A regular meeting of the Southold Town Planning Board was
held on Monday, March 6, 1978 at 7:30 p.m. at the Town Hall, Main
Road, Southold, New York.
Present were:
John Wickham, Chairman

. 7:30 p.m. Adjourned public hearing of Frank Murphy minor
subdivision. Mr. Murphy attended.
Mr. Wickham: The public hearing was held February 14th and there
was no one here representing the developer or his attorney. In
a minor subdivision we normally have covenants that none of these
lots will be subdivided. Each one is about twice the minimum lot
area�
Mr. Murphy: I have no objection to that.
Mr. Wickham: When you set off a minor subdivision from a larger
parcel, we require a covenant that if you or the subsequent
owners decide at some time that you want to subdivide it, it has
to be subdivided as a major subdivision.
Mr. Murphy: My reason for buying the property is to put it into
the trees. I want to get rid of the woodland. I am going to tie
that piece up for a minimum, of twelve years in Christmas trees.
Mr. Wickham: We found that one ' s plans frequently change and
this is why we require these covenants to go with theland. It
has been uniform practice on this board as a condition of a minor
subdivision on one portion of the property, we require a covenant
that will run with the land that the rest of it will not be

/ divided except by a major subdivision and this is toing to be a
condition. It has uniformly been a condition that we require.
Mr. Murphy: I have a man very interested in buying a lot. He
has to start building very soon and I am looking for approval so

I can sell this lot to this man. We tried to make very large lots

and make it as good for the town as possible. I have spent a lot

of money on interest on the land and I bought the land so I could

raise some Christmas trees and the only way is to buy a piece like
this and sell some off. If I can sell the four lots off, I hope
to have Christmas trees in there for my retirement.
Mr. Wickham declared the hearing closed and told Mr. Murphy a
determination would be made later in the evening.
West Creek Estates marina. Mr. Pfeffer, Mr. Jellett and another
gentleman appeared. There was a question regarding the marina in
the subdivision. It was these gentlemen' s understanding that it
would go to a property owners' association. Mr. Wickham would
like to talk to the town attorney about it. It is possible that
it is a violation of the implied promise of the filed map. Mr.
Wickham told the gentlemen to call the office in a few days and
he would have the information for them. There was a question as
to who should initiate the action and Mr. Wickham felt it should
be the property owners.
Sebastian' s Cove. George Toumanoff appeared.
There was question about the cul de sac and where it should be
located. Mr. Toumanoff suggested that it be a cul de sac with
Section 1 and if Section 2 is developed it be made into a corner
and go down to the boat ramp. When Mr. Raynor questioned the
egress and ingress, Mr. Wickham said there would be. a fifty foot
road put in Section 2 but it would not be a spec road. Mr.
Toumanoff said the intention was to keep the roads private when
a 100 foot turnaround dotted in at the boat ramp area was
discussed. Mr. Toumanoff said he wanted to sell lot 2 which has
a house on it. Mr. Raynor said on preliminary approval they
have released one lot but with road frontage.
Kouros Acres . Edward Boyd, Esq. , appeared. The lot transferred
to Mr. Horton has been left out of the subdivision and must be
put back in.
On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to set 8:30 p.m. , March 27, 1978 at the Town Hall,
Main Road, Southold, New York, as the time and place for a public
hearing on the final map of the subdivision known as "Kouros
Acres" , owned by Olympia Kouros.

On motion made by Mr. Coyle, seconded by Mr. Wickham, it was
RESOLVED to grant approval to the map of the minor subdivisiT.

Clerk' s Office as to no further subdivision and that Section 2
will only be brought in as a major subdivision if it is ever
developed.

On motion made by Mr. Gordon, seconded by Mr. Wickham, it was
RESOLVED to request a letter from the Supt. of Highways
regarding the drainage in the subdivision known as "Peconic BaV
Cove" .
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
Mr. Wickham reported that he had discussed the flood plain
elevation with the town attorney and Supervisor Martocchia and was
told by them to go ahead and have Lawrence Tuthill, the town
engineer, make a study using Planning Board and Engineering funds.
It was also mentioned that Shelter Island and several other areas
were barred from flood insurance. The Planning Board wants the
town attorney contacted to find out what the reason is for this.
On motion made by Mr. Wickham, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board recommends
that a study be made to determine the accuracy of the Preliminary
Flood Plain map as presented to the Town of Southold by the flood
insurance people and also the accuracy of the statements made in
the teAt.
Vote of the Board: Ayes : Wickham, Raynor, Coyle , Gordon
Mrs. Tiedke reminded the Board of its invitation to a program
sponsored by the League of Women Voters and the North Fork
Environmental Council at which David Newton of the Cooperative
Extension Service will speak on Coastal Zone Management.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to set 8: 30 p.m. , Monday, April 17, 1978 at the
Town Hall, Main Road, Southold, New York, as the time and place
for a public hearing on the question of the approval of the final
map of the subdivision known as "Country Club Estates" .

at 7:30 p.m. , Tuesday, February 14, 1978 at the Town Hall, Main
Road, Southold, New York.

