Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., July 19, 2006 regarding the above matter:
WHE~EAS, En-Consultants, Inc. on behalf of ROBERT & PATRICIA MOELLER
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the! Southold Town Code, the Wetland Ordinance of the Town of Southold,
applidation dated June 19, 2006, and,
WHE~EAS, said application was referred to the Southold Town Conservation Advisory
Coun~il and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHE~EAS, a Public Hearing was held by the Town Trustees with respect to said
appliqation on July 19, 2006, at which time all interested persons were given an
oppo~unity to be heard, and,
WHE~EAS, the Board members have personally viewed and are familiar with the
premi~es in question and the surrounding area, and,
WHE~EAS, the Board has considered all the testimony and documentation submitted
conceJrning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of ROBERT &
PAT~ICIA MOELLER to remove and replace (in-place) approx. 72 linear ft. of existing
bulk~ead with vinyl bulkhead. Incidentally dredge (to recover lost backfill) approx. 25 cy.
sand Ifrom area up to 10' off bulkhead (to max. depth of -4' ALW) and use spoil for
back~i11landward of bulkhead. Remove and replace (in-kind/in-place) existing dockage
struc~ures, including a 6'X 6' cantilevered deck, 2'X 13' ramp, and 6'X 36' float, with the
cond~tion of a 10' non-turf buffer landward of the bulkhead, and a silt boom/turbidity
screE!n is installed during construction activities, and as depicted on the plan prepared
by E~-Consultants, Inc. dated June 9, 2006.
Permit to construct and complete project will expire two years from the date the permit
is sig~ed. Fees must be paid, if applicable, and permit issued within six months of the
date Of this notification.
Inspejctions are required at a fee of $50.00 per inspection. (See attached schedule.)

200$, the following recommendation was made:

RE~OLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of
tl).e Town of Southold Town Code and the Local Waterfront Revitalization Program
(t WRP) Policy Standards. Based upon the information provided on the L WRP
qonsistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
qONSISTENT with the Policy Standards and therefore is CONSISTENT with the
IJWRP provided that:
1. The installation of a silt boom/turbidity screen durin!!: construction activities
is required to minimize turbidity in the water column.
,
PUrsuant to Chapter 95, the Board of Trustees shall consider this recommendation in
pteparing its written determination regarding the consistency of the proposed action.

with fm application to the Board of Trustees for a Town Wetlands Permit to remove and replace
(in-~aCe) an existing timber bulkhead with a vinyl bulkhead and incidentally dredge a maximum
of2 cubic yards lost backfill material from a IO-foot area adjacent to the new bulkhead, which
shall be used as backfill landward of the new bulkhead.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for pennits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. * Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A DroDOsed action will be evaluated as to its significant
beneficial and adverse effects uoon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be eXDlained in detail. Iistinll both sUDDOrtinll and non-
sUDDOrtinll facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shaJ1 not be undertaken.
