PO Box 488 Hampton Bays, NY 11946 RE: LAURA WEIL 2760 VILLAGE LANE, ORIENT SCTM# 26-1-20.1 Dear Ms. Rigdon: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, June 19, 2013: WHEREAS, DKR Shores, Inc. on behalf of LAURA WEIL applied to the Southold Town Trustees for an Amendment to Wetland Permit #4349 and Coastal Erosion Permit #4349/26-1-20.1 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated May 8, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, • 2 • WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Wetland Permit #4349 and Coastal Erosion Permit #4349/26-1-20.1 to reconstruct 12' of an existing 29' return; to backfill area that was scoured out with t75 cubic yards of clean sand trucked in from an upland source; construct a 4'x3' set of "inset" beach access steps; to armor the return and 27' of shoreline with toe armor consisting of 1-2 ton stone on filter fabric; replant and restore area with Cape American beach grass plugs 18" on center; and as depicted on the site plan prepared by DKR Shores, Inc., last dated May 2, 2013 and stamped approved on June 19, 2013. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the LWRP Policies and therefore, CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Based upon the information provided on the LWRP Con~istencv Assessment Form submitted to this department as well as the records availrible to me, it is my recommendation that the proposed action is INCONSISTENT with I[he following LWRP Policv Standards• The fiction proposed timber to be treated with CCA Please review the use of the material to Chapter 97 regulations. 6.1 Protect and restore ecological quality throughout the Town of Southold. A. Avoid adverse changes to the Long Island Sound and the Peconic Bay ecosystems that would result from impairment of ecological quality as indicated by: 1. Physical loss of ecological components Physical loss is often the most obvious natural resource impairment to identify. It usually results from discrete actions, such as filling or excavating a wetland or clearing an upland forest community prior to development. The dock will protrude an additional 14 feet into Orient Harbor form the existing length Large, hlstorlc populations of eelgrass were found in the area and the area continues to _ exhibit prime habitat for eelerass. It is unknown if eelerass currently exists in the area where the dock is proposed to be extended. The physical impact will involve the shadine of bottom land where the dock is located and a PERMANENT loss in ample habitat for eelerass or even existine eelerass populations B. Protect and restore ecological quality by adhering to the following measures. 1. Maintain values associated with natural ecological communities. Each natural ecological community has associated values which contribute to the ecological quality of the Town of Southold. These values should be assessed on a case-by-case basis. 2. Retain and add indigenous plants to maintain and restore values of natural ecological communities. a. Protect existing indigenous plants from loss or disturbance to the extent practical. 3. Avoid fragmentation of ecological communities and maintain corridors to facilitate the free exchange of biological resources within and among communities. a. Each individual resource area should be maintained as a complete contiguous areas to protect the area's natural resource values. Specifically, actions that would fragment the ecological community into separate ecological islands should be avoided. b. Where fragmentation of ecological communities has already occurred, the adverse effects of fragmentation can be mitigated by maintaining or providing connecting corridors to allow exchange of biological resources. 4. Maintain ecological integrity of particular locales by maintaining structural and functional attributes, including normal variability, to provide for self-sustaining systems. 5. Avoid permanent adverse chance to ecological processes The proposed action would result in a physical loss of ecological components as indicated above. 9.4 Assure public access to public trust lands and navigable waters. A. Provide free and substantially unobstructed passage along public trust shorelands. B. Ensure that interference with passage along the shoreline is limited to the minimum extent necessary to gain access from the upland to the water. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 1. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navigation, recreation, and other public trust purposes, including the incidental rights of public anchoring. 2. To the best of their knov~iedge and belief the existing 25' long high-profile solid wooden groin depicted on the En-Consultants plan at the North end of the bulkhead, which is contiguous to and an integral part of the existing dock, never secured regulatory approvals when constructed and "was built under the dock to avoid the need for permits", according to the previous owner who had the wor1C performed. Consequently its legal status is dubious at best. ThisJgroin, like others in the vicinity, is responsible for substantial scouring and loss of beach sand and aggregates on its North side and captures mate~-ia1 on its South side. This can be readily seen in the 2004 black and whits aerial photograph (attached as page 4 w/ the subject eroded areas highlighted in red). Additionally, the site of the proposed is one of only two subskantially bulkheaded properties in the hamlet of Orient East of the Orient Yacht Club Dock originally constructed below MHW. Like the other property, the "Jim Douglass Homestead°, several hundred feet to it's South, their respective bulkheads were constructed beyond the existing natural coas$al contour and the existing line of retaining walls originally built on Oriexpt Harbor between 1890-1940. The North faces (returns) of these two bulk~eaded properties have created additional erosion for their Northerly neigk)bors much like the groins in the area. It is particularly noticeable adjacent to the Douglass property in the above-mentioned photograph because of the contrasting sand/water color but difficult to see adjacent to the Vl/eil property due to the beach stone there which is dark in color. Page 1 of 6 r However, unlike the bulkhead of the Douglass property, the Weil property had additional hard structures in the form of two high-profile wooden groins and one low profile stone groin constructed seaward of the bulkhead. The Northerly groin (25' long) and the Northerly bulkhead return (30'+long) act in concert to create a hard high profile North facing unit structure in excess of 55' lang. The attached circa 2002 color photograph (page 5), complements of "Google Earth", clearly depicts the loss of Bredemeyer beach as a consequence of this Weil bulkhead/groin