The Board agrees with your request to change the trees to Zelkova's "Serrata", and to place them in the location shown on your plan dated October 8, 1991. As indicated in the Town Code 100-207, (copy enclosed), the sign must conform to the code within three (3) years from the date of enactment of the code which was February 25, 1989. The Board will now proceed with your application, by starting the State Environmental Quality Review process (SEQR) at its meeting on November 18, 1991. Please find enclosed a photo copy of site plan. Re- ferring to your markings to move curb line trees to areas you have indicated. (Marked in red). West (right) side is planted with existing Pine trees. Middle area is existing plants and rock-burm. The East side (right) is an existing 25' Birch tree. I sincerely feel your request will distort the already existing landscaping. I feel trees along the curb line is the best possi- bility. (See yellow highlights). For this purpose I recom- mend Zelkova's "Serrata". The Zelkova's have a low branch spread and are easily pruned from the overhead wires. After serving on the Southold Town Tree Committee for 3 years, and being in the tree business for 18 years, I feel this change would blend in with the existing landscaping. As I have been asked to help the Town with the trimming of street trees, I am sure you will rec- ognize this is my area of expertise. Your second concern in the letter of October 31, was the non-conformity of the sign submitted by my tenant. I have spoken with Mr. Victor Lessard, Superintendent of $outhold's Building Department. He informed me since the sign was in existence prior to the Master Plan and the square footage is 40', I should leave the sign as is. This was his opinion. A change of the sign would be a hardship on the tenant involved, especially as our economy is still in recession. Maybe, consideration should be given to the fact that there are 2 businesses on the premises? Also I feel that there are signs that are as large or larger in this area. I am respectfully sure the right decisions will be made. And will be awaiting your answer in this matter. Yours very truly, ~'Joseph P. Shipman Encl. /kas CONC. SIDE O~_ NYT CATCH ~L-.-CONC.
