The following action was taken by the Southold Town Planning
Board at a regular meeting held Monday, March 22, 1982:
RESOLVED that the Southold Town Planning Board declare itself
lead aqency in regard to the State Environmental Quality
Review Act in the matter of the minor subdivision of property
entitled Hubert and Catherine Harren, located at Mattituck.
An initial determination of nonsignificance has been made.
The Board will make a field inspection on this property prior
to the next Planning Board meeting April 12, 1982. We will
advise you of any other actions taken by this Board.

in the review of the aqove-mentioned minor .subdivision and its

REASON FOR APPEAL
Continued
1 STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the applicants purchased the properties by t:w:> deeds, copies
of which are attached, and now wish to sell the easterly or vacant lot but are
unable to do so. To retain both lots in an area where the adjoining lots on
the Map of Saltaire Estates are nuch srraller would be impracticable, and to eventually
sell such a large parcel in the area would be virtually inpossible.
2. The hardship created is UNIQUE and is not shored by 011 properties alike in the immediate
vicinity of this property and in this use district because the lots men separated would have
frontage of 150 feet each. 'Ihe easterly lot would have an area of 30,000 feet,
and the westerly lot would have an area of 34,000. 'Ihe adjoining lots on bbth the
north and south side have areas between 20,000 and 22,500 square feet.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the granting of the variance would merely make
the easterly lot buildable and would contain a larger area than the lots on the
Map of Saltaire Estates.

Covenants & Restrictions;
1. No Buildings other than one private dwelling for the use and occupancy of one
family and one private garage shall be erected on anyone lot. Any dwelling erected
thereon shall have a first floor area of not less than 800 sq. ft. and any detached

garags erected thereon shall cost not less than $750.00.
2. The premises shall not be used for the manufacture or sale of merchandise or
goods of any kind or for trade or business whatsoever or for the display of advertising
or COmmercial signs.
3. No fences Or hedges over 4 feet in height shall be erected on said premises
and such fences or hedges shall be maintained and kept in good appearance.
4. No stables or outside toilets shall be erected on said premises and no nuisance
shall be created or allowed on said premises and no use shall be made thereof that shall
be dangerous to the health of, or offensive to the senses of sight or smell of the
parties of the first part, their heirs and assigns, as owners of the premises adjoining
the premises thereof.
5. No part of any dwelling or garage shall be constructed on anyone lot within
30 feet of street line or within 10 feet of other boundaries of said lot and no part of
any cesspool shall be within 5 feet of any boundaries of said lot.
6. No fowl, poultry, animals or livestock shall be kept on said premises other
than domestic pets. No trailers shall be kept, used or allowed upon said premises except
when kept within an enclosed garage.
7. These covenants and restrictions shall run with the land hereby conveyed and
shall bind and inure to the benefit of the said parties hereto, their heirs, and admin-
istrators and assigns until January 1, 1982 and said covenants and restrictions may be
enforced by action for damagss or injunctions or both until the said 1st day of January,