structure and shows the landward incursion of Orient Harbor, which, if unchecked, may permanently turn the Bredemeyer concrete retaining wall into a bulkhead (it's footing has been exposed during two recenlt winters). The loss of Bredemeyer beach is easily seen when compared to the property to the immediate South of the Weil property. UnigLxe, physical evidence of this erosion is readily seen in this unaltered "Goode" photograph as a darkened green patch in the vicinity of the bulkhead and groin. It results from filamentous green algae having colonized the deeper bottom contours, having avoided regular wave action, which scours the rest of the beach "clean". On 6/ 17/06 there was up to 20" more sand'on the South side of the subject groin when compared to its North side. Additionally, the Bredemeyers are concerned that the proposed smooth surfaK:ed plastic bulkheading, may lead to still more beach erosion at the toe of the bulkhead compared with wood, which gets rough with age and colonization by marine organisms. L~a1~Standin~ in this Matter: I have been asked to act in the aforementioned matter on behalf of my pazeryts, John M. Bredemeyer, Jr. and Jeanne R. Bredemeyer. They reside at 2660 Village Lane, Orient, N.Y. which is the their principal residence located immediately North of and contiguous to the proposed site. (Letter of authorization is attached as page 6) Background/Discussion: My parents have lived on Village Lane, Orient and have owned the property immediately North of Ms. Weil for the last 42 years. To the best of their knowlledge and belief the existing 25' long high-profile solid wooden groin depic#.ed on the En-Consultants plan at the North end of the bulkhead, which is contiguous to and an integral part of the existing dock, never secured reguldtory approvals when constructed and "was built under the dock to avoid! the need for permits", according to the previous owner who had the work',performed. Consequently its legal status is dubious at best. This groin, like others in the vicinity, is responsible for substantial scouring and loss of beach sand and aggregates on its North side and captures mate#~ial on its South side. This can be readily seen in the 2004 black and white aerial photograph (attached as page 4 w/ the subject eroded areas highl$ghted in red). Additionally, the site of the proposed is one of only two substiantially bulkheaded properties in the hamlet of Orient East of the Orient Yacht Club Dock originally constructed below MHW. Like the other property, the "Jim Douglass Homestead", several hundred feet to it's South, their'respective bulkheads were constructed beyond the existing natural coastal contour and the existing line of retaining walls originally built on Orient Harbor between 1890-1940. The North faces (returns) of these two bulklheaded properties have created additional erosion for their Northerly neighbors much like the groins in the azea. It is particularly noticeable adjacent to the Douglass property in the above-mentioned photograph because of the contrasting sand/water color but difficult to see adjacent to the Weil property due to the beach stone there which is dark in color. Page 1 of 6 _ However, unlike the bulkhead of the Douglass property, the Weil property had additional hard structures in the form of two high-profile wooden groins and one low profile stone groin constructed seaward of the bulkhead. The Northerly groin (25' long) and the Northerly bulkhead return (30'+long) act in conce~°t to create a hard high profile North facing unit structure in excess of 55' lo#~g. The ap:tached circa 2002 color photograph (page 5), complements of "Google Earth'", clearly depicts the loss of Bredemeyer beach as a consequence of this Weil ~rulkhead/groin structure and shows the landward incursion of Orient Harbor, which, if unchecked, may permanently turn the Bredemeyer concrete retaining wall into a bulkhead (it's footing has been exposed during two recenn: winters). The loss of Bredemeyer beach is easily seen when compared to the property to the immediate South of the Weil property. Unigwe, physical evidence of this erosion is readily seen in this unaltered "Google" photograph as a darkened green patch in the vicinity of the bulkhead and groin. It results from filamentous green algae having colonized the deeper bottom contours, having avoided regular wave action, which scours the rest of the beach "clean". On 6/ 17/06 there was up to 20" more sand ion the South side of the subject groin when compared to its North side. Additionally, the Bredemeyers are concerned that the proposed smooth surfaG:ed plastic bulkheading, may lead to still more beach erosion at the toe of the bulkhead compared with wood, which gets rough with age and colonlization by marine organisms. The Bredemeyers are especially concerned that ill' their retaining wall is destroyed as a consequence of the continuing erosion caused by the existing and proposed structures, that a conventional bulkhead or stone revetment needed to protect their property would greatly detrat;t from aesthetics and property values in the area, possibly leading to a domino effect creating the need for other properties to the North to become bulklieaded. Historically, the Bredemeyer beach has been the most signifficant source of Bay Scallop harvest on Orient Harbor from wind-driven event's; its 110' of length yielding over 100 bushels on several occasions (with many fall and winter days yielding 10-30 bu./event)-the potential loss of publit: access to commonly held natural resources, were additional bulkheading necessary, would be a travesty. Page 2 of 6 ,i Relied Sought: 1.) Absent proof certain that the groin in question is a lawful structure, the Bredemeyers request that said Northerly groin on the Weil property, which is attacDied to the dock and bulkhead, be removed in its entirety as a condition of any permit to construct. If it is a lawful structure, they request it be reduced it height and length to become a functional "Low -profile" groin and that it be well armored with rip-rap/large stones on it's North side. 2.) Tl!ae Bredemeyers request that any permit granted Ms. Weil require the placement of rock armoring/ rip-rap of suitable size and quantity at the toe of the new bulkhead along the entirety of it's North face (return) starting at the Bredemeyer retaining wall and wrapping around the N/W corner of the bulkhhead and continuing to the beginning of the new dock so as to have the effecti of minimizing toe scour and other erosional forces. 3.) T)Ixe Bredemeyers have no objection to a new low profile rock groin less than 3' in height and 20' in length, (approximating the size of the other stone groin of Ms. Weil) being permitted and constructed to replace the existing hard'structure in question.
