Dear Nlr. Herrmann:
The ~oard of Town Trustees took the following action during its regular meeting held on
Wed.~ July 19, 2006 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of MAURICE JEZO applied to the Southold
Town ITrustees for a permit under the provisions of Chapter 275 of the South old Town
Code~ the Wetland Ordinance of the Town of Southold, application dated June 19,
2006,jand,
WHE*EAS, said application was referred to the South old Town Conservation Advisory
Coun~i1 and to the Local Waterfront Revitalization Program Coordinator for their findings
and r~commendations, and,
WHE*EAS, a Public Hearing was held by the Town Trustees with respect to said
applic~tion on July 19, 2006, at which time all interested persons were given an
opporlunity to be heard, and,
WHE~EAS, the Board members have personally viewed and are familiar with the
premi~es in question and the surrounding area, and,
WHE~EAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of MAURICE JEZO to
remove and replace (in-place) approx. 97 linear ft. of existing timber bulkhead with vinyl
bulkhead. Incidentally dredge (to recover lost backfill) approx. 25 cy. sand from area up
to 10' off bulkhead (to max. depth of -4' ALW) and use spoil for backfill landward of
bulkh .ad. Remove and replace (in-kindlin-place) existing dockage structures, including
(2) 6' : 20' floats, and with the condition of a 10' non-turf buffer landward of the
bulkh .ad and a silt boom/turbidity screen is installed during construction, and as
depic ed on the plan prepared by En-Consultants, Inc. dated June 9, 2006.
Permit to construct and complete project will expire two years from the date the permit
is sig~ed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspe!:;tions are required at a fee of $50.00 per inspection. (See attached schedule.)

Tl11e applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
T~e .applicant and the owner and occupants of the premises upon which the operations authorized by
th,s permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
it~ officers and employees to enter upon the premises where such operations are being conducted to
m~ke such inspections as the Town may deem necessary to insure that !!Jch operations are being con-
d~cted in conformity with this permit.
Tl11is operation will not substantially:
A. Adversely affect the wetlands of the town.
'B. Cause damage from erosion, turbidity or siltation.
:C. Cause saltwater intrusion into the fresh water resources of the town.
'd. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. I ncrease the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

1!he proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of
tlite Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
a~'ailable to me, it is my recommendation that the proposed action is generally
dONSISTENT with the Policy Standards and therefore is CONSISTENT with the
UWRP provided that:
I, The installation of a silt boom/turbidity screen durin!! construction activities
is required to minimize turbidity in the water column.
PIITsuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

1. All applicants for pennits" including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. "Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its silmificant
beneficial and adverse effects uoon the coastal area (which includes all of South old Town).
