The following action was taken by the SOl.thold Town Planning
Board at a regular meeting held November 24, J980.
RESOLVED that whereas, a formal applicat:'.on for the approval
of a subdivision plat, entitled Minor Subdivi:lion of Katie J.
Dexter located on the north side of Park Avencle at Mattituck was
submitted to the Planning Board on July 25, 1980, and an application
fee of $50 was paid on July 25, 1980, and
WHEREAS, a public hearing was held on th3 said subdivision
application and plat at the Town Hall, Main Road, Southold, New
York, on November 24, 1980 at 7:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said s~bdivision plat and
application,
Now, therefore, be it RESOLVED that the E.pplication of Katie
J. Dexter for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C., be approved and the chairman be authorized
to endorse his approval on the map.
I enclose negative declaration regarding SEQRA and will
forward you a copy of the map when I have it signed.

NEGATIVE DECLARATION
November 24, 1980
Pursuant to Article 8 of the Environmental Conservation Law
state Environmental Quality Review Act and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that Southold Town Planning Board as lead
agency for the action described below has determined that the
project will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Katie J. Dexter located on the
north side of Park Avenue at Mattituck is a two-lot residential
subdivision.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
As the subdivision is not within 300 feet of tidal
wetlands, comments were not solicited from the New York
State Department of Environmental Conservation.
The Suffolk County Department of Health Services
indicates that conditions are suitable for individual
sewage disposal systems but cautions that water quality
in the area has a history of nitrate contamination.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

As requested, I have reviewed the above referenced project in respect to
water supply and sewage disposal facilities.
Information available indicates that conditions are suitable for an indi-
vidual sewage disposal system; however, water quality in the area has a
history of nitrate contamination.
In addition, this Department does not recommend the creation of parcels
less than 40,000 square feet in area where private wells and individual
septic systems are proposed.

Appellant has appealed to this Board seeking a variance
approving the insufficient area of two proposed parcels,

in relation to the Code requirements is not substantial;
that if the variance is granted no substantial detriment to