Mr. Wickham: Everything seems to be in order. This requires no
highways. It has two nights-of-way. Do the minutes- show what

conditions, if any, are imposed- on Section 11? 1)
Mr. Raynor: I thought it was discussed that number two should be
brought in as a major subdivision.
Mr. Wickham: I will ask for anyone that wishes to be heard in
opposition to this subdivision at this time. Hearing none, I
will ask for anyone that wishes to be heard in favor of it.

/�Mr. Raynor: About twenty to seven this evening, Mr. Murphy calle�
and said he would not be available and his attorney was tied up
in Riverhead.
Mr. Wickham: Would the board think well of adjourning the hearing
until some time when Mr. Murphy or his attorney can be present?
Mr. Coyle: We assume that there has been some contact made with
Catalano or the Cemetery Association. We have some record of
that, don't we?

�a 7nwicated that they have no money for expansion.
Mr. Raynor: We have the usual restriction about not dividing
into more than four lots.
Mr. Wickham: If there is no one that feels otherwise , I would
like to adjourn the hearing and get in at least a statement by
the developer or his attorney that Section II will not be developed
except as a major subdivision. This has been our uniform practice
and there is nothing in the file.
Mr. Coyle: Can you make them do that?
Mr. Wickham: Surely, it is an evasion of the major subdivision
requirements. If there is no objection, I will adjourn the hearing
until 7:30 p.m. on March 6, 1978.
Peter Blank, Jr. subdivision. Mr. Blank and Irving L. Price, Jr. ,
Esq. appeared.
Mr. Wickham read over the recommendations of the Soil and Water
Conservation District in Riverhead. In Item 2a of the report it
was indicated that the coarse textured subsoils and 4 to 5 feet
deep throughout the area. Mr. Blank indicated that he had put in
three test holes - one showed 1-1/2 feet deep, one was 2 feet and
one 2-1/2 feet but there was no five feet. The test holes were
done on lots 1, 10 and 15. t Mr. Price questioned the qualifications
of Mr. Esser who had made the report. Mr. Wickham answered that
he was the District Conservationist. The criteria prior to this
which has been used was established by Charles Barnett, formerly
of the Soil and Water Conservation District in Riverhead. Mr.
Blank said he had spoken to Mr. Irving Latham and he has a
differing opinion. Mr, Wickham said we have an inspector and he
decides how deep it should be. - Mr. Price asked, assuming this is-
the specification for swales, what is the developed supposed to
do and Mr. Wickham said they should get the opinion of their
excavator as to whether it is feasible or noti Mr. Price asked
what is the next step and Mr. Wickham answered that normally it
is presented to the Town Board to see if they will accept it because
it has to go to the Town Highway Committee and Town Highway
Superintendent. Mr. Price didn't think the -developer was obligated
to do anything on Orchard Street as it is part of the town highway
system. Mr. Raynor said this is probably why the District -
Conservationist asked for one-foot contours. Mr. Wickham said- the

covenants on the property to be subdivided.
On the portion that you are making into a minor
subdivision it will be necessary that you file with
the County of Suffolk covenants that the property will
never be resubdivided. I am enclosing a sample of the
covenants that are required.
The Planning Board also told you that it will
require covenants that if you ever subdivide the portion
that you now have in Christmas trees that you or any
future owners will have to come in for a major subdivision.
I am enclosing covenants from another subdivision which
you can use for a guide.

NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the
Town Law, public hearing will be held by the Southold Town
Planning Board at the Town Hall, Main Road, Southold, New York,
in said town on the 14th day of February, 1978, on the question

7:30 p.m. Approval of the minor subdivision of property of
Francis J. Murphy and Elizabeth H. Murphy situated at Laurel in
the Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a concrete monument marking the intersection of
the northerly line of land now or formerly of Dominick J. Catalano
and the westerly line of Aldrich Lane, which monument is located

I am in receipt Of six copies of map of minor subdivision
of Frank Murphy. It appears that you have complied with the
requests of the Planning Board with the exception that there is
no notation on the map that these lots will not be further
subdivided.
I am enclosing application uhich you must complete in
duplicate and return to this office together with a legal
description of the property and the fee in the amount of $40.
