Box 550 Orient, NY 11957 RE: 590 NORTH VIEW DR., ORIENT SCTM#13-1-5.1 Dear Mr. & Mrs. Winter: The Board of Town Trustees took the following action during its regular meeting held on Wed., June 21, 2006 regarding the above matter: WHEREAS, JOHN & NINA WINTER applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the South old Town Code, the Wetland Ordinance of the Town of Southold, application dated May 5,2006, and, WHEREAS, said application was referred to the South old Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21, 2006, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 . . WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of JOHN & NINA WINTER to install an in-ground swimming pool, buried propane tank, retaining wall, perimeter pool fence and garden shed, and install drywells to contain the pool backwash, and all as depicted on the survey prepared by Michael James Hillebrand last revised September 29, 2005 and landscaping plan received on May 5, 2006. PROPERT'( FACTS/DESCRIPTION: The applicants' 41,907+- square foot descrlbed parcel is vacant/With 129.50 feet along the north side of North View Drive, 315.20 feet In depth along the eastarlyslde line to the high water mark of the Long Island Sound (measured 6/26/03). The dIstance between the existing top of the bluff line to the front yard line along North View Drive Is 112 feet. BASIS OF APPLICATION: Variancas are requested under Sections 100-33 and 100-239.4A(1). based on . the Building Inspector's October 7, 2005 Notice of Disapproval concerning an accessory swimmIng. pool, proposed in a side yard instead of the code-required front yard or rear yard. and in a location' at less than 100 feet from the top of the bluff or bank of the Long Island Sound. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal Inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants which to construct a new 16'x32' free form swimmIng pool along the eastern edge of their side yard with setbacks at approximately 25' from the front property line and approximately 55' from the top of the bluff that runs along the northern edge of thelr.rear yard, as shown on the June 26, 2003 survey by Hillebrand Land Surveying, P.C. with the September 29, 2005 revisions fOf the proposed swimming pool. The topography of the site Is such that the proposed location for the swimming pool would be well below the road grade and completely out of sight from off the, premises. Extensive existing landscaping with native ornamentals, shrubs and evergraen trees creates further privacy from adjacent propertlesand'theroad frontage. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances from code required locations and setbacks for an accessory swimming pool. Due to the close proximity of the owner/applicants' house to the bluff, they have Installed several leaching pools and drywells to direct runoff from ground water, gutters and downspouts In their front yard, westerly side yard and rear yard. The only available location for the proposed swlmmlng.pool Is within the rernalFllng eaStedy<.al~~.yard. To further ensure bluff stability. they propose to locate part of the swimming poollri the southeast corner of their front yard to keep the pool as far away from the bluff as possible. The proposed pool will be set back 55' from the bluff. which Is the rear setback for the existing house. It was also noted that houses to the east of the owner/applicants' also have less than 25 foot set backs In their front yards. 3. The variance granted herein is not substantial. 4. The difficulty was created when the applicant decided to construct a new swimming pool on a parcel of land that has limited building area. 5. No" evidence has been submitted to suggest that the proposed swimming pool will have an adverse Impact on physical or environmental conditions In the neighborhood. Written testimony dated January 25, 2006 from Polly L. Weigand. Soli District Technician with Suffolk County, states that "As the bluff Is In good condition and the pool Is sited as far as possible from the bluff, installation Is feasible." 6. G.rant of the requested variance is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an in-ground accessory swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member'Dlnlzlo, and duly carried to GRANT the variances as applied for, as shown on the June 26, 2003 survey by Hillebrand Land Surveying, P.C. amended September 29,2005. subject to the following Conditions: 1. Upon initiating processing, it was identified that a Tidal Wetlands Letter of Non-Jurisdiction (copy enclosed), Application # 1-4738-03064/0000 I, was issued on 9/ I 2/02 for the property landward of the topographic crest of the bluff, labeled as the top of the bank on the survey prepared by John T. Metzger last revised on 7/5/02. The presently proposed structure(s) is also landward of this previously determined jurisdictional boundary and therefore does not require a permit from this Department. Accordingly, the Application and supporting materials are being returned. Please be advised that this office does not make repeated determinations for the same site. At this site, previous excavation has OCCWTed into the slope of the hill in order to site the house. To stabilize this soil, a 3-foot slate retaining wall with landscaping has been installed. At least an 8-foot hish vertical face will be created due to the excavation. Therefore a retaining wall of equivalent height of this vertical face should be installed apinst the face. The proposed in ground pool, dry wells, retaining wall, pool filter, waterfall & heater, buried propane tank, perimeter fence and garden shed are on non- _ wetlands area and all at least 55 feet from the top of the bluff. The present residential home is 55.4 feet from the top of the bluff and has a certificate of occupancy. There are no trees on the pool site which need to be removed. The site is at present sparsely vegetated and - several ornamental shrubs have been temporarily planted. The dry wells shall be installed near the pool to allow for proper disposal of pool water and rain run off. Therefore, no water - run off at any time shall have any impact on the bluff. During construction careful precautions of placing straw bales just north of the excavation site shall prevent any soil or water to run _ off towards the top of the bluff. Hand excavation and small mechanical bobcat excavator shall be used to minimize any collateral soil disturbance. Access to the pool site will be directly from the street. Excavated material shall be used to fill in areas adjacent to the pool - for proper grade and excess material shall be carried off site directly southward, away from the direction of the bluff, right to the road. The 500 gallon buried propane tank will be to - code. The waterfall shall be decorative in nature and all its water closed circulated into the pool. The easterly retaining vertical face retaining wall is necessary to ensure the stability of _ the dirt wall, thereby preventing erosion. The plan is to re-vegetate the pool site according to the enclosed landscaping plans with shrubs and bushes to stabilize the soil, prevent erosion