Pursuant to Sections A14-24, Article XIV of Suffolk County Administrative Code
pursuant to Sections A14-24, Article XIV of the Suffolk County Administrative
Code, a referral was received by the Suffolk County Planning Commission on
May 14, 1997, with respect to a proposed plat entitled, "Gerard E. Neumann &
Kathleen A, Neumann" submitted by the Town of Southo[d Planning Board
affecting premises located on the southerly side of Mill Road, 826.89 feet
westerly from Reeve Road, Mattituck, and
WHEREAS,
said referral was considered by the Suffolk County Planning Commission at its
meeting on June 4, 1997, and
WHEREAS, the Commission has voted to disapprove said referral, Be It Therefore
RESOLVED, That the Suffolk County Planning Commission hereby approves and adopts the
report of its staff, as the report of the Commission, Be It Further
RESOLVED, That said proposed plat is disapproved because of the following reason:
The proposed subdivision will result in the creation of a landlocked parcel;
that is, a parcel that does not have frontage on an existing or proposed public
road. The creation of such a lot is contrary to good subdivision layout
principles and creates problems as far as access by emergency and service
equipment is concerned. This lack of access could result in health, safety and
welfare problems for the future residents of the landlocked lot, not to mention
potential disputes over the use and maintenance of any right-of-way over an
adjacent parcel that may be created for the purpose of access.
Creation of a landlocked lot also places the Zoning Board of Appeals in the
awkward position of having to grant a building permit for the lot under Section

Attached is a sketch plan for a proposed clustered set-offofa 1.57 acre unimproved lot
from a 24.9 acre parcel.
The property abuts the eastern shoreline of Mattituck Creek. The application was
originally submitted in 1997. Therefore, the application needs to be updated to current
regulations. The Planning Board has alerted the applicant to the problems with the
wetland setback and location of the proposed well. The issues were outlined in a March
12, 2002 letter that is attached for your perusal.
Unrelated to the set-off, Mr. King and I have discussed the problems with the sheet
runoff plaguing Mill Road. The applicant has also expressed concerns regarding this
issue and has indicated that he would be willing to discuss remediation measures with the
Town Trustees.
Please indicate if the sketch plan correctly shows the delineated wetland lines and meets
all Southold Town Trustees regulations.

The Planning Board treated the application as a cluster set-off. The wetland
and upland acreages for the set-off lot must be calculated separately and
labeled on the map. The wetland acreage, although a part of the lot acreage,
is not recognized as a part of the buildable acreage of the lot.
Consequently, before determining the yield for any future action on the
remaining 23.33 acre parcel, an amount equal to 80,000 square feet, minus
the buildable upland area of the set off parcel, must be excluded from the
yield.
The map must also contain a notation that the subdivision has been designed
as a cluster subdivision and also must contain a notation stating the above-
mentioned condition pertaining to the future yield of the property.
Additionally, the notation in regard to the determination of yield must be
contained in a Declaration of Covenants and Restrictions.

Sketch plan approval is conditional upon the submission of final maps within six months
of the date of sketch plan approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final maps, six (6) paper prints and
two (2) mylars, must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.
The Planning Board has reviewed the property and has decided that it is inadequate for
a reservation of land for park and playground use. Therefore, a cash payment in lieu of
land reservation will be required. The amount to be deposited with the Town Board
shall be $5,000 ($5,000 per vacant lot in the subdivision). Payment is required prior any

L The existing site use is vacant land. The proposed use is a single family home approXnnately
2800 square feet with normal Water requirements.

