Dear Mr. Kasper:
The following actions were taken by the $outhold Town Planning
Board, Tuesday, June 15, 1982.
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in
the matter of the minor subdivision of Henry Tac a Et al, located
at Laurel. An initial determination of nonsignificance has been
made.
RESOLVED that the Southold Town Planning Board approve a set-off
(106-13) on the minor subdivision map of Henry Tacat Et al,located
at Laurel, dated May 14, 1982 with a condition that covenants be
filed with the County Clerk's Office stating no further subdivision
will be made on the property and receipt of the filing fee in the
amount of $50.
Please forward six (6) copies of said map to this office so that we
might expedite referrals to state and county agencies. At such
time as the above conditions are met and completion of the State
Environmental Quality Review Act, the chairman will endorse approval
on the subdivision map.

on the property of Leander B. Glover, located at Cutchogue,
following recommendations:
1. The entire parcel abutting Cox's Lane to be set-off
and purchased by the Town of Southold.
2. The ingress and egress to be utilized for emergency
use.
If necessary, additional buffering on Cox's Lane to
insure the residents on Matthews Lane from any harmful
effects.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski

After discussion with the Town Attorney, he stated that this would /

WHEREAS,
a certain parcel of land

the Declarant is the owner in fee simple of
situate at Greenport, Town of Southold,
and designated on the Suffolk County Tax

by the Declarant by deed dated October 13, 1977 and recorded in the

WHEREAS, the Declarant intends to set off from said
Premises for residential purposes a six (6) acre part of said
premises described on Exhibit A hereof and to subject said six

order to preserve the maximum open space, natural scenic beauty and
natural vegatation and to prevent overcrowding and to conserve the
ground water resources of the Town of Southold; and
WHEREAS, the Declarant had applied to the Planning Board
of the Town of Southold for its consent to said set off and
development of the said six (6) acre part of said Premises.
NOW, THEREFORE, the Declarant does hereby declare that
the aforesaid six (6) acre parcel and every portion thereof is
hereby held and shall be conveyed subject to the conditions,
covenants and restrictions hereinafter set forth, and that every
purchaser of said Premises, or any portion thereof, by the accep-
tance of a deed thereto, covenants and agrees that the premises
so purchased shall be held subject to the covenants, conditions,
and restrictions hereinafter set forth.
1. No lot or plot as shown and designated on the
Premises described as Exhibit A hereof shall be subdivided.
2. That all of the covenants, conditions and restrictions
contained herein shall be construed as real covenants running with
the land and shall continue and remain in full force and effect at
all times as against the owner of the premises or any portion
thereof in perpetuity. Said covenants, conditions and restrictions
shall be binding upon, inure to the benefit of and be enforceable
by the Declarant, their heirs, successors and assigns; any owner of
any portion of the aforesaid premises, their heirs, successors and

and assigns, and the Town of Southold, and its successors and
assigns, and the failure of any of the foregoing to enforce any
of such covenants, conditions and restrictions shall in no event
be deemed a waiver of the right to do so thereafter.

Dear Mr. Kasper:
We are in receipt of your reply to our letter dated
September 29, 1982 regarding covenants and restrictions
on the above captioned property.
This letter creates a bit of confusion; you state
that such covenants and restrictions would be a problem
for perspective purchasers, yet we are in receipt, from
the office of William Wickham, Esq., a copy of the filed
covenants and restrictions stating no further subdivision
will be made on the six-acre parcel set off by this board.
As we did not place this restriction on the remaining
59.7 parcel, it appears that the conditions of the approval
have been met.
A prompt reply would be greatly appreciated as a build-
ing permit is being withheld until this matter is resolved.

Dear Mr. Raynor:
I am in receipt of your letter, reminding me of the
Covenants and Restrictions necessary in order to have the
Chairman sign and approve of the Map and Resolution.
We have reviewed your request as to the Covenants and
Restrictions and this, apparently is too much of a risk for us
to take at this time with the Map that was originally presented
to you for approval. The cost of developing is very excessive,
as you probably know, and we do not want to commence with a
problem that we may regret in these trying times.
We have felt out some of the prospective purchasers and
this restriction on the Covenant becomes a problem to them in
financing today because of the tight money situation. We,
therefore, have decided to revise that map and I now have it
pretty well completed by Alden Young.
I would like to set up an appointment to see you personally,
or your Board Members~ to review what we have and get some ex-
pression of opinion as to what and how we should proceed with
this map, after certain waivers can be accepted. I would apprec-
iate an appointment at your earliest convenience so that we could
resolve this portion of the map as soon as possible. We will
either continue with the sub-division or we will abandon the idea
and stick to the farming end of it alone.
Your early response would be appreciated.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Henry Taca, Et al, is a two-lot
subdivision located at Laurel.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Based upon the information available, it appears that con-
itions are suitable for individual sewage disposal systems.
However, problems may be encountered with obtaining potable
water due to the effects of agriculture on the groundwater
supply.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Dear Mr. Raynor:
At your request, I am submitting to you for your Board's
consideration, a release of the 6 acre parcel which you and I
discussed at your office recently, for the purchaser of this
parcel, being Thomas Wowak, an old time farmer in this area.
As I pointed out to you, it is imperative that he have
this parcel released very soon because his farm has been sold
and he was instructed to leave and quit the premises as soon as
possible since the present owner wishes to make use of this
property for himself. Mr. Wowak is confronted with a problem
of machinery and he intends to use the barn for that purpose on
this particular parcel which he is purchasing. He plans to build
himself a home fronting on Route 25.
It would be greatly appreciated if you would give us a
positive answer without going through the mechanics of a minor
sub-division. Mr. Wowak is agreeable to restricting himself
with a Covenant which will be necessary to sign so that this
parcel will not be further sub-divided in the future. This
is in agreement with Mr. Wowak's thinking.
Therefore, I will carry on the other requirements such as
getfing approvals from the State, if necessary, for a curb cut.
It would probably expedite matters if I walk these things through.
I'd be very happy to work with the Planning Board to expedite
matters.
Your attention would be greatly appreciated. An early reply
would be very helpful for Mr. Wowak to make his decision to pur-
chase this parcel or not.