and improve the esthetic appearance of the site and home. Perimeter fencing shall - be installed per code which will not encroach upon the top of the bluff. All these recommendations and plans were made by the County of Suffolk, Soil and Conservation - District on January 25, 2006 and became the basis for the ZBA's approval for the in ground pool variance grant. Suffolk County found that "the bluff is fully vegetated and in good condition. As the bluff is in good condition and pool is sited as far as possible from the bluff, installation is feasible". The purpose of the proposed operations is to be granted the permits to I?lace a modest in ground swimming pool, buried propane tank, standard pool equipment (filter, pump, heater waterfall), dry wen, retaining wall, perimeter fence and garden shed all on the non-wetlands portion of our residential property. Our property is a waterfront bluff site and the existing home and proposed actions are at an elevation of 90 feet high up on a bluff and 258 feet from the high tide line. The present home is newly constructed (Certificate of Occupancy 5f2EW5) and has the proper permits in place to have been constructed at a 55 foot setback from the top of the bluff. On February 8, 2006 Chairwoman Oliva and the Southold Zoning Board of Appeals granted us a Variance to construct and place the proposed in ground swimming pool at a setback of 55 feet to the existing bluff as follows: "The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances from code required locations and setbacks for an accessory swimming pool. Due to the close prOXImity of the owner/applicants' house to the bluff, they have installed several leaching pools and drywells to direct runoff from ground water, gutters and down spouts in their front yard, westerly side yard and rear yard. The only available location for the proposed swimming pool is within the remaining easterly side yard. To further ensure bluff stability, they propose to locate part of the swimming pool in the southeast corner of their front yard to keep the pool as far away from the bluff as possible. The proposed pool will be set back 55 feet from the bluff, which is the rear setback for the existing house. It was also noted that houses to the east of the owner/applicants' also have less than 25 foot set backs in their front yards. No evidence has been submitted to suggest that the oroposed swimming 0001 will have , . . an adverse imoact on environmental conditions in the neighborhood. The County of Suffolk Soil and Conservation District's letter of January 25, 2006 recommends that "dry wellslfeaching basins should be installed near the pool to allow for proper disposal of pool water." We absolutely intend to comply with such notice and have marked on both the survey and the poolJlandscapin~ design plan the location of the dry wells relative to the pool's placement. Suffolk SOil District's letter further states that in order "to facilitate installation of the pool, the landscaping and stonewall will need to be removed and further excavation into the hill will be required. At least an 8 foot high vertical face will be created due to the excavation. Therefore a retaining wall of equivalent height of this vertical face should be installed against the face". We absolutely intend to comply with this additional notice and the survey along with the poolJlandscaping design Indicates the location of the retaining wall. The proposed size of the in ground swimming pool's interior dimensions are 16 x 32 feet, free fonn with a closed circulated waterfall. The depth of the finished pool will be 6 feet. The buried propane tank is 500 gallons. The amount of material which will be excavated will be 92 112 cubic yards (in ground pool: 90 cubic yards, in ground propane tank: 2 112 cubic yards). The pool excavation depth will be 6112 feet. Hand excavation and small bob cat excavator will be used. Straw bales shall be placed at the project site to prevent any possibility of silt or water runoff. Access to the site, material removal along with project construction will not have any adverse effects on the environment since the nearby street provides a short and direct path. The pool site is totally flagged. The proposed garden shed size is 10 x 14 and will be also set back 55 feet from top of bluff, as marked on the survey. The dry well, pool mechanicals and pool perimeter fence locations are all marked on the surVey. There will be no need to remove any trees from the site and the property will be professionally re-Iandscaped as per the landscaping design attached in order to stabilize the soil, prevent erosion and improve the esthetic appearance of the home site for the . ( . . community. In consultation with the Suffolk County Soil and Water Conservation Division, in December 2005 we have planted 2000 culms of Cape American Beach Grass on the north side of our new state-of-the-art interlocking retaining wall to further stabilize the bluff and environment. Our intention is to respect and maintain the integrity of the bluff and surrounding environment. There are no known permits that have been applied for, are pending, and have been granted by Suffolk County Health Department or USACOE. It is strongly believed that no effects on wetlands and tidal waters of the town may result by reason of such proposed operations. (The body of water is Long Island Sound). There are no known prior operations conducted on the premises in question (other than the existing home) and no prior licenses or permits (other than DEC letter of non-jurisdiction and ZBA Variance approval for in ground pool) to erect structures or deposit fill on said premises and no such permits or licenses were ever revoked or suspended by a governmental agency. We respectfully request that the Board show leniency and grant us waiver of certain requirements of Article 2, paragraphs 97-21 A 8, 11, and 14. We were provide a certified topographical map survey of two foot intervals by the Department of Environmental Conservation which is more than 1 year old, however, we believe that the top of the bluff as represented has not at all changed location as compared to the more recent 2005 amended survey. The DEC maintains its position of non-jurisdiction based on the documentary evidence it presented us, which we in turn, present to the Board. Paragraphs 11 & 14 are, we believe, Inapplicable to the project. In such event that the Board considers otherwise, again we respectfully request that such requirements be waived for this residential pool. We encourage a site visit by the Board to complement the application materials. We believe, as wen as the ZBA and Suffolk County that the project IS feasible and shall not cause any adverse environmental effects on the bluff. All necessary precautions during construction shall be taken. Our intention is to make sure our home and prOpOsed project remains safe by maintaining and not disturbing the well vegetated bluff. Our time frame is such that we would like to place the garden shed in July 2006 and commence the pool project in June 2007 with anticipated pool, landscaping and total project completion by October 2007.
