The following actions were taken by the Southold Town Planning
Board at a regular meeting held on July 13 , 1981.
RESOLVED to approve the sketch map of the minor subdivision ..of
Ilene Klasfeld.
RESOLVED to assume lead agency role in regard to the State
Environmental Quality Review Act in the matter of the minor sub-
division of Ilene Klasfeld.
In order to proceed with this determination of lead agency,
the Southold Town Planning Board would like to request that six (6)
more maps be drawn up and sent to us.

and copy of the map of the minor subdivision of Ilene Klasfeld
at Greenport, Town of Southold, for Mr. and Mrs . Jon Kalsfeld.
This project is unlisted and an initial determination of
non-significance has been made. We wish to coordinate this
action to confirm our initial determination in our role as lead
agency.
May we have your views on this matter. Written comments
on this project will be received at this office until August 3
1981. We shall interpret lack of response to mean there is no
objection by your agency in regard to the State Environmental
Quality Review Act.

Re: Minor Subdivision of Property of Klasfeld
Dear Henry:
I have looked at the above captioned minor subdivision map and the letter of
John J. Munze 1 dated June 30, 1981. You have asked that I give you an opinion
as to the type of Covenants and Restrictions which would be necessary for the
subdivision.
It would appear that the entire 28 acre parcel is to be divided into four lots and
that each lot has access to a public highway and each lot has frontage on Long
Island Sound. It also appears from the map that there is a bluff of approximately
40 feet in height.
It would seem that a Declaration of Covenants and Restrictions should be executed
by the owners which would (a) prohibit the further subdivision of the property,
(b) Provide for a set back of buildings from the bluff and (c) provide protection
against erosion of the bluff. These are the three areas which come to my mind.
It may well be that the Planning Board wishes to impose further restrictions.
I have prepared a Declaration of Covenants and Restrictions and the Declaration
is enclosed herewith. The Declaration prohibits further subdivision; requires
any structures to be set back from the bluff, and provides protection against
the erosion of the bluff by preventing the removal of vegetation or stairways or
other structures without the approval of the Planning Board, The Declaration
also provides that it run with the land; continues in perpetuity; is enforceable
by any owner of all or a portion of the property as well as the Town of Southold.

I would suggest that the Planning Board review this Declaration and if they believe
that further covenants and restrictions should be imposed, they may be added.
However, you must keep in mind that this Declaration is intended to remain
in effect in perpetuity and, therefore, in considering any further restriction,
it must be kept in mind that they will always remain a burden on the property.

DECLARATION OF COVENANTS
AND RESTRICTIONS
THIS INDENTURE made this day of 1981, by
residing at
hereinafter called the Declarant.
WHEREAS, the Declarant is the owner in fee simple of a certain parcel of land
situate at Greenport, Town of Southold, Suffolk County, New York, and designated on
the Suffolk County Tax Map as District 1000, Section 033, Block 3 and Lot 19 contain-
ing approximately 28 acres, being the same premises acquired by the Declarant by
deed dated and recorded in the Suffolk County Clerk's Office on
in Liber of deeds at page and referred to
herein as the "premises" and
WHEREAS, the Declarant intends to subdivide said premises for residential
purposes and desires to subject said premises to certain conditions, covenants and
restrictions in order to preserve the maximum open space, natural scenic beauty
and natural vegetation and to prevent overcrowding and to conserve the ground water
resources of the Town of Southold, and
WHEREAS, the Declarant had applied to the Planning Board of the Town of
Southold for approval of the subdivision and development of the premises as a Minor
Subdivision, to contain not more than four (4) lots or parcels.
NOW, THEREFORE, the Declarant does hereby declare that the aforesaid
premises and every portion thereof is hereby held and shall be conveyed subject to
the conditions, covenants and restrictions hereinafter set forth, and that every
purchaser of said premises, or any portion thereof, by the acceptance of a deed
thereto, covenants and agrees that the premises so purchased shall be held subject
to the covenants, conditions, and restrictions hereinafter set forth.
1. No lot or plot as shown and designated on the Minor Subdivision map
approved by and filed with the Southold Town Planning Board shall be further sub-
divided.
2. No dwelling, or other building or structure shall be erected or maintained
within feet of the top of the bluff or cliff adjacent to Long Island Sound.
3. In order to prevent the erosion of the bluff or cliff adjacent to Long Island
Sound, no vegetation shall be removed therefrom nor disturbed in any manner, nor
shall any stairways, paths or other structures be placed or maintained thereon,
without the written approval of the Southold Town Planning Board.
4. That all of the covenants, conditions and restrictions contained herein shall
be construed as real covenants running with the land and shall continue and remain
in full force and effect at all times as against the owner of the premises or any
portion thereof in perpetuity. Said covenants, conditions and restrictions shall be
binding upon, inure to the benefit of and be enforceable by the Declarant, their heirs,
successors and assigns; any owner of any portion of the aforesaid premises, their
heirs, successors and assigns, and the Town of Southold, and its successors and
assigns, and the failure of any of the foregoing to enforce any of such covenants,
conditions and restrictions shall in no event be deemed a waiver of the right to do so
thereafter.

