name and reputation in the community means
everything. Use the Leudesdorfs as an example. Towns post the names and pictures of
sex offenders. Why not follow suit and make sure people who assault our natural
resources are publicly identified and shamed.
~. In addition to DEC fines, the town should require the Leudesdorfs to pay a fine to a town
I fund that would pay for planting trees and shrubs around town.

CO$LUSION
It's ti e to stop giving people passes. Ignorance is not a defense. They may be nice people, but
nice ople often do stUpid and hannful things.
In b ilding their home, the Leudesdorfs took advantage of every loophole in the old building
cod to build a house too tall and too large for the available building space. They reconfigured
the ntour of their property which to this day causes continuing flooding and erosion problems,
but scaped penalty by getting their C.O. 10 days before the passage of new town codes that
woul have held them responsible for addressing these issues.

Now the code is clear. The Leudesdorfs have displayed the ultimate arrogance and disregard
for tl)eir neighbors, the environment and the town by decimating the trees below the bluff line.
Now! is the time for the town to stand firm for once and make sure that they do not get away with
this ~rrible action and that this disease of thinking that land owners in environmentally sensitive
area~ can just do as they please without meaningful repercussion - as what happened when
the qwners of 1900 Hyatt Road and their landscaper got away with similar, although lesser,
infraCtions.
And finally, I would ask that you all keep me posted about action in this case. All too often, I've
bee told, "Good point. We see the need for change." And nothing happens. While the greater
issu here is the protection of the town's wetland areas and the bluffs all along the Sound, my
pro rty is now being assaulted from two sides. The stability of the bluff on either side has been
put t risk. Thus, I need to know that the town is taking this seriously and looking out for my
right ,as well as those of all town residents.

In response to your concerns please be aware that the Trustees are in the process of
investigating this matter. We will contact you to let you know how this is resolved.
However, please uoderstand that this is a matter for enforcement. The Bay Constables
and the Southold Police Department are in charge of enforcing the code. Please bring this
matter to the attention of the Chief of Police if you are not getting any response from the
Bay Constable. If it is in fact a violation it will be enforced by their department, not ours.
