Said premises shall be subject to the following
covenants and restrictions, which will run with the land:
1. The premises shall be used only for a single-family
residence. The dwelling shall not exceed two-stories in height,
with an attached garage for not more than two automobiles. A two-
story dwelling shall contain a first-floor area of not less than
1,000 square feet and a one-story dwelling shall contain a floor
area of not less than 1,500 square feet, (excluding attached
;arage).
2. No dwelling or structure may be erected or modified
;ithout the prior written approval of the site location and
building plans and specifications by the party of the first part.
3. No mobile type home or trailer shall be kept, used,
or allowed on said premises with the exception of a boat trailer,
which shall be stored near the rear boundary.
4. No animals, livestock or poultry of any kind shall be
~aintained on the premises, except domestic animals, which shall be
housed in the dwelling.
5. These covenants and restrictions will remain in force
and effect until January 1, 1987, and may be enforced by an action
and damages, an injunction or both.
6. The party of the first part, her successors or assi~l[
reserves the right to alter, modify, extend, terminate or' annul
any of these covenants, in whole or in part, by agreement with the
owner of the premises.

Gentlemen:
This is in reply to your letter of May 9th regarding the two
twenty foot strips on the proposed minor sub-division.

When I first appeared before the Board with this petition, I
stated that the strips were owned by Mrs. Kirchgessner and that,
upon approval of the minor sub-division, she would convey them to
the adjoining owners so that each strip would become part of the
adjoining parcel and not a separate unit

The subdivision of property of Appolonia Kirchgessner
was reviewed at the regular meeting of the Southold Town Planning
Board on May 2, 1977.
The consensus, of the board was that a d~termination will
have to be made as to who owns tlhe two 20 foot Jogs and they
will have to be disposed of on~ way or another.

This is to confirm my statement of last night that the
20 foot strip along the westerly boundary of the Norris
property adjoining Kirchgessner is intended to be an easement
to the sewerage pollution control plan site. Young & Young,
Surveyors, have also assured me this was the intended purpose
for the strip.