JOHN J. MUNZEL, being duly sworn, deposes and says :
1 . That he is the attorney for Petitioner , ILENE KLASFELD, and
makes this affidavit rather than the Petitioner as she presently resid s
in Florida at 690 Golden Harbour Drive , Boca Raton. Florida.
2 . Your deponent is fully familiar with the facts and circum-
stances herein.
3 . The proposal is for a minor subdivision as more fully set
forth in the minor subdivision plan of Klasfeld property dated June 15 ,
1981 , prepared by Young & Young.
4 . It would be noted that the property abuts Long Island Sound
for a distance of 644 . 22 feet , has a general depth of approximately
1860 feet with an additional 150 feet by 92 feet portion abutting
Middle Road.
5 . The property lies west of McCann Lane and East of Greenhill
Lane and consists of approximately 28 acres .
6 . The proposal is for a minor subdivision consisting of two
lots of three (3) acres each, and one lot- of 13 .3 acres and a fourth
lot of 9 acres .
7 . The three (3) acre lots shall be located on the easterly and
westerly portions of the property with the larger lots dividing the
center of the property. The extra acreage on the one lot consisting

of 13 . 3 acres approximately results from a greater depth at the south
end of the property than any diminution of the width of the property.
8. All four lots shall have approximately 165 foot frontage on
Long Island Sound.
9 . Since this is a minor subdivision of substantially large lots ,
sanitation and water supply facilities should not be required as the
properties will use individual wells and cesspool facilities .
10 . There are no proposed covenant or deed restrictions for the
lots .
11 . The parcel lies in the zoning district designated as Resi-
dence A requiring 40 , 000 square feet per plot, together with minimum
150 feet frontage .
12 . It is obvious from the proposed minor subdivision that the
requirements of Residence A zoning are more than adequately provided
for. The following are the names of all adjoining subdivisions and/or
owners of record of all adjoining property:
To the East : Eastern Shores Section 1
To the West : Eastern Shores Sections 4 and 5
To the South: Edgar Burt , E .C . Keough, M. S . Burt and R. Gallitel i.
13. No parQels o, land are proposed to be dedicated for public
use .
14 . The topography of the land is basically open meadow with a
natural spring located toward the southerly portion of the property.
Upon information and belief , the pond had once been used for watering
livestock and it is the intention to develop the two large parcels as

small farms providing for the water to be used by any livestock that
might be kept there.
15 . There are no easements , buildings , water courses , marshes ,
rock outcrops , wooded areas , trees with a diameter of twelve (12)
inches or more as measured three (3) feet above the base of the trunk,
or any significant feature of the proposed subdivision, other than the
land as it presently exists with a forty (40) foot cliff leading from
the beach.
16 . It is not the intention to disturb the cliff features in any
manner whatsoever , not is it the intention to disturb the natural ponds
on the property or natural drainage of the property in any manner.
17 . There are no existing sewers , water mains , culverts or drain
on the property.
18 . The probable future drainage layout of the entire tract shall
be to perculate into the ground due to the minimal coverage of the
land.
19. It is the opinion of the subdivider that the development of
the property in accordance with the plan proposed will be a benefit to
the surrounding community , leaving most of the land in its natural
state as it has been for the last eight (8) years that your deponent
has owned the property and since farming was no longer done on the
property, which upon information and belief was ,many. years ago.
20 . The land lends itself ideally to "gentleman farms" and it is
the intention of the developer to develop the property along the lines
indicated.
21 . As is self evident , there will be no` burden plated upon the
population by the density of use , nor upon any of the municipal facilit e:

as upon information and belief there will be only four homes built on
the entire parcel .
22 . As can be seen, the land slopes from the forty (40) foot
grade level by Sound Drive toward Middle Road with the natural pond to
catch any water run-off.
23 . No previous application for the relief requested herein has
been made .
WHEREFORE , it is respectfully reques the minor subdivision
be granted.