4. Well specifications will be developed based on a single family's requirements. The water fi'om
the well on the adjacent land where we have lived for the past 30 summers has been tested and is
without problems.
5. No adverse impact is anticipated. Existing trees and wetlands will be preserved. Landscaping
will employ drought tolenmt plants.
Please note that the referenced application was filed on November 9, 200 1 and was complete based
on the forms provided by the Planning Board at that time. It is the same plan that was tentatively
approved by the Planning Board in 1997. We have been asked by Southnld (James McMhon) to
consider the construction of bexms on our property to reduce the nm-off of silt into the Mattituck

Dear Mr. Neumann:
Water supply and quality within the Town of Southold is a serious community issue. Public water supply,
although provided by the Suffolk County Water Authority, is determined through the current and
projected use of the community. To date, the supply does not meet the demand, however, water use is
controlled by an individuals' actions and can often be mitigated through numerous water conservation
measures implemented during the planning process.
Water quality is very difficult to control. Although point source pollution can usually be traced to its
origin, non-point source pollution is boundless and one of the largest threats to local environmental and
community health. Non-point source pollution has been identified as the primary cause of water quality
degradation in more than 90 pement of New York State's impaired water bodies. In the Town of
Southold, localized well and surface water contamination already exists.
Consequently, the Town of Southold Planning Board in cooperation with the Suffolk County Water
Authority now requires the completion and submittal of the attached Environmental Assessment Form,
Section D. Informational Details and Water Supply Narrative as part of the SEQR review process. Until a
completed Environmental Assessment Form, Section D. Informational Details and Water Supply
Narrative is submitted, applications will be considered incomplete and the SEQR review will not proceed.

Dear Mr. Neumann:
The following resolutions were adopted by the Southold Town Planning Board at
. a meeting heJd~0r~ Monday, May 12, 1997:
BE IT RESOLVED that the Southold Town Planning Board start the lead agency
coordination process on this unlisted action.
BE IT RESOLVED that the Southold Town Planning Board grant sketch approval
on the map dated December 12, 1996, with the following conditions:
1. The upland area and the wetland area for the set off parcel must be shown
on the map.
2. The Planning Board is treating the set off proposal as a cluster subdivision.
Therefore, before determining the yield for any future subdivision of the
remaining 23.33 acre parcel, an amount equal to 80,000 square feet minus
the upland area of the set off parcel must be subtracted from the total aj'ea
of the parcel to be subdivided.
The final map must contain a notation that the subdivision has been
designed as a cluster subdivision and must contain a notation stating the
above mentioned condition pertaining to the future yield of the property.
The notation in regard to the determination of yield must be contained in a
Declaration of Covenants and Restrictions.
A building envelope indicating front, rear and side yard setbacks must be -
shown for the set off parcel.

4. Front, rear and side yards must be shown for the existing house.
5. The proposed parcels must be shown as Lot 1 and Lot 2.
6. The 75' wetland setback must be shown as a 75' wetland buffer. This area
shall remain in its present state. Maintenance of the natural vegetation
shall be the only use or activity allowed within this area. This condition
shall be contained in a Declaration of Covenants and Restrictions.
Sketch plan approval is conditional upon submission of final maps within six
months of the date of sketch approval, unless an extension of time is requested
by the applicant, and granted by the Planning Board. The final maps, six (6)
paper prints and two (2) mylars, must contain a current stamp of Health
Department approval and must be submitted before a final public hearing will be
set.
The sketch plan has been referred to the Suffolk County Planning Commission, .
the Town Trustees, the Town!s Engineering Inspector and the Mattituck Fire
Department for review. You will be notified when the Planning Board receives
responses from these agencies if any additional items are required.
Th~ Planning,Board may require covenants and restrictions in addition to the
ones mentioned above, upon review of the reports from the above mentioned
agencies and upon review of the final maps. You will be notified if any additional
covenants and restrictions are required.
Draft deeds for each parcel must be submitted as part of the final submission.
Each deed must describe the right of way and the provisions for access.
The Planning Board has reviewed the property and has decided that it is
inadequate in size for a reservation of land for park and playground use.
Therefore, a cash payment in lieu of land reservation will be required as per
Section A 106-38 (e) of the Town Code. The amount to be deposited with the
Town Board shall be $2,000 (two thousand dollars per vacant lot in the
subdivision). Payment is required prior to any final endorsement of the
subdivision.
