Dear Mr. Hickey:
The following actions were taken by the Southold Town
Planning Board on Monday, December 18, 1989.
A final public hearing for the above mentioned lot line
proposal was held and closed. The following motion was made and
adopted:
WHEREAS, Martha Husing, is the owner of the property known as
Martha Husing located on Peconic Bay Blvd. at Mattituck; and
WHEREAS, a formal application for the approval of this lot line
change was submitted on June 20, 1989; and
WHEREAS, the Southold Town Planning Board pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617 Title
6NYCRR declared itself Lead Agency and issued a Negative
Declaration on November 20, 1989; and
WHEREAS, a final public hearing was held on said lot line change
application at the Town Hall, Southold, N.Y. on December 18,
1989 at 7:30 p.m.; and
WHEREAS, all the requirements of the Subdivision Regulations of
the Town of Southold have been met; and
be it therefore,
RESOLVED that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated October
26, 1989.

It was noted that Mr. Thomas Hickey, agent, will file the
following deeds before the end of the year:
1. The new deed for the south westerly part of the
Suffolk County Tax Map (SCTM)#1000-122-7-8.3 shall be
deeded out to the current owner of
SCTM #1000-126-2-15.2 with the following covenants and
restrictions:
The south westerly part of SCTM #1000-22-7-8.3 shall
not be improved by a single family residence, and,
further shall be considered merged with
SCTM #1000-126-2-15.2.
A draft deed with this restriction on the south westerly
lot must be submitted for the Planning Board's review before
filing.
The Planning Board Chairman endorsed the maps at the
meeting. Enclosed please find a copy of the endorsed map for
your records.

Pursuant to your request, I reviewed the description on
the above referenced matter, and it is correct. Enclosed
are copies of Mr. Van Tuyl's description, a portion of the
survey showing the premises, and the unexecuted deed.
A boundary line that is South 34 degrees 20 minutes 10
seconds East in one direction is North 34 degrees 20 minutes
10 seconds West going in the opposite direction. The
description here begins at the point on Peconic Bay Blvd.
and moves clockwise and closes at the place of beginning.
However, the first two courses are from the description of
the overlapping lot and are described on the survey coming
in the opposite direction than the description at issue.
Reading the description and following the survey, it is
obvious that it is correct.
It does not matter whether property is described
clockwise or counterclockwise. If you want the description
to run counterclockwise, then the other three courses will
need to be reversed in the description (South to North and
East to West) so it will not be the same as the survey.
Between Bill Wickham and Roderick Van Tuyl, there is over
one hundred years of real estate describing experience, but
for what it is worth, I can assure you the description is
correct.

Dear Mr. Hickey:
The following actions were taken by the Southold Town
Planning Board on Monday, November 20, 1989.
RESOLVED that the Southold Town Planning Board do an
uncoordinated review, declare the Planning Board lead agent, and
as lead agent, under the State Environmental Quality Review Act,
grant a negative declaration.
RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated January 19, 1989.
Final maps must be submitted within six (6) months of the
date of the sketch approval. If such plat is not so submitted,
or an extension of time is not requested by the applicant and
granted by the Planning Board, approval of the sketch plan may
be revoked by the Planning Board.
RESOLVED that the Southold Town Planning Board set Monday,
December 18, 1989 at 7:30 p.m. for a final hearing.
