RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled Minor Subdivision of Martha Husing dated January 2, 1981, was submitted to the Planning Board on January 29, 1981, and an application fee of $50.00 was paid on January 29, 1981, and WHEREAS, a public hearing was held on the said subdivision application and plat at the Town Hall, Southold, New York, on February 26, 1981 at 8:15 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, Now, therefore, be it RESOLVED that the application of Martha Husing for approval of said subdivision plat prepared by Roderick Van Tuyl dated January 2, 1981, be approved and the chairman be authorized to endorse approval on said subdivision plat. Mullen, Jr · .NEGATIVE DECLARATION March 17, 1981 Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of $outhold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Martha Husing is a two-lot residential subdivision located at Mattituck. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the projeCt be implemented as planned. Because there has been no response in the alloted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Applicant should be aware that a permit may be required because of the proximity to the freshwater wetlands. Because there has been no response in the alloted time from the Suffolk County Department of Health Services it is assumed that there is no objection nor comments by that agency. The Suffolk County Planning Commission has indicated that because Nature Conservancy haS seen fit to acquire the adjoining parcel containing the body of water known as Horton Creek, measures should be taken to insure that any construction activity that takes place upon Lot 2 dOes not effect the conservation parcel by depositing silt or other debris upon it or by damaging its vegetation in any way. Just to set the record straight, we did not ask that the requirement to show the entire property be waived. What we requested was that we be permitted to furnish either the Suffolk County Tax Map or a sketch showing the location of the entire parcel with a survey of the parcel to be conveyed. In reading the regulations as contained in the resolution, this is exactly what the Suffolk County Planning Board permits namely, that the map contain sufficient data to determine the location of the property, that it be drawn on a scale of one inch equals two hundred feet, that it is plotted from a reliable source of information such as the Suffolk County Tax Map and that it show the approximate area of the entire tract and the approximate length of each boundary line. The parcel being cut out of the track has to be surveyed with the exact direction and exact length of each boundary line and showing all existing buildings on the property. Apparently there has been some failure of co~Lm~nication and I have contacted Mr. Van Tuyl's office and they will prepare the large map covering the entire parcel in accordance with the Suffolk County Planning Board regulations. This map is not a guaranteed survey but does meet the requirements of the Suffolk County McNULTY, GliMARTIN, DIPIETRO, NESCI ~ HAEFELI ATTORNEYS ~ COUNSELORS AT LAW Planning Board and can be obtained at a much more modest Cost. Unfortunately, in today's world, we sometimes use the term map and survey interchangeably whereas surveyors have a definite understanding as to what a survey is. Apparently the misunderstanding arose in this situation over the distinction between map or sketch and an actual survey. ' In addition, we have been advised that not only must a formal application be made but in addition the Suffolk County Tax Map is not acceptable to show the large parcel and that a sketch will not be acceptable but that an official survey costing a thousand dollars or more must be submitted. We realize that many of these regulations are imposed on you but we would appreciate a waiver in these circumstances.
